Job Applicant Privacy Policy

Poshmark’s mission is to put people at the heart of commerce, empowering everyone to thrive. We strive to
protect the privacy of our job applicants and any personal information shared with us. This Job Applicant Privacy
Policy (“Policy”) describes the types of personal information Poshmark, Inc. and our subsidiaries and affiliates
(collectively “Poshmark”, “we”, “us”, and “our”) obtain when you apply for a job with Poshmark, how we may
collect, use, and share it, and how you may exercise your rights and choices with respect to that data. By
submitting an application, you acknowledge and understand that we will collect, use, disclose and transfer your
information as stated in this Privacy Policy and as permitted or required by applicable law.

Notice at Collection and Use of Personal Information

We may collect the following categories of personal information about you:

● Identifiers: Name, alias, postal address, phone number, email address, unique personal identifier (e.g.,
employee number, unique pseudonym, or user alias; and other forms of persistent or probabilistic
identifiers), Social Security number, driver’s license number, state identification card number, national
identification number, PAN card, or other similar identifiers.
● Personal Records: Signature
● Protected Classifications: Characteristics of protected classifications under California, federal, or
international law, such as race or ethnic origin, sex, gender, disability, criminal records (where permitted
by applicable law), citizenship status, and military and veteran status.
● Professional or Employment-Related Information: Resume/CV information, work experience, work
experience, certifications, professional qualifications, skills, language proficiencies, references, and related
information.
● Education Information: Education history and transcripts.
● Other Information You Provide: We may also obtain other information about you if you provide it to us,
for example, in an email or survey where you choose to identify yourself.

We obtain most of this information directly from you, for example, when you complete an application, survey, or
otherwise communicate with us. We may also obtain information about you from other categories of sources, such
as from:

● Job board websites you may use to apply for a job with us
● Vendors who provide services on our behalf
● Prior employers and other individuals, for example for employment references, professional references,
and referrals
● Providers of background check, credit check, or other screening services (as permitted by law)
● Government entities
● Public social media profiles or other publicly-available sources
● Employment agencies or recruiters

We may use this information for certain business purposes, which may include using the information to:
● Evaluate your candidacy for the role(s) you applied for
● Communicate with you about or in connection with your job application and the recruitment process,
including current or previous requisitions
● Verify your information and conduct background, employment eligibility, and reference checks
● Provide, analyze, and improve our application and recruitment process
● Creating and submitting reports, as required by applicable laws or regulations
● Keeping records related to our hiring processes and other internal administration
● Help to ensure security and integrity, and to verify or maintain the quality or safety, in connection with
the Poshmark recruitment and application process
● Allow our vendors to perform services on our behalf in connection with the recruitment and application
process
● Comply with law, legal processes, or other legal, regulatory or governmental obligations
● Where we believe it is necessary to fulfill or protect our legal rights, interests, and protect the interests of
others

The categories of information we obtain will be retained to fulfill the purposes for which they are collected or as
needed to satisfy applicable governmental laws, regulations, investigations, proceedings or for reasonable backup,
archival, audit, legal or other similar purposes. To determine the retention period, we may consider the amount,
nature, and sensitivity of the information, our business and compliance needs, the potential risk of harm from
unauthorized use or disclosure of information and if we can attain our objectives by other means, as well as our
legal, regulatory, tax, accounting, and other applicable obligations.

We do not disclose your personal information to third parties in exchange for monetary or non-monetary
consideration (hereafter, referred to as the “Sale” of personal information) or for cross-context behavioral
advertising (hereafter, referred to as the “Sharing” of Personal Information). To the extent we process deidentified
information, we will maintain and use the information in deidentified form and will not attempt to reidentify the
information unless permitted by applicable law.

The information practices described in this section also apply to the personal information we may have collected
about you during the 12-month period preceding the “last updated” date of this Policy.

Disclosures of Personal Information

We may disclose your information to our service providers in connection with the job application process. For
example, we may share your information with vendors that provide recruitment software and services or help
conduct employment verification and background checks.

In addition, during the preceding 12-month period from the “last updated” date of this Policy, we may have
disclosed personal information about you to a third party for one or more of the business purposes described
above. The table below lists these third parties and the categories of personal information that may have been
disclosed to them.

In addition, we may disclose and may have disclosed your personal information to business transfer participants in
transactions or potential transactions whereby we sell, transfer or otherwise share some or all of our business or
assets, including your personal information, such as a corporate divestiture, merger, consolidation, acquisition,
reorganization or sale of assets, or in the event of bankruptcy or dissolution.

Security

Poshmark employs organizational, technical, and physical safeguards designed to protect personal information
from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Depending on the
circumstances, our safeguards to protect personal information in electronic and physical records may include
facilities access restrictions, system access controls, firewalls, data encryption, and other security best practices.

International Data Transfers

We are headquartered in the United States and may disclose your information to service providers and other
recipients in the United States and worldwide. If you are located in the United Kingdom or other regions with laws
governing data collection and use that may differ from U.S. law, please note that we may transfer personal
information to a country and jurisdiction that does not have the same data protection laws as your jurisdiction. In
the event of an international data transfer, we use appropriate transfer mechanisms, such as the UK International
Data Transfer Agreement, to protect the information we process in a manner that complies with applicable laws
and regulations.

Legal Basis for Processing Your Information

Poshmark collects and processes your information on the basis of different legal grounds, as follows:

● Performance of a Contract: The personal information we collect and use about you during the application
and selection process is necessary in order to enter into a contract for employment with us.
● Legal Obligations: We may collect and use your personal information to comply with a legal obligation.
For example, we may be required to submit demographic reports.
● Legitimate Interest: We may collect and use your personal information based on our legitimate interests.
Such legitimate interests will include where we send you communications about other Poshmark roles
you may be interested in, where we believe you have a reasonable expectation that we will perform a
particular type of processing on your behalf, or where such processing is necessary for fraud detection
and prevention.
● Consent: Finally, in certain situations, Poshmark may rely on your consent in order to process your
personal information.
Your Rights

Depending on your location, you may have certain rights, choices, and means available to you when it comes to
your personal information, including:

● Right to Know: The right to request information about the personal information related to you that we
have collected, used, disclosed, and sold during the past 12 months.
● Right to Access: The right to request the specific pieces of personal information we have collected about
you during the past 12 months.
● Right to Correct: The right to request that we correct inaccurate personal information about you. Please
note that, irrespective of this right, you should keep your personal information on file with Poshmark up
to date and inform us of any significant changes to it.
● Right to Delete: The right to request that we delete certain of the personal information we have collected
from you.
● Right to Withdraw Consent: The right to withdraw consent, where we rely on your consent to process
your information. Withdrawing your consent will not affect any processing that has already taken place at
the time of the withdrawal.

To make a request to know, access, correct, or delete your personal information, please contact
privacy@poshmark.com. We may need to request specific information from you to help us confirm your identity
and ensure your right to access, correct, or delete your personal information (or to exercise any of your other
rights), and may charge you a fee for such request, where allowable. We cannot process your request if you do not
provide us with sufficient detail to allow us to understand and respond to it.

The steps we take to confirm your identity may vary depending on the type of request you make and the
jurisdiction you are in. However, in general, we will require you to provide certain information (such as your name
and email address) to confirm your identity. In addition, if you ask us to provide you with specific pieces of
personal information, we reserve the option to require you to sign a declaration under penalty of perjury that you
are the individual whose personal information is the subject of the request.

Please note, however, that your requests and choices may be limited in certain cases, such as the following
examples: if fulfilling your request would reveal information about another person, or if you ask to delete
information which we are required by law or have compelling legitimate interests to keep.

Californian Applicants

You can submit a request to know, access, correct, or delete by emailing us at privacy@poshmark.com. If you
choose to exercise any of these rights under the CCPA, you have the right not to receive, and you will not receive,
discriminatory treatment by us.

Please note that California law also provides consumers with the right to opt out of the Sale or Sharing of personal
information and to limit the use/disclosure of sensitive personal information in certain instances. We do not Sell or
Share job applicants’ personal information or use sensitive personal information to infer characteristics about you,
except as otherwise permitted or required by law.
To submit a request as an authorized agent on behalf of a California resident, please email us at
privacy@poshmark.com, and be sure to include proof that the individual in question has provided permission for
you, the authorized agent, to submit the request. Please note that, for requests submitted by an authorized agent,
we may still require the relevant individual to verify their own identity directly with us.

Canadian Applicants

We will process your information with your consent, unless an exception applies. Your consent may be explicit,
such as when you check an online box approving the collection of your information. Or it may be implied based on
the circumstances or your actions. After collection, we may transfer your information outside Canada for
processing. Please also review the “Security” and “International Data Transfers” sections of this privacy Policy,
which describe how we protect that information and the risks associated with its transfer.

United Kingdom Applicants

UK applicants may have additional rights, including a right to restrict the processing of your personal information;
and to obtain the personal information you provide in a structured, machine readable format. In addition, you can
object to the processing of your personal information in some circumstances (in particular, where we don’t have to
process the data to meet a contractual or other legal requirement). Poshmark does not take any solely automated
decisions which have legal or other significant effects.
