AN ORDINANCE REQUIRING ALL HOUSEHOLD OF BARANGAY EL NONOK


TO COMPLY ZERO OPEN DEFECATION (ZOD) PROVIDING GUIDELINES
AND PENALTIES FOR VIOLATION AND PPROPRIATING FUND THEREOF.
PREPATORY NOTE

The 1987 Constitution particularly on Section 15 provides that "The State shall protect and
promote the right to Health of the people and install Health Consciousness among them.

Republic Act. 7160. Otherwise known as the Local Government Code of 1991, likewise, accord
every local government unit the power and authority to promote the general welfare within its
territorial jurisdiction including the promotion of health and safety of its constituents.

1. The Local government of Barangay El Nonok consistent with its vision of healthy
constituents is aware as to the effect of Unsanitary Disposal of human waste. Hence the
Local Government of Cinco is committed to implement the Zero Open Defecation (ZOD)
policy.

Be it ordained by the Sangguniang Barangay of El Nonok, Banga, South Cotabato during its
128th Regular Session assembled and unanimous sponsorship.

SECTION I. Scope and Coverage. This shall be applicable to all persons, resident, or
nonresident within the territorial jurisdiction of Barangay El Nonok, Banga, South Cotabato.

SECTION II. DEFINITION OF TERMS: when used in this ordinance the following words
shall mean understood as follows:
a) Zero Open Defecation (ZOD)-one hundred percent (100%) absence of Open Defecation
practice.
b) Community Service- refers to the services rendered to the Community by offender.
c) Defecate- to discharge fecal waste from the body of a person.
d) I. E. D. Campaign- Information, Education, and Dissemination Campaign.
e) Open Defecation- refers to the manner of excreting, discharging fecal waste on a place,
site or location other than the toilet comfort room, and leaving it exposed to the
environment.
f) Public Places- refers to all places that are accessible or open to the people in the
community.
g) Sanitary Toilet- refers to sanitation facilities/materials used to the collection of Human
feces and urine.

SECTION III. PROHIBITED ACTS


1. It is prohibited to defecate in open public/private places.
2. It is prohibited to throw human waste to include diapers, napkins, tissue paper outside
the toilet or any open spaces public/private.
3. It is also prohibited to throw human waste/ animal excreta in waterways, river, creeks,
drainage and canal that will contaminate surface of water.

SECTION IV. ADMINISTRATIVE PROVISIONS

Every Household within the territorial jurisdiction of Barangay El Nonok is required to


have a sanitary toiled in their respective homes to ensure proper disposal of human waste in
order to prevent the occurrence of diseases caused by open defecation.
The Barangay Government of Barangay El Nonok shall provide free toilet bowl,
provided that as a counterpart the owner shall be responsible in the construction of the toilet and
provide other materials needed for its completion.
The Barangay is required to have a Barangay Sanitation Task Force who shall inspect,
monitor, and have master list of all household and establishment who have and do not have
sanitary toilets.

SECTION V. CREATION of Barangay ZOD Task Force and its function.

There shall be a creation of Barangay ZOD Task Force to be composed of the following:
Chairman: Kgd. On Committee on Health
Member:
Kgd. Member of the Committee
Rural Health Midwife
BHW/BNS
NDP (DOH NURSE)

The Barangay ZOD Task Force shall conduct a monthly monitoring within the Barangay to
ensure the provision of this ordinance are being complied with and being followed by their
constituents they shall submit a written report to the ZOD implementing Team for validation, and
make appropriate action.

SECTION VII. PENAL PROVISION: Any person violating and not complying with the
ordinance shall be penalized and shall render the following community service.

1st Offens - Two (2) days Community Service


2nd Offense - Three (3) days Community Service
3rd Offense - and subsequent offenses Five (5) days Community Service

SECTION VIII. BUDGET AND APPROPRIATION

The Barangay Government shall have appropriate fund from the 20% Development Fund
of the Barangay for the implementation of Zero Open Defecation (ZOD) ordinance.
SECTION IX. SEPARABILITY CLAUSE. Any ordinance acts and issuances in contrary in
whole or in part to any provision of this ordinance are hereby superseded accordingly.

Enacted Passed and Approved:


This ordinance shall take effect upon approval.
