SALE DEED OF SIBEN TALUKDAR
- BETWEEN -
1.MR. SIBEN TALUKDAR Son of Late Birendra Nath
Talukdar PAN NO. ABQPT8868A age about 57 . years, 2. DIPTIREKHA
DAS, Wife of Mr. Siben Talukdar, PAN NO. ARRPD6176A age about 55
years old, both are resident of Protech Green Block-C Flat No. 8K
Namghar Path, Opposite Namghar, Guwahati Panjabari PO Panjabari PS
Satgaon Guwahati-781037, in the district of Kamrup(M), Assam,
hereinafter called the SELLER/1ST PARTY (which expression shall
unless and otherwise contrary or repugnant to the context and meaning
made herein, include her heirs, successors, assignees and representatives)
of the FIRST PART.
- AND -
AND WHEREAS the said Seller has agreed to sell and transfer as
well as the purchaser has agreed to purchase the said flat (hereinafter
referred to as the said Flat') together with all permanent hereditament and
absolute right of use and occupation of the said flats together with
proportionate share of land.

1. That the Seller is the absolute owner and exclusive physical possession
holder of the aforesaid residential Flat together with all amenities fully
described in the schedule herein below and she has every right, title,
interest and possession upon the said flat.
2. That the purchaser has approached the said seller and desire to
purchase the said flat and the seller has also agreed to sell the same in
appropriate consideration.
3. That the value of the said flat including ornamental cost and all other
modern fittings, miscellaneous structures and amenities etc. along
with the proportionate share of the land is fixed at Rs.23,00,000/-
(Rupees Twenty three Lacs) only.
5. That the first party will obtain the necessary sale permission from the
Deputy Commissioner, Kamrup (Metro), Guwahati at her own cost and
the expenditure for registration of the final sale deed shall be borne by
the second party.
7. That the seller shall sell and the purchaser shall purchase the said
flat together with all permanent hereditament and absolute right, of the
use and occupation of the said flat and together with all benefits,
facilities together with proportionate share of land.

8. That the seller do hereby covenant with the purchaser that she has paid
all her share of taxes and other liabilities and outgoing expenses payable
in relation to the said flat up to date and in case any amount is hereby
found due from the seller or person or authority or any other account
whatsoever in connection with the said flat, the same shall be paid and
discharged by the seller.
9. That, the Purchaser shall pay the balance amount in the Bank Account of
the Seller or by Bank draft within 3 months from the date of agreement.
After completion of the said payment the Seller shall be liable to put his
signature in the Deed of Sale presented by the Purchaser and handover
the key of the house to the Purchaser.
11. That the seller is the absolute owner and exclusive physical
possession of the said Flat, free from all encumbrance, charges, lien,
claim, demands etc. and if any defect of title will be made out at any
point of time, the seller will refund the advance money to the
purchaser.

A residential flat, measuring 950 sq. ft. (super built up area) on the
3rd Floor being Flat No. 3B of the Building "GAURAV APARTMENT
FLAT"with one car parking space on the ground floor along with the
undivided proportionate share of land measuring 13.97 Are (01 Bigha, 0
Katha, 0 Lechas) covered by Dag No. 1880 (O) 947(N) of K.P. Patta No.
06(O) 1442(N) in Revenue Village – Maidamgaon, Mouza - BELTOLA,
under Dispur Revenue Circle, in the district of Kamrup (Metro),
Assam,
IN WITNESS WHEREOF : both the parties have put their
respective seal and signature on this DEED OF AGREEMENT FOR
SALE OF A FLAT , the day, month and years as mentioned earlier with
sound state of health, mind without any duress and coercion from any
corner in presence of the following two witnesses :
