Answer any ONE of the following CASE STUDY: (1x4=4)


6. A convict was awarded death sentence by the Trial court and it was confirmed by
the Highcourt. The Supreme court did not interfere in the lower courts order. The
prisoner filed a mercy petition before the president of India to pardon him. The
president rejected the mercy petition without assigning any reason for doing so. Can the
court ask the president for his reason?
7. ‘ Z’ a member of the Parliament was put under preventive detention, while the
parliament was in session. ‘ Z’ challenges his detention order on the ground that a
member of the parliament cannot be detained so as to prevent the member from
exercising his constitutional right as a member of the parliament. Discuss the
validity of the detention order.
