[Sub.:- Legal notice under Section 138 of the Negotiable Instrument Act, 1881]

Sir,

Kindly note, that, as per the instructions of my client, Mr. Rajesh , aged about 40 years,
Nationality- Indian, residing in XYZ Road, Vile Parle-400134, (herein referred to as 'my
client'), hereby I serve upon you the following notice which solemnly states:-

1. That, my client is a dealer of various kind of machines and bears his office at 26,
Eddigarh, Mumbai-400123.

2. That, you had approached my client for a bulk delivery of coffee vending machines on
29.03.2024 as per the order no. Xyc456.

3. That, my client relied on your promise of payment through cheque and delivered the
order at the address mentioned in the bill no. 1245 on 30.03.2024.

4. That, a transaction of 10,00,000 took place between you and my client bearing number
1234 from XYZ Bank, Andheri-567, IFSC Code-CYZ567, Branch Code-678, dated-
30.03.2024 to pay off the liabilities you had incurred after buying Order no. Xyc456.
5. That, my client deposited aforementioned cheque, bearing no. 1345 to XYZ Bank, Shukla
Street, Wafa Chowk, Mumbai-400123, IFSC Code-GYH899, Branch Code- 577 in order to
redeem for payment of the above-mentioned invoice on 01.04.2024.

6. That, my client failed to withdraw the stipulated amount as the bankers evaluated the
cheque 'dishonored due to lack of funds' and intimated the same to our client through
cheque return memo with number 6077 dated 01.04.2024.

7. That, you have commited an offence under Section 138 of Negotiable Instruments Act-
1881 on account of dishonoring the cheque of bearing number 1234.

Now, through this legal notice I hereby call upon you addressee to make the payment of
Rs.10,00,000 applicable bank charges of the said dishonoured cheque along with any other
extra charges or fine incurred which you are liable to pay, within fifteen days of the receipt
of this notice, failing which my client shall be constrained to take legal action against you
by way of civil as well as criminal proceedings, at your risk as to cost and consequences
resulting therefrom. Copy of this legal notice is also preserved at my office for future
reference.
