SUB: LEGAL NOTICE UNDER SECTION 138 OF THE
NEGOTIABLE INTRUMENTS ACT, 1881

Dear Sir,

Under the instructions from and on behalf of my client Mr. Rajesh, Stellar
Park C-25, Noida- 201301, Uttar Pradesh (hereinafter referred to as ‘my
client’),

I serve you with the following notice,

1. That the machines you purchased from my client was delivered in the
reasonable time period for which a cheque bearing no. 43256 dated
22/06/2024 for an amount of Rs. 10, 00, 000 was drawn on the Bank of
Baroda, Noida-110076, Uttar Pradesh branch, was issued as part payment
by you in lieu of discharge of your financial liabilities to my client.

2. That the mentioned cheque was deposited by my client with his banker
State Bank of India, Noida-110076, Uttar Pradesh, for encashment on
29/06/2024.

3. That the said had been returned by your bank to my client with the
endorsement “Dishonored for insufficiency of funds.” The Bank has
informed us through their cheque return memo dated 28/06/2024.

4. That for the first time my client came to know about the dishonoring of
the said on 30/06/2024.

5. That on account of the dishonoring of the cheque you are guilty of


committing offences u/s 138 of the Negotiable Instruments Act, 1881 (as
amended up to date).
Now through this legal notice I hereby call upon you addressee to make the
payment of Rs. 10, 00, 000 + applicable bank charges of the said dishonored
cheque, within fifteen days of the receipt of this notice, failing which my
client shall be constrained to take legal action against you by way of civil as
well as criminal proceedings which may result into punishment under the
section 138 of the Negotiable Instruments Act, 1881 with the imprisonment
for [a term which may be extended to two years], or with fine which may
extend to twice the amount of the cheque, or with both.
