Trade regulations, taxes and social security


Since this Agreement is for a remote job/teleworking, the compliance with the trade regulations and the
taxation of the remuneration is the responsibility of the Contractor. The Contractor must take care of/be
liable for the deduction of social security contributions or taking out any compulsory insurance.
Please note that the legal provisions in this regard differ depending on the country.
DCS DWC-LLC recommends that the Contractor take out social insurance at his/her own expense if
he/she does not have any.
DCS Communication Center DWC-LLC assumes no liability.

Sickness & annual leave


DCS Communication Center DWC-LLC does not make payments for/such as annual leave, sick leave
and sick leave certificates. DCS Communication Center DWC-LLC assumes no liability.

Automatic notification
The Contractor expressly agrees that he/she may be automated via the telephone system in the event of
an increase in call volume, or that he/she may be personally informed by the project management.
Different media such as pop-ups, emails, calls or SMS may be used for this.
State of health
I, ……………………………………………………, hereby certify with my signature that my state of health
is in no way impaired for the performance of the activity. If there is a change to my health status that
partially or completely prevents the execution of my work, I am aware that I must inform the Client
immediately. In this regard, I, ………………………………………, bear full responsibility in all respects as
the Contractor. DCS Communication Center DWC-LLC is not liable.
Recording of sound files
For quality reasons, sales and consulting conversations are recorded and stored for a maximum of 3
years (depending on the project). After expiry of the specified retention period, the recordings are
automatically deleted. The Contractor expressly agrees to this procedure.
Miscellaneous
The Contractor confirms that he/she has provided all information conscientiously and truthfully and
commits to report any changes to the Client immediately.
Equipment
All technology, including PC equipment, required for the performance of the activity shall be provided by
the Contractor for the duration of the Agreement. The Contractor is responsible for providing an Internet
connection for the purposes of the Client's request.
14) Place of fulfilment/jurisdiction

The parties agree that shall be the place of jurisdiction and

performance for their rights and obligations arising from this Agreement.

hereinafter referred to as the "Contractor".

The above Parties have agreed to the following Contract for Services:

1) Start date of the working relationship

The working relationship shall commence on 10 / 06 / 2024 .

2) Probationary period

This Contract for Services is concluded for an indefinite period of time. The first 3 months shall constitute
a probationary period. During this probationary period, the working relationship may be terminated by
either party with a notice period of two weeks.
The Client's right to terminate the working relationship immediately (lack of quality, inadequate technical
equipment, non-compliance with telephone-related and work rules, non-compliance with the work
schedule, violation of data protection or the duty of confidentiality in any respect) remains unaffected.

3) Activity

 The Contractor is hired as a telephone operator (telephone customer advisor, member of


customer service staff).

 Telephone customer advice Inbound/outbound calls, telephone customer service/advice, back


office activities, mail processing, order acceptance, complaints management, complaints
processing, returns processing, and handling delivery service matters in all respects form part
of the content of the activity.

 The Contractor undertakes to take care of the handling of customer concerns (telephone
customer advice inbound/outbound calls, telephone customer service/advice, back office
activities, mail processing, order acceptance, complaints management, complaints processing,
returns processing, delivery service matters in all respects) for the Client in accordance with the
relevant guidelines of the Client provided during training, in each case at his/her own economic
and legal risk.

The Contractor undertakes also to work as a telephone operator in other areas (working or making
telephone calls in other projects) which correspond to his/her previous knowledge and skills if required by
the Client. This applies insofar as this is reasonable and does not involve a reduction in wages.
The exact times of deployment shall be specified weekly between the two parties.

4) Perfomance of tasks

The Contractor is responsible for providing an Internet connection for the purposes of the Client's request.
In addition, the Contractor undertakes to carry out the activity in a duly furnished room (see Onboarding
Form). During working hours, no third party may have access to or view of the work area, workplace and
equipment other than the Contractor and the Client. The Contractor undertakes to comply with the above-
mentioned requirements required by the Client.
The services of the Contractor shall be considered fulfilled and accepted if the Client does not raise
objections immediately.
If defects in the quality of the assigned service are proved to exist by the Client, the Contractor is obliged
and entitled to make corrections.
Objectives of the individual divisions/departments/projects, such as hourly production figures, talk times,
processing times, forwarding rates, specifications of the number of emails, will be announced by the
training officer/trainer during the initial training and must be complied with or strived for by the
Contractor. Repeated non-compliance with the average production values or production figures leading
to economic damage for the Client gives the Client an immediate right of termination.

5-) Remuneration for work

Contractor is registered in the Client's system.

6) Working hours

The regular weekly working hours are at least 30 to 40 hours per week (part-time/full-time), depending on
agreement. The beginning and end of the working day will be governed by operational requirements.

7) Customer data and data protection

Both parties undertake to take full account of the provisions of the General Data Protection Regulation
(GDPR). Data secrecy will continue even after termination of the Contractor's activities.

1. During the collaboration, the contracting parties undertake to keep secret all documents
that are made available to them for the execution of the Contract. Upon termination of their
collaboration, the Contractor undertakes to return to the Client and to destroy all business
documents in full, without making copies.

2. Names, company names and products of the Client are to be treated as absolutely confidential
and may not be passed on to third parties.

3. The following customer-related data is generally processed: surname, first name, address,
telephone number, email address. All other data associated with the execution of the activity is
also subject to confidentiality and is secret.

4. For the duration of the working relationship, and even after he/she ceases work for the Client, the
Contractor agrees to handle all of the Client's trade and business secrets with the strictest of
confidence.

5. The Contractor is obliged to treat confidentially all information that he/she receives in the course
of his/her work.
The Contractor undertakes to comply with the GDPR (EU General Data Protection Regulation)
and to ensure that all provisions contained in the regulation are strictly complied with. If the
Contractor needs support that is related to the activity carried out, he/she may only obtain this
from another employee of the

The Contractor shall be fully liable for any damage caused by non-compliance with these provisions.
In particular, no information about the Client's partners and their names may be passed on.

6. Pertaining to all documents, the following document is signed as Appendix 1 to this Contract and
forms part of this Contract, to fully secure customer data and ensure data protection: Obligation
to maintain confidentiality and to observe data protection.

8) Confidentiality obligation

For the duration of the working relationship, and even after he/she ceases work for the Client, the
Contractor agrees to handle all of the Client's trade and business secrets with the strictest of confidence.

9) Secondary activity

Any secondary activity performed for a fee, or which interferes with the working relationship, shall only be
permitted with the Client's consent.

10) Contractual penalty

In the event that the Contractor terminates the working relationship in breach of the Contract, the
Contractor undertakes to pay the Client a contractual penalty amounting to 1 (one) month's net
remuneration. The average remuneration of the last 3 months shall be used. The Client''s right to assert
further claims for damages shall remain unaffected.

11) Termination

Upon expiry of the probationary period, the notice period is 14 days. Notice of termination must be issued
in writing.

12) Additional agreements

The main activity includes the handling of personal data. This is subject to the Federal Data Protection
Act. (BDSG). During working hours, mobile phones and writing materials and other means of recording
are strictly prohibited at the workplace.

13) Other provisions/ancillary agreements/place of employment

1. This Contract and any related annexes constitute the entire agreement between the contractual
parties.
2. There are no tacit, verbal or written side agreements. Amendments and additions to this Contract
shall only be effective if they have been agreed in writing. This also applies to changes to this
requirement for the written form.
3. Two copies of this Contract have been issued and signed.
4. All documents and, in particular, the Employment Contract and the obligation to maintain
confidentiality and to observe data protection are drawn up in German, English a language jointly
understood, spoken and read by both parties. Both parties agree to this.
5. The Contractor confirms that he/she has provided all information conscientiously and
truthfully and commits to report any changes to the Client immediately.
6. The Contractor is bound to the address or place of work specified in the Contract. The
Contractor must therefore comply with the technical requirements required for the execution of
the activity. Should the place of work have to be changed for some reason, this is only
possible with the consent of the Client. In such a situation, the Contractor undertakes to
properly comply with all contractual provisions, in particular, data protection and provisions
relating to the workplace. Should the Client deem it necessary, its right to renew or update the
Employment Contract remains unaffected. All communications/exchanges of information are
subject to the written form clause.

14) Place of fulfilment/jurisdiction

The parties agree that DUBAI shall be the place of jurisdiction and performance for
their rights and obligations arising from this agreement.
