PERFORMANCE WORK STATEMENT

TEMPORARY GENERAL CLERK SERVICES

1. GENERAL: This is a non-personal services contract to provide Temporary General Clerk Services.
The MSPB shall not exercise any supervision or control over the contract service providers performing the
services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn,
is responsible to the MSPB.

1.1 Description of Services/Introduction: The contractor shall provide all personnel, equipment, supplies,
facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary
to perform Temporary General Clerk Services as defined in this Performance Work Statement except for
those items specified as government furnished property and services. The contractor shall perform to the
standards in this contract.

1.2 Background: The MSPB is an independent quasi-judicial agency within the Executive Branch of the
Federal government established to protect Federal merit systems against partisan political and other
prohibited personnel practices and to ensure adequate protection for federal employees against abuses by
agency management.

The Board serves as the highest-level administrative tribunal in deciding appeals relating to the personnel
actions and decisions of federal agencies and the Office of Personal Management.

1.3 Objectives: The objective of this requirement is to provide one Temporary General Clerk Services in
support of the operation of the MSPB Regional Office in Dallas, Texas.

1.4 Scope: The Contractor shall provide qualified personnel to accomplish the requirements specified in the
PWS. The Contractor shall efficiently and effectively manage the performance under this contract to ensure
all the necessary experience, training, and expertise required to accomplish all tasks is employed.

1.5 Period of Performance: The period of performance shall be for a period of 6 months with one (1) six-
month option period. The Period of Performance reads as follows:

Base Period: July 22, 2024 to January 21, 2025


Option Period I: January 22, 2025 to July 21, 2025

1.6 General Information

1.6.1 Recognized Holidays: The contractor is not required to work on the following recognized holidays:
New Year’s Day Labor Day
Martin Luther King Jr.’s Birthday Columbus Day
President’s Day Veteran’s Day
Juneteenth Memorial Day
Independence Day Thanksgiving Day
Christmas Day

1.6.2 Hours of Operation: The contractor is responsible for conducting business, between the hours of 8:00
a.m. to 4:30 p.m. (1/2 hour for lunch) Monday thru Friday except Federal holidays or when the MSPB
facility is closed due to local or national emergencies, administrative closings, or similar MSPB directed
facility closings. For other than firm fixed price contracts, the contractor will not be reimbursed when the
MSPB facility is closed for the above reasons. The Contractor must at all times maintain an adequate
workforce for the uninterrupted performance of all tasks defined within this PWS when the MSPB facility
is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the
stability and continuity of the workforce are essential.

1.6.3 Place of Performance: The work to be performed under this contract will be performed at the Dallas
Regional Office, 1100 Commerce Street Room 620 Dallas, Texas ,75242. This work requires on-site
performance and is not eligible for remote work.

1.6.4 Type of Contract: The MSPB anticipates an award of a firm fixed price contract.

1.6.5 PHYSICAL Security: The contractor shall be responsible for safeguarding all MSPB equipment,
information and property provided for contractor use. At the close of each work period, MSPB facilities,
equipment, and materials shall be secured.

1.6.6 Identification of Contractor Employees: All contract personnel attending meetings, answering
MSPB telephones, and working in other situations where their contractor status is not obvious to third
parties are required to identify themselves as such to avoid creating an impression in the minds of members
of the public that they are Government officials. They must also ensure that all documents or reports
produced by contractors are suitably marked as contractor products or that contractor participation is
appropriately disclosed.

Contractor shall turn in all issued badges and identification cards to the COR upon termination of their
services under this contract. Contractors shall immediately report any lost or stolen badges or CAC to the
COR.

Credentials issued by the Government to Contractors are property of the U.S. Government. Contractors
must return all Government issued credentials to the PM, COR, or Office of Special Security (OSS)
Security Representative when it is determined that the credential has expired; is no longer needed for
contract performance; contract completion/termination; completion of employment with contracting
company; or any other condition in which the Contractor is ineligible for use or no longer requires the
credential. Failure by the Contractor to return government issued credentials may result in delay of final
payment and/or administrative sanctions under the terms and conditions of the contract and/or supplemental
security guidance.

1.6.7 Contractor Travel: Contractor will not be required to conduct travel in support of this PWS.

2. DEFINITIONS AND ACRONYMS:

2.1. DEFINITIONS:

2.1.1. CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to
the MSPB. The term used in this contract refers to the prime.

2.1.2. CONTRACTING OFFICER (CO). A person with authority to enter into, administer, and or
terminate contracts, and make related determinations and findings on behalf of the MSPB. Note: The only
individual who can legally bind the government.

2.1.3. CONTRACTING OFFICER'S REPRESENTATIVE (COR). An employee of the U.S. Government


appointed by the contracting officer to administer the contract. Such appointment shall be in writing and
shall state the scope of authority and limitations. This individual has authority to provide technical
direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a
change, and has no funding implications. This individual does NOT have the authority to change the terms
and conditions of the contract.

2.1.4. DEFECTIVE SERVICE. A service output that does not meet the standard of performance
associated with the Performance Work Statement.

2.1.5. DELIVERABLE. Anything that can be physically delivered but may include non-manufactured
things such as meeting minutes or reports.

2.1.6. KEY PERSONNEL. Contractor personnel that are evaluated in a source selection process and that
may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When
key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does
not have a firm commitment from the people that are listed in the proposal.

2.1.7. PHYSICAL SECURITY. Actions that prevent the loss or damage of Government property.

2.1.8. SUBCONTRACTOR. One that enters into a contract with a prime contractor. The Government
does not have privity of contract with the subcontractor.

2.1.9. WORKDAY. The number of hours per day the Contractor provides services in accordance with the
contract.

2.1.10. WORK WEEK. Monday through Friday, unless specified otherwise.

3. GOVERNMENT FURNISHED ITEMS AND SERVICES:

3.1. Services The government will provide basic services to include telephones, if required to accomplish
the mission, in addition to information technology while working in Government facilities.

3.2 Facilities Basic facilities such as workspace and its associated operating requirements (i.e., phones,
desks, utilities, information technology, and general office supplies) will be provided while working in
Government facilities.

3.3 Utilities: The Government will provide all utilities in the facility for the contractor’s use in
performance of tasks outlined in this PWS. The Contractor shall instruct employees in utilities conservation
practices. The contractor shall be responsible for operating under conditions that preclude the waste of
utilities, which include turning off the water faucets or valves after using the required amount to
accomplish cleaning vehicles and equipment.

3.4 Equipment: The Government will provide necessary equipment required to perform services while
working in Government facilities.

4. CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES:

4.1 General : The Contractor shall furnish all supplies, equipment, facilities and services required to
perform work under this contract that are not listed under Section 3 of this PWS.

SPECIFIC TASKS

5. Specific Tasks:

5.1. Basic Services. The contractor shall provide services for Temporary General Clerk Services.

5.2. Duties:
Receives incoming telephone calls and visitors, determines the nature of business, and tactfully refers calls
to the appropriate staff member.

Assist with receipt and distribution of incoming mail for the agency. Create, tab, and tab paper files,
indexes, and other documents as needed. Data entry and typing is done consistently on a personal
computer. Uses a variety of office equipment in conducting the work of the office, including but not limited
to personal computers, fax machine, copy machine, mail equipment, scanner, etc.

Communicates with court reporters and external customers to schedule telephone conference and
in-person and video hearings. Initiates inquiries regarding case processing and responds to appeal
inquiries on behalf of the Administrative Judge (AJ) of the office.

At the direction of the Supervisory Paralegal Specialist to respond to the public, appellants, and
their representatives, concerning potential, pending and past appeals and general Board procedures.

5.3. Experience: May require 2-4 years of experience in the adminisrative field or in a related legal
assistant area. Has very basic knowledge of commonly-used concepts, practices, and procedures in the
legal field.
