JOINT AFFIDAVIT OF RELATIVES

(RE: DISCREPANCY AS TO THE MOTHER’S NAME OF THE DECEASED)

We, PORFERIA DIMPAS CUDIAMAT, Filipino, of legal age, widow and a resident
of No. 72 Area B Kagawad Road, Batasan Hills, Quezon City, and ERLINDA RESUS
MENDIOLA, Filipino, of legal age, widow, and a resident of Alley 1 Area B Talanay, Batasan
Hills, Quezon City, after having been duly sworn to in accordance with law, hereby depose and
state, that:.

1. We personally know the late VIVENCIO SADIAN DELA PEÑA who died on
April 20, 2016 in his own family residence at 32 Kagawad Road, Area Talanay, Batasan Hills,
Quezon City. A copy of his Certificate of Death is hereto attached as ANNEX “A” hereof;
2. We know him well because I, Porferia, is his maternal aunt, her mother
Magdalena Sadian (also known by her married name as Magdalena Sadian Dela Peña) being my
second cousin, while I, Erlinda, is his cousin;
3. On account of our close blood relationship, we are in a position to attest to the
truth that his surviving legal wife is Flora Tagudar Dela Peña whom he married on November 3,
1982 in City Court, Caloocan City, Branch II;
4. Out of their marriage, they were able to produce three children, namely, WILMA
DELA PEÑA-SUPAN, ARMAN DELA PEÑA, and ADONIS DELA PEÑA, all were born in
Caloocan City;
5. By virtue of relationship with the deceased, we can likewise attest to the truth that
his parents are Victor Dela Peña and Magdalena Sadian (also known by her married name as
Magdalena Sadian Dela Peña) per his Marriage Contract and CENOMAR (copies attached as
ANNEXES “B” and “C” respectively).
6. In his SSS Records, however, he erroneously declared the late Arsenia Sadian as
his mother instead of Magdalena Sadian, the latter being his biological mother.
7. The reason why the late Vivencio declared Arsenia Sadian as his mother
was that after Magdalena died, the former was the one who raised and took care of him during
his lifetime. Thus, Vivencio must have considered Arsenia as his mother. Thus, this discrepancy
was committed by the late Vivencio himself.
7. As his close relatives, we are competent to attest to the truth the name Arsenia
Sadian as appearing in his SSS Records actually refers to Magdalena Sadian, the latter being his
biological mother per his Marriage Contract and CENOMAR.

That we are executing the foregoing Joint Affidavit in order to attest to the truth that his
mother is Magdalena Sadian (also known by her married name as Magdalena Sadian Dela Peña)
per his Marriage Contract and CENOMAR and not Arsenia Sadian per his SSS Records, in
support of Flora Tagudar Dela Peña’s claim for death benefits with the Social Security System,
and for whatever legal purpose it may serve.
