Accused, with the assistance of the Public Attorney’s Office, through the
undersigned counsel, most respectfully submits this Judicial Affidavit of their
witness EVELYN S. ALARCON in lieu of her direct testimony to form part
of defense evidence, and in support thereof avers:

The testimony of the Witness EVELYN S. ALARCON is being offered

for the following purposes:

1. To disprove and controvert all the material allegations contained in the

Information filed against the accused;

2. To corroborate the testimony of the accused;

3. To prove such other matters that are relevant to the defense of the
accused.

Q2. Natatandaan mo ba kung nasaan ka noong ika-26 ng Hunyo

2013, mga ika-7:15 ng gabi?
A2. Opo.

Q3. Nasaan ka ng naturang araw na yun?

A3. Naglalakad po ako sa kahabaan ng P. Dela Cruz Street
kasama ang mag-asawang akusado na Alverne.

Q4. Bakit kayo nasa lugar na yun nung araw at oras na iyon?
A4. Papunta po kasi kami sa Nova Square dahil may bibilhin
kaming maintenance na gamot para kay Annie Liwanag Alverne
(“Annie”).

Q5. Ano ang kakaibang nangyari noong araw na iyon, kung meron
man?
A5. Pagdating po namin sa harap ng Cathay Steel Corporation
narinig namin ang boses ni Bituin P. Quinto (“Bituin”) na minumura
ang mag-asawa, sabi niya “Putang-ina niyong mag-asawa, mga hayop
kayo”.
 Q6. Ano ang sumunod na nangyari, kung meron man?
A6. Tinanong ko po sino iyon, sinabi po ni Arthur na yun daw si
Bituin at wag na lang naming pansinin dahil manggugulo lang iyon.
Nagpatuloy na lang po kami sa paglalakad at bumili ng gamot ni Annie.

Q7. Ano ang masasabi mo sa bintang kina ARTHUR LORETO

ALVERNE at ANNIE LIWANAG ALVERNE ng Private
Complainant na si Bituin P. Quinto?
7. Hindi po totoo yun, wala pong nangyaring pananakit sa kanya
ng araw na iyon. Hindi po nila siya sinakal, ninakawan ng kwintas,
hikaw, bracelet at cash dahil ni hindi ng apo siya nilapitan ng mag-
asawa at sa halip ay sila pa ang umiwas sa panggugulo ni Bituin.

Q8. May nais ka pa bang sabihin kaugnay ng kasong ito?

A8. Sa ngayon ay wala po.

A4: Papunta po kasi kami sa Nova Square dahil may bibilhin
kaming maintenance na gamot para sa aking asawa na si Annie
Liwanag (“Annie”).

Q5: Ano ang kakaibang nangyari noong araw na iyon, kung meron
man?

siya si Bituin at wag na lang naming pansinin dahil manggugulo lang
iyon. Nagpatuloy na lang po kami sa paglalakad at bumili ng gamot ng
aking asawa.
Q7. Ano ang masasabi mo sa bintang sa iyo ng Private
Complainant na si Bituin P. Quinto?
A7. Hindi po totoo yun, wala pong nangyaring pananakit sa
kanya ng araw na iyon. Hindi po nila siya sinakal, ninakawan ng
kwintas, hikaw, bracelet at cash. Gawa-gawa lang po niya ang kasog ito
dahil matagal na po siyang may galit sa aming mag-asawa at mag
pagkabaliw po siya.

Q8. Paano mo naman nasabi na matagal ng may galit sa inyo ang

Private Complainant?
A8. Dati po ay nagtirik siya ng mga kandila sa harap ng aming
bahay ng madaling araw. Simula po ng araw na iyon ay parati na niya
kaming ginugulo at sa katunayan nga po ay sinampahan niya kami ng
kanyang mga gawa-gawang reklamo kagaya ng kasong ito.

Q9: May ebidensya ka ba ng nasabing insidente kung saan ay

nagtirik siya ng kandila sa harap ng inyong bahay ng madaling
araw?
A9. Opo ito pong Complaint namin sa Office of the Barangay
Public Safety Officer ng Barangay San Bartolome na may petsang ika-7
ng Marso 2013, at ito pong Report ng Guard na nakaduty ng
insidenteng iyon na si SG Galliguez CD mula sa King Billy Security
Agency, Green Heights Subdivision.

Copies of the Complaint dated March 7, 2013 and of the Report

executed by the guard on duty at said date are herein attached as
Exhibits “1” and “2” of this Judicial Affidavit.

Q10. May ebidensya ka din ba sa un among nabanggit na matapos

ang araw na iyon ay ginugulo na kayo ng Private Complainant at
sinampahan niya kayo ng kanyang mga gawa-gawang reklamo
gaya ng kasong ito, kung meron man?
A10. Opo itong Resolutions ng mga kasong finile niya na
nadismiss po ng Office of the City Prosecutor.

Copies of the Resolutions dated December 3 2013 and May 23, 2014
are herein attached as Exhibits “3” and “4” of this Judicial Affidavit.

Q11: May nais ka pa bang sabihin kaugnay ng kasong ito?

A11. Sa ngayong ay wala na po.
