completed- Vacate Notice issued - Regarding.

Government of AP in the reference 1 cited, have accorded sanction to the
proposal of the Municipal Council , Guntur for leasing out a site measuring 8345
SqYards reserved for school and play ground in the approved layout bearing LP
No 44/71 in favour Sri venkateswra Bala Kuteer (Registered), Ltd., Guntur for
construction of a school and for laying a play ground for a period of 25 years in the
first instance subject to the condition that the above site should be used only for
educational purpose and for its furtherance , and also subject to the payment of
nominalrent Rs 50/- per annum by the lessee to the Municipal council, Guntur

Government of AP in the reference 2nd cited, have accorded permission and
extension of lease period measuring 8345 Sq Yards reserved for school and play
ground in the approved layout bearing LP No 44/71 in favor Sri Venkateswra Bala
Kuteer (Registered) , Ltd.,Guntur for construction of a school and play ground for
further period of 25 years subject to the payment of Leae amount @Rs 6/- per Sq
Yard and an increase 33 1/3% for every three years
The said land was leased out by following the lease procedure as per the
Rules in force, applicable to the then Guntur Municipality and present Guntur
Municipal Corporation. According to Section 148(3) of Municipal Corporations Act
1955, in no case lease period of immovable property shallexceed 25 years and
hence, such leases have to be terminated and fresh lease has to be entered into
by conducting auction.
In the reference 5h cited, in pursuance of Hon'ble High Court orders in
W.P.No. 6354/2009, the Government issued orders to terminate all leases beyond
25 years and to take action for auctioning such premises by calling tender-cum
open auction. In terms of Rule 12 of A.P. Municipalities Receipts & Expenditure
Rules 1968, no lease can be extended exceeding 25 years.
Accordingly, it is observed that the Lease period of the Vacant site in L P
No 44/71,Syamala Nagar, Guntur leased out in favour of Sri Venkateswra Bala
Kuteer (Registered) as per the references 1 ,2 and 3 cited and the said lease is
going to expire by 12-10-2024. Since the total lease period exceeded 25 years,
the lessee of the said premises is therefore informed to vacate the premises by
12-10-2024, since the premises has to be re-auctioned.

If the lessee is having any objection with regard to the period of


Commencement of the lease as afore mentioned, he may get the necessary
clarifications by representing to the Deputy Commissioner-2, Guntur Municipal
Corporation at his office within 90 days from the date of receipt of this notice. If no
objection is received within the time stipulated, further process will be continued
for calling tenders as afore mentioned, presuming that he is not having any
objection.
