Petition under Section 151 CPC praying that 1n the circumstances stated in
the affidavit fited in support of the petition, the High court may be pleased to
dispense with the flling of the certified copy of the docket order dated 0310112022
passed in osSR.No.13653l2O21 on the file of Hon'ble Principal District Judge,
iL.R.District, at L.B.Nagar, pending disposal of the CRP.

ORDER:

This Civil Rcvision Petition is filed against the order

dt.O3.O1.2022 passed in OSSR.No.13653l202l, rvherein and rvhereby

the suit fileci by the petitior-rer lor partition of the suit schedule property

$,as returned on the ground that the Markct Value Certificate of the suit

schedule property is not produced as per Rule-3 of the rules framed

under Telangana State Court Fce and Suit Valr-lation Act.

2. Learned counsel for petitioners submits that after introduction of

'Dharani' Portal streamlining the land record under Integrated Land

Records Management System, the Market Value Certificates are
uploaded in the website and the petitioner has taken the certificate from

the said website and produced before the Court below, but the Court
below is insisting for physical copy of the Market Value Certificated

signed by the competent authority. He also submits that certificate

down loaded from the website clearly says that the information provided

online and no physical visit is required; and that after introduction of

Dharani Portal, the power of registering the documents by the Sub-

Registrars is conferred on Tahasildar and that all the litigant public are

facing lot of rlifficulty irr producing physical market value certificate

signed by the competent aLlthoritlr'. He further submits that the District

Judge who returned the present suit also addressed a letter

the notice of the Collector and District Magistrate, Rangareddy District

and the same is pending. He also submits that in another districts and

also the other Judges of the Ranga Reddy District are numbering the

suits, basing on the online Market Value Certilicate downloaded from

the website; and that the Court below which returned the suit of the
petitioner herein numbered OS.No.482 of 2O2l filed by one K.srinivas

Reddy basing on the market value certificate dou,nloaded lrom the

'Dharani' portal wcbsite.

3. Learned counscl for petitioner also filed additional affidavit

stating that he has approached the Balapur Tahasil Officer for the
purpose of Market Value Certificate before filing the suit, but the office

authorities informed him that the Markct Value certificate is available in

the Dharani Portal and advised him to download the same from the
website and also stated that the downloaded copy is valid and that

there will be an endorsement on the said dovvnloaded copy that no

personal visit is required to obtain the market value certificate.

4. in this case it is to be seen that the suit is returned on the ground

that the Market Value Certificate is not signcd by the competent
authority as per Rule-3 of the Rules framed under Telangana State
Court Fee and Suit Valuation Act. BLrt, after introduction of .Dharani,

portal, the concernecl Departments are not issuing Market Value

Certificates and instructing the parties to dorvnload thc same from the

Dharani portal. As such, the pctitioner produced the Market Value

Certificate by downloading the same from the Dharani portal website

and the said certificate also contain that the information is provided
online is updated and no physical visit is required. The District Judge,

himself has written a letter dt.27 .o1.2022 bringing the subject issue to

the notice of the District collector, Rangareddy District. It is also stated

that one suit in OS.No.482 of 2O2l is numbered basing on the

downloaded Market Value Certificate from the u'ebsite; and that some

Judges of entire Telangana State are nttmbering the suits only basing

on tlre dou,nloaded copy of the Markct Valr-re certificate from the

r.,",ebsite.

5. Since the issue is already pending before the Collector and

District Magistrate, Rangareddy District, it is for him to take

appropriate steps for mitigating the difficulty ol the litigant public and

issue prop-er instructions to the concerned authbrities' Pending such

exercise the present suit may be numbered subject to other

compliances. However, the petitioner/ plaintiff shall file an affidavit

stating that the Market Value certificate which was down loaded from

the website is true and correct. However, the said certilicate will be

subject to other side objection, when appearance is made by the

defendants. Till the Collector and District Magistrate, Rangareddy

District, issues necessary instructions to the concerned authorities,
basing on the letter addressed by the District & Sessions Judge'

Rangareddy District, dt.27 .O1.2022, the same procedure as mentioned

above may be followed in all other similar cases. Further, the Collector
and District Magistrate, Rangareddy District, is directed to take

necessary action on the letter addressed by the District and Sessions

Judge, Rangareddy District.

6. Accordingly, t1-re CRP is disposed of. No order as to costs
