BAC RESOLUTION NO. 02

Series of 2023

RESOLUTION RECOMMENDING TO THE HEAD OF THE PROCURING ENTITY,

HON. RENE S. FABRIA, THAT THE PUBLIC BIDDING SHALL BE ADOPTED FOR
THE PROCUREMENT OF SUPPLIES AND MATERIALS FOR THE WATER SYSTEM
PROJECT IN PUROK 9 AMOUNTING TO THREE HUNDRED FORTY-EIGHT
THOUSAND PESOS AND 0/100 (₱348,000.00) PURSUANT TO THE REVISED IRR OF
RA 9184 OTHERWISE KNOWN AS THE GOVERNMENT PROCUREMENT REFORM
ACT

(Explanatory Notes)

WHEREAS, paragraph (2) and (3), section 12 of the Republic Act 9184, otherwise known as
Government Procurement Reform Act, provides:

(2) “……the BAC shall also recommend to the Head of the Procuring Entity the use of Alternative
Methods of Procurement as provided for in Article XVI hereof….; and

(3) “……The BAC shall be responsible for ensuring that the Procuring Entity abides by the standards
set forth by this Act and the IRR,…….

WHEREAS, the Barangay Council of Paniangan has to implement the project Water System in
Paniangan, Manticao, Misamis Oriental for the general welfare of the constituents;

WHEREAS, The Barangay Government of Paniangan has appropriated in the amount of

₱350,000.00 for its 20% BDF for FY 2023 intended for the project Water System;

 WHEREAS, as per the approved Program Design, the amount of materials and supplies expenses
for the project costs ₱348,000.00 being the amount to be bid;

WHEREAS, in accordance with section 10 of IRR-A, as a general rule, the procuring entity shall
adopt public bidding as the general mode of procurement and shall see to it that the procurement program
allows sufficient lead time for such public bidding.

NOW THEREFORE, after several discussions and deliberations and upon motion of Hon.
Carmelito D. Buzarang which was duly seconded by Hon. Juliet G. Cañete, it was:

RESOLVED, to recommend to the office of the Head of the Procuring Entity and the Punong
Barangay of Paniangan, Manticao, Misamis Oriental the amount of ₱348,000.00 intended for the expenses
on Materials and Supplies for the Water System to hold for PUBLIC BIDDING;

RESOLVED FINALLY, to furnish copies of this resolution to the office of the Punong Barangay of
Paniangan, Manticao, Misamis Oriental, and other offices concerned for their immediate action and
approval.
