INVITATION TO APPLY FOR ELIGIBILITY AND TO BID


The BARANGAY COUNCIL OF PANIANGAN, Manticao, Misamis Oriental, through its Bids and
Awards Committee with its Barangay Funds per Code as indicated below as to its Budget, intends
to apply the sum as reflected opposite the respective project/item being the Approved Budget for
the Contract (ABC) to payment under the contract for the PROCUREMENT of the following, to wit:

Bids received in excess of the ABC shall be automatically rejected at the Bid opening.

The BARANGAY COUNCIL OF PANIANGAN, Manticao, Misamis Oriental now invites Bids from
eligible Bidders for the supply of the above item to be bid and delivery is required by the Procuring
Entity within fifteen (15) days from the issuance of Notice of Award and/or Purchase Order.

Bidding will be conducted through open competitive bidding procedures using non-discretionary
pass/fail criteria as specified in the Implementing Rules and Regulations Part A (IRR – A) of
Republic Act 9184 (R.A. 9184), otherwise known as the “Government Procurement Reform Act”,
and is restricted to Filipino Citizens/sole proprietorships, organizations with at least sixty percent
(60 %) interest or outstanding capital stock belonging to citizens of the Philippines, and to citizens
or organizations of a country the laws or regulations of which grant similar rights or privileges to
Filipino citizens, pursuant to Republic Act 5183 (R.A. 5183) and subject to Commonwealth Act 138
(C.A. 138). Only Bids from Bidders who pass the eligibility check will be opened. The Bidder with
the lowest Calculated Bid (LCB) shall advance to the post-qualification stage in order to finally
determine responsiveness of the bid to technical and financial requirements of the supply of the
above items. The contract/purchase order shall then be awarded to the Lowest Calculated and
Responsive Bidder (LCRB) who was determined as such during the post-qualification procedure.

Interested Bidders may obtain further information from the OFFICE OF BARANGAY PANIANGAN,
Manticao, Misamis Oriental during office hours from 8:00 A.M. to 12:00 NN and 1:00 P.M. – 4:00
P.M.

Following are the required eligibility documents, submission of which is non-electronic, to wit:

A. Class “A”
Legal Documents
1. Registration certificate from SEC, Department of Trade and Industry (DTI) for sole
proprietorship, or CDA for cooperatives.
2. Mayor’s/Business permit issued by the city or municipality
3. Tax clearance per E.O. 398, s. 2005, as finally reviewed and approved by the BIR.

Technical Documents
1. Statement of the prospective bidder of all its ongoing government and private contracts,
including contracts awarded but not yet started, if any, whether similar or not similar in
nature and complexity to the contract to be bid.
2. Statement of the bidder’s Single Largest Completed Contract (SLCC) similar to the
contract to be bid.

Financial Documents
1. Audited financial statements, showing, among others, the prospective bidder’s total and
current assets and liabilities, stamped “received” by the BIR or its duly accredited and
authorized institutions, for the preceding calendar year which should not be earlier than
two (2) years from the date of bid submission.
2. Computation of Net Financial Contracting Capacity (NFCC). A bidder may submit a
committed Line of Credit from a Universal or Commercial Bank, in lieu of its NFCC
computation.

B. Class “B” Document


1. Valid joint venture agreement (JVA), in case the joint venture is already in existence. In
the absence of a JVA, duly notarized statements from all the potential joint venture
partners should be included in the bid, stating that they will enter into and abide by the
provisions of the JVA in the event that the bid is successful. Failure to enter into a joint
venture in the event of a contract award shall be ground for the forfeiture of the bid
security.
2. Each partner of the joint venture shall submit their respective PhilGEPS Certificates of
Registration.

(Note: Any missing documents in the above-mentioned checklist is a ground for outright rejection of the Bid)

All Bids must be accompanied by a Bid Security in the amount indicated below, to wit:

a. Cash or cashier’s/manager’s check issued by a Universal
or Commercial Bank. For biddings conducted by LGUs,
the cashier’s/manager’s check may be issued by other
banks certified by the BSP as authorized to issue such
financial instrument.
b. Bank draft/guarantee or irrevocable letter of credit issued
by a Universal or Commercial Bank: Provided, however, Two percent (2%) or ₱6,960.00
That it shall be confirmed or authenticated by a Universal
or Commercial Bank, if issued by a foreign bank. For
biddings conducted by LGUs, bank draft/guarantee, or
irrevocable letter of credit may be issued by other banks
certified by the BSP as authorized to issue such financial
instrument.
c. Surety bond callable upon demand issued by a surety or
insurance company duly certified by the Insurance Five percent (5%) or ₱17,400.00

A complete set of the original Bidding Documents can be secured by interested Bidders at the
Barangay Hall Office upon payment set by the BAC. The bidding documents shall be received
personally by the prospective Bidder or his, authorized representative.

contract award, without thereby incurring any liability to the affected Bidder/s
