Below mentioned is the Unit Price Sheet and Payment Schedule for your
reference. Please note that the terms of this Allocation Letter are binding on
you from the date hereof. You are requested to confirm the receipt of the
Allocation Letter within 2 days of the receipt of the same but in any case, it
shall be deemed that you have accepted the allotment of the Allocated
Plot(s) on the terms and conditions as specified in this Allotment Letter.

Note:
1. All statutory charges and taxes will be borne by the Applicant(s) as per
the rates applicable from time to time.
2. Third party payments are not acceptable. Demand Drafts will have to
be supported by a letter from the bank confirming that the same has
been drawn from the Applicant's account.

3. **Stamp Duty & Registration Charges as mentioned above are


approximate & may vary as per government notification. Government
levies are additional. Any subsequent levies mandated by the
competent governing authority shall be informed & shall be payable by
the Applicant(s) as and when applicable.

4. #Promoter shall be maintaining the Project for 5 years. Promoter shall


collect CAM charges (Calculated at Rs. 7/- per month per Sq. Ft of the
Allocated Plot area + GST @18%) before registration of Deed of
Conveyance in favour of the Applicant(s). CAM charges are indicative
in nature and subject to changes as per market conditions and/or as
determined by the Promoter. GST or other relevant taxes will be over and
above.

5. #Corpus fund charges (One time charge) is payable at the time of


possession of the Allocated Plot(s) (Calculated at Rs. 7/- per month per
Sq. Ft of the Allocated Plot area + GST @18%) before registration of Deed
of Conveyance in favour of the Applicant(s) and is subject to change in
accordance with the prevailing policy.

6. Plot Value / Consideration Value and Infrastructure Charges mentioned


above is calculated basis of per square feet. Any addition or reduction
in the actual area of the Allocated Plot(s) shall be charged accordingly.

7. The above rates are calculated on a per sq. feet basis and conversion
to square meter shall be at basis 1 square meter = 10.7639 square feet.
Applicant(s) applying should state inventory type and the count of plots
applied for. Any Application Form not stating both inventory type and number
of plots is liable to be rejected as incomplete.
The Applicant(s) shall be liable to pay on demand, amounts towards all
government levies/taxes of any nature whatsoever in relation to the Allocated
Plot(s), including but not limited to, Stamp Duty and Registration charges. Any
other government levies/ taxes will be due and payable by the Applicant(s) as
applicable when charged.
All offers/ discounts/waivers are subject to the Applicant(s)’ completing the
transaction as envisaged herein by registering the Agreement for Sale and
Deed of Conveyance as per the terms of the Agreement for Sale. In the event
the Applicant(s) cancels/ terminates the transaction at any stage, for any
reason whatsoever, the Applicant(s) shall not be entitled to claim any benefit
of such offers/discounts/waivers, in any manner whatsoever.
In case of non-payment as per Payment Schedule, the booking will be
cancelled & deductions will apply as per the cancellation policy.

Guideline for payment towards Tax Deducted at Source (TDS):


As per government notification (Effective 01st April 2021), TDS @1% is payable
on agreement value (if the agreement value is more than Rs.50,00,000/-). You
will have to pay TDS directly on the government online portal https://www.tin-
nsdl.com and provide us the challan copy (i.e. Form 26QB and bank payment
receipt) along with the payment due as per the due date.
Below are the details of the Promoter that you will require for making the TDS
payment:

Annexure 3: TERMS & CONDITION WITH ANNEXURES

I/We have been informed that the project is being developed and marketed
by The House of Abhinandan Lodha® vide HOABL Realtech Private Limited
(“Promoter”) at Village - Tihura Majha, Pargana – Haveli Awadh, Tehsil - Sadar,
District - Ayodhya, Uttar Pradesh as one of the phases of the larger layout (The
Sarayu) to be determined and developed by the Promoter in a phase-wise
and/ or segment-wise manner from time to time, consisting of mixed-use
development comprising of residential / non-residential development /
clubhouse(s) / hotel etc., as a 7-star development, which phase is registered
with the Uttar Real Estate Regulatory Authority (UPRERA) under the name and
style of project “The Sarayu”, having registration certificate no.
UPRERAPRJ311468 (“Project”) and the Promoter has invited applications for the
same.

I am/we are interested in applying in the Project (as per the inventory
requirement submitted in this Application).
Promoter has informed me/us that:

a. Definitive Agreements/documents for the Allocated Plot(s) shall be


executed in my/our favour and I/we shall be placed in possession of the
same subject to full payment towards the total consideration value
alongwith all other charges as mentioned herein for the Allocated
Plot(s).
b. Features of the plotted development are set out in Annexure 5 which
shall be provided by the Promoter (“Common Areas and Amenities”)
and (“Clubhouse Amenities”) which are common for all phases and plot
owners of the larger property and/or larger layout of the proposed
development;
c. Promoter expects to complete the above features of development by
14 May 2027, subject to any force majeure circumstances or
circumstances beyond control of the Promoter.

It is understood that the Promoter shall not be carrying out any construction on
the said Allocated Plot(s). I/we am/are entitled to construct at my/our risk and
cost upon the handing over of the possession of the Allocated Plot(s) to me/us,
in accordance with the applicable construction approvals and regulations, as
well as the byelaws of the association/ society of all the plot purchasers in the
Project/ larger layout.

The application fee is defined in Annexure 3. Please consider this Application


Form along with the application fee as a formal complete Application from
my/our end.

I/We understand that Promoter reserves the right to accept or reject the
Application Form at Promoter’s sole discretion and without assigning any
reason for the same. Upon Promoter’s acceptance of my/our Application,
Promoter shall intimate to me/us the details of the plot allotted to me/us. The
application fees shall then be adjusted against the total consideration amount
payable in respect of the purchase of the said Allocated Plot(s).

I/We understand that post confirmation of plot allocation, the payments, and
registration timelines will be followed by me in adherence to the Payment
Schedule mentioned in Annexure 3.
I/We agree with the Payment Schedule highlighted in Annexure 3. Time as to
payment is of the essence and all overdue payments will bear interest at SBI
MCLR+1% per annum.
In the event, I/we fail to pay the amounts due per the applicable Payment
Schedule, Promoter shall have the right to cancel my/our Application and the
consequences of cancellation as set out in these terms and conditions shall
ensue.
I/We understand that the Definitive Agreements/documents will be registered
with the office of the relevant Sub-Registrar of Assurances. A title certificate
issued by reputed legal counsels certifying Promoter’s title to be clear and
marketable shall be conclusive and binding.
The eligibility for withdrawal and corresponding refund timelines are
mentioned in Annexure 6 and I/we have understood and agree to abide by
the same. This Application and the terms hereof shall supersede all the prior
discussions and correspondences (written or otherwise) between us, i.e. the
Applicant(s), and the Promoter.
This Application is personal to me/us and is not, directly or indirectly,
transferable by me/us to any other person/entity. I/we confirm that this Letter
does not create any right title or interest in my/our favour in respect of any
Allocated Plot(s) and or in the Project.
The other terms and conditions of this Application are set out in this Letter which
I/we have read and understood. The same is acceptable to me/us along with
the terms and conditions of the Application Form and I/we agree to be bound
by the same.

I/We declare and affirm that in case of joint allotment, failure to pay by anyone
of the joint applicants shall be deemed as failure to pay by both/all, and the
joint applicants shall be treated as a single person for the purpose of this
Application, and both (all) shall be liable for the consequences jointly as well
as severally.

Annexure 5: Withdrawal and Refund policy

A. Withdrawal Process before allotment of the plot:


Initiation
Withdrawal request needs to be raised by writing an email to
withdrawal@hoabl.in

Eligibility
• The email should be sent from the email id mentioned in the Application
Form and only the email id mentioned in the Application Form will be
treated as an official request.
• The withdrawal email can be sent any time post-application submission
until allocation confirmation of the plot.
• A cancelled cheque copy is mandatory to initiate the refund process.

Refund in case of withdrawal.


All refunds shall be made by NEFT/RTGS which will be deposited into the
Applicant's designated bank account within 45 (forty-five) working days from
the date of the receipt of the withdrawal email or cancelled cheque
(whichever is later). Statutory/government taxes, levies, and costs, discounts,
offers, if any shall not be refundable.

B. Withdrawal Process post allocation and before registration of Agreement for


Sale:
Initiation
Withdrawal request needs to be raised by writing an email to
withdrawal@hoabl.in

Eligibility
• The email should be sent from the email id mentioned in the Application
Form and only the email id mentioned in the Application Form will be
treated as an official request.
• The withdrawal email can be sent any time post-application submission
until allocation confirmation of the plot.
• A cancelled cheque copy is mandatory to initiate the refund process.

Refund in case of withdrawal.


a. Any withdrawal post plot allocation confirmation will be treated as a
cancellation and in the event of cancellation of Allocated Plot(s), the
Promoter shall be entitled to deduct 2% of the Agreement Value and
brokerage charges, if any, towards “Administrative charges”.
b. In the event of cancellation of the Allocated Plot(s), the Promoter shall
be entitled to deal with and/or dispose of the Allocated Plot(s) in the
manner it deems fit and proper, and the Applicant/s does/do not have
any right on the Allocated Plot(s) and shall not have any claim or raise
any objection in this regard.
c. All refunds, if applicable, shall be made by NEFT/RTGS which will be
deposited into the Applicant(s)’ designated bank account within 90
(ninety) working days from the date of the receipt of the withdrawal
email or cancelled cheque (whichever is later). Statutory/government
taxes, levies, and costs, discounts, offers, if any shall not be refundable.

Incomplete application
An incomplete application is liable to be rejected at our sole discretion.

A few illustrations of incomplete application which may lead to rejection are


as follows:
a. The UTR no./ Swift Code is not correctly mentioned.
The cheque/demand draft/Banker's cheque issued by the Applicant/s
towards the application fee is dishonoured or returned, unpaid for any
reason whatsoever, or the payment of application fee through
RTGS/NEFT is not realized by the Promoter.
b. Application Form contains incorrect inventory requirement and codes.

Loan from financial institutions


Loan from the financial institution may be availed by the Applicant(s) basis
eligibility and institution norms. However, if a particular institution/bank refuses
to extend financial assistance on any ground, the Applicant(s) shall not make
such refusal an excuse for non-payment of further instalments/dues and the
consequences of non-payment as set out herein shall be applicable to any
non-payment for reasons of Applicant(s) being not able to avail loan from an
institution/bank. In case of NRI Applicant(s), it is Applicant’s responsibility to
ensure FEMA and other necessary compliances and the Promoter shall not be
responsible for the same in any manner whatsoever.

All the terms and conditions mentioned herein shall be binding from the date
hereof.
