Note:
1. All statutory charges and taxes will be borne by the Applicant(s) as per
the rates applicable from time to time.
2. Third party payments are not acceptable. Demand Drafts will have to
be supported by a letter from the bank confirming that the same has
been drawn from the Applicant's account.
7. The above rates are calculated on a per sq. feet basis and conversion
to square meter shall be at basis 1 square meter = 10.7639 square feet.
Applicant(s) applying should state inventory type and the count of plots
applied for. Any Application Form not stating both inventory type and number
of plots is liable to be rejected as incomplete.
The Applicant(s) shall be liable to pay on demand, amounts towards all
government levies/taxes of any nature whatsoever in relation to the Allocated
Plot(s), including but not limited to, Stamp Duty and Registration charges. Any
other government levies/ taxes will be due and payable by the Applicant(s) as
applicable when charged.
All offers/ discounts/waivers are subject to the Applicant(s)’ completing the
transaction as envisaged herein by registering the Agreement for Sale and
Deed of Conveyance as per the terms of the Agreement for Sale. In the event
the Applicant(s) cancels/ terminates the transaction at any stage, for any
reason whatsoever, the Applicant(s) shall not be entitled to claim any benefit
of such offers/discounts/waivers, in any manner whatsoever.
In case of non-payment as per Payment Schedule, the booking will be
cancelled & deductions will apply as per the cancellation policy.
I/We have been informed that the project is being developed and marketed
by The House of Abhinandan Lodha® vide HOABL Realtech Private Limited
(“Promoter”) at Village - Tihura Majha, Pargana – Haveli Awadh, Tehsil - Sadar,
District - Ayodhya, Uttar Pradesh as one of the phases of the larger layout (The
Sarayu) to be determined and developed by the Promoter in a phase-wise
and/ or segment-wise manner from time to time, consisting of mixed-use
development comprising of residential / non-residential development /
clubhouse(s) / hotel etc., as a 7-star development, which phase is registered
with the Uttar Real Estate Regulatory Authority (UPRERA) under the name and
style of project “The Sarayu”, having registration certificate no.
UPRERAPRJ311468 (“Project”) and the Promoter has invited applications for the
same.
I am/we are interested in applying in the Project (as per the inventory
requirement submitted in this Application).
Promoter has informed me/us that:
It is understood that the Promoter shall not be carrying out any construction on
the said Allocated Plot(s). I/we am/are entitled to construct at my/our risk and
cost upon the handing over of the possession of the Allocated Plot(s) to me/us,
in accordance with the applicable construction approvals and regulations, as
well as the byelaws of the association/ society of all the plot purchasers in the
Project/ larger layout.
I/We understand that Promoter reserves the right to accept or reject the
Application Form at Promoter’s sole discretion and without assigning any
reason for the same. Upon Promoter’s acceptance of my/our Application,
Promoter shall intimate to me/us the details of the plot allotted to me/us. The
application fees shall then be adjusted against the total consideration amount
payable in respect of the purchase of the said Allocated Plot(s).
I/We understand that post confirmation of plot allocation, the payments, and
registration timelines will be followed by me in adherence to the Payment
Schedule mentioned in Annexure 3.
I/We agree with the Payment Schedule highlighted in Annexure 3. Time as to
payment is of the essence and all overdue payments will bear interest at SBI
MCLR+1% per annum.
In the event, I/we fail to pay the amounts due per the applicable Payment
Schedule, Promoter shall have the right to cancel my/our Application and the
consequences of cancellation as set out in these terms and conditions shall
ensue.
I/We understand that the Definitive Agreements/documents will be registered
with the office of the relevant Sub-Registrar of Assurances. A title certificate
issued by reputed legal counsels certifying Promoter’s title to be clear and
marketable shall be conclusive and binding.
The eligibility for withdrawal and corresponding refund timelines are
mentioned in Annexure 6 and I/we have understood and agree to abide by
the same. This Application and the terms hereof shall supersede all the prior
discussions and correspondences (written or otherwise) between us, i.e. the
Applicant(s), and the Promoter.
This Application is personal to me/us and is not, directly or indirectly,
transferable by me/us to any other person/entity. I/we confirm that this Letter
does not create any right title or interest in my/our favour in respect of any
Allocated Plot(s) and or in the Project.
The other terms and conditions of this Application are set out in this Letter which
I/we have read and understood. The same is acceptable to me/us along with
the terms and conditions of the Application Form and I/we agree to be bound
by the same.
I/We declare and affirm that in case of joint allotment, failure to pay by anyone
of the joint applicants shall be deemed as failure to pay by both/all, and the
joint applicants shall be treated as a single person for the purpose of this
Application, and both (all) shall be liable for the consequences jointly as well
as severally.

Eligibility

Form and only the email id mentioned in the Application Form will be
treated as an official request.
• The withdrawal email can be sent any time post-application submission
until allocation confirmation of the plot.
• A cancelled cheque copy is mandatory to initiate the refund process.

Incomplete application
An incomplete application is liable to be rejected at our sole discretion.
All the terms and conditions mentioned herein shall be binding from the date
hereof.
