2023 In-N-Out Family Picnic Events Waiver

Release & Code of Conduct Form

IN-N-OUT BURGER INFORMED CONSENT AND RELEASE OF LIABILITY

ASSUMPTION OF RISK AND WAIVER OF LIABILITY RELATING TO CORONAVIRUS/COVID-19

IN-N-OUT BURGER CODE OF CONDUCT GUIDELINES

All terms and provisions of this waiver and release expressly apply to any minor
children that attends the Event.
I desire to voluntarily participate in the 2023 In-N-Out Family Picnic Event(s) (the Event) and voluntarily
ride the bus to/from the Event sponsored by In-N-Out Burgers. Detailed information concerning the Event
can be found on the INOnet. I acknowledge that my participation in this Event has inherent risks, including
risks that could cause property damage, personal injury, illness, disability, or death. I am medically,
physically and in all other respects, fit and fully able to participate in this Event. I have no special medical
requirements or conditions except those that my doctor has advised me will not in any way interfere or
hinder my participation in the Event. I understand that medical personnel may not be present at the Event.

I assume voluntarily all of the known and unknown risks in my participation in this Event. In consideration
of being allowed to participate in the Event, I hereby release, indemnify and hold harmless In-N-Out
Burgers and its officers, directors, associates, agents, successors, and assigns (Staff) from any and all claims,
demands, actions or causes of action whatsoever, and from any and all liability, loss, damages, costs and
expenses (Losses) arising from or related to my acts or omissions or participation in the Event, including but
not limited to any property damage, personal injury, illness, or disability of any kind or nature, or
description including death, and attorneys fees and expenses of litigation and settlement. This release shall
be binding upon my heirs, administrators, executors and assigns.

I understand that by signing this document I am fully releasing In-N-Out Burgers and its Staff from any
known and unknown claims and I expressly waive and release any right or benefit which I may have under
California Civil Code Section 1542. I understand and acknowledge the significance and the consequences of
such release, as well as the specific wavier of Section 1542. Section 1542 provides that:

A general release does not extend to claims which the creditor does not know or suspect to exist in his or
her favor at the time of execution of the release, which if known by him or her must have materially
affected his or her settlement with the debtor.

I further understand that participation in this event with In-N-Out Burgers is strictly voluntary and that
neither In-N-Out’s general liability insurance nor workers' compensation insurance will cover injuries or
other damages arising out of my voluntary participation in this Event. Therefore, I am solely responsible for
the cost of treatment for any injuries or other damages sustained while participating in this Event.
I further agree that all terms and provisions of this waiver and release expressly apply to any minor
children that accompany me to the Event.

I further agree to being photographed, recorded, videotaped or captured in any visual or audio medium
(the “Recordings”) by In-N-Out Burgers while at the Event. I also grant In-N-Burgers any and all rights,
including ownership to the Recordings.

I represent that I have read and understand the Informed Consent and Release of Liability and acknowledge
that this release is being relied upon by In-N-Out Burgers in permitting me to participate in this Event.

Assumption of Risk and Waiver of Liability Relating To Coronavirus/COVID-19

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health
Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person
contact. As a result, federal, state, and local governments and federal and state health agencies
recommend social distancing and increased personal protection efforts, including frequent hand washing
and wearing face coverings at all times outside the home.

In-N-Out Burgers (“In-N-Out”), in the course of planning, hosting, or conducting events, has instituted
precautionary measures aimed at preventing and reducing the spread of COVID-19 among event attendees.
However, In-N-Out cannot guarantee that you, or those with whom you come in close contact, will not
become infected with COVID-19. Attending In-N-Out’s events (including your travel to and from such
event) could increase your risk of contracting COVID-19.

By registering for, signing below, and attending the In-N-Out event, you acknowledge the contagious nature
of COVID-19 and voluntarily assume all risk that you may be exposed to or infected by COVID-19 in
attending the event, and that such exposure or infection may result in personal injury, illness, permanent
disability, and death to you or those with whom you come into close contact.

You further acknowledge and agree to accept sole responsibility for any injury, including, but not limited to,
personal injury, disability, illness, death, damage, loss, claim, liability, or expense, of any kind, to you or
those with whom you come into close contact, including your household members)(“Claims”). You hereby
release, covenant not to sue, discharge, and hold harmless In-N-Out, its owners, employees, board of
directors, and representatives (“Released Parties”), of and from any Claims, including all liabilities, claims,
actions, damages, costs, or expenses of any kind arising out of or relating thereto.

You further understand and agree that this release includes any Claims based on actions, omissions, or
negligence of the Released Parties, whether a COVID-19 infection occurs before, during, or after
participation in any In-N-Out event.

You agree to abide by posted rules, warning or instructions by In-N-Out, the event venue, and any
government authority with respect to social distances, adherence to any dress code (including mandatory
face coverings), and sanitation guidelines.

You further agree not to attend the event if you are diagnosed with or suspect that you may have been
infected by COVID-19. If you become ill or suspect you have been infected with COVID-19, you agree to
immediately discontinue your participation in the event and alert In-N-Out via e-mail or telephone.
You agree not to attend the In-N-Out event if you cannot agree to or accept the foregoing. Failure to agree
to or abide by any of the foregoing may result in denial of entry or immediate expulsion from the event, at
In-N-Out’s sole discretion, in addition any and all remedies which may be available to In-N-Out, in equity or
at law.

In-N-Out Burger Code of Conduct Guidelines

All In-N-Out Burger Associates and parties participating in company-sponsored events or activities are
expected to act in a safe, professional and responsible manner. You are expected to serve as a positive role
model by showing respect and courtesy.

Although it is impossible to provide an exhaustive list of all types of impermissible conduct, the following
are some examples of impermissible conduct during company-sponsored events or activities:

 Profanity or other offensive language, whether spoken or appearing on apparel.


 Smoking, other than in designated areas.
 Throwing of items or liquids not typically associated with the event activity
 Bringing prohibited items into the venue (as directed by the venue).
 The possession, consumption, purchase of alcohol, or being under the influence of alcohol.
 The use, purchase, sale, transfer, possession, distribution, or being under the influence of an illegal
drug.
 Fighting or other threatening, intimidating or harassing behavior, including sexual harassment.
 Any kind of misconduct with any staff or the use of profane language towards any person.
 Any behaviors or practices that would endanger the health and wellbeing of any person present.
 Engaging in behavior that would be prohibited in the stores.
 Other conduct that violates In-N-Out Burgers Standards of Conduct policy, as stated in our
Associate Handbook, or any other company policy or practice.

You should recognize, however, that conduct not specifically listed, but that is otherwise detrimental to In-
N-Out Burger, other Associates, staff and attendees, may lead to suspension from future events, as well as
disciplinary action up to and including termination. In-N-Out Burger reserves the right to impose discipline
or to refuse or discontinue your participation in such events at its sole discretion.

You hereby acknowledge, by signing below, that participating in company-sponsored events or activities is
entirely voluntary, not a condition of employment, completely outside the course and scope of
employment, and will take place outside of scheduled work time and away from the premises of In-N-Out
Burger.
