COUNTER AFFIDAVIT OF B.KIRAN KUMAR

I, B.Kiran Kumar son of Mr.B.Venugopal, Hindu, aged about 39

years, residing at Door No.3, Sidco Main Road, Kannadasan Nagar,
Chennai 600 118, do hereby solemnly affirm and sincerely state as
follows:

1. I state that I am the 5th Respondent in the above application

and 5th Plaintiff in the main suit, I am also swearing this affidavit on
behalf of Respondents/Plaintiffs 2 to 4 and 5 to 9, as such I am well
acquainted with the facts of the case and contents of this affidavit.

2. I deny all the averments in the affidavit filed in support of

petition filed by the petitioner/11 th Defendant except those which are
specifically admitted and adverted hereto and puts the petitioner to
strict proof of the same.

3. I state that the petitioner is all along watching the

proceedings behind the screen but after Amended Plaint copy was
filed and despite of several opportunities given to the petitioner he
never chosen to file written statement as such he wantonly and
deliberately did not filed written statement in time. Further the reason
stated in the affidavit is not convincing to allow the petitioner, hence
the petition filed by the petitioner deserves to be dismissed.

I, therefore pray that this Hon’ble court may be pleased to

dismiss the above I.A.No. of 2024 in O.S No.4092 of 2024 with
exemplary costs and thus render justice.
