and CONSTANCIA ROBLES-GUEVARRA

KNOW ALL MEN BY THESE PRESENTS:

WHEREAS, SPOUSES EPITACIO GUEVARRA and CONSTANCIA ROBLES-


GUEVARRA, who died on May 27, 1980 and May 6, 1999 at Brgy. San Bartolome, City of Sto.
Tomas, Batangas, respectively, leaving no will nor debts settled to date but leaving a parcel of
land situated at Brgy. San Bartolome, City of Sto. Tomas, Batangas.

WHEREAS, at the time of their death, they left as legal heirs, the following and to wit:

NIEVES R. GUEVARRA and PURITA R. GUEVARRA, both single, of legal age,


Filipino citizen and presently residing at Brgy. San Bartolome, City of Sto. Tomas, Batangas;

WHEREAS, they are both their legal heirs by reason of the fact that they are both their
legitimate children and who are supposed to inherit by way of intestate succession;

WHEREAS, at the time of their death, they left a parcel of land together with
improvements thereon and more particularly described and bounded as follows:

ORIGINAL CERTIFICATE OF TITLE NO. O-242

“A parcel of land (Lot 2, plan Psu-195102, L.R. Case No. N-1474; L.R.C.
Record No. N-37109), situated in the Barrio of San Bartolome, Municipality of
Sto. Tomas, Province of Batangas. Bounded on the NE., from point 1 to 5, by
property of the Heirs of Flora Evangelista; and from point 5-6, by property of
Primitivo Evangelista; on the SE., from point 6-7, by the property of the Heirs of
Eugenio Robles; from point 7-8, by property of Celerina Malabrigo; and from
point 8-9, by property of the Heirs of Mariano Robles; on the SW., from points 9-
10, by property of the Heirs of Eugenio Robles; and from point 10-11 by property
of Juan Garcia; on the NW., from point 11-1, by property of Miguela Maloles.
Beginning at a point marked “1” on plan x x x containing an area of TWENTY
ONE THOUSAND SEVENTY FOUR (21,074) SQUARE METERS, more or less.

WHEREAS, in view of the above facts and circumstances , we are therefore co-owners
and to terminate co-ownership over the same, we hereby adjudicate over the same in pro-
indiviso sharing pursuant to Section 1, Rule 74 of the Revised Rules of Court of the
Philippines subject to the liabilities imposed by Section 4, of the same Rule;

That the above-described property has not yet been registered under Act 496 nor under
the Spanish Mortgage Law and that therein parties do hereby agree to register this instrument
under the provision of Act 3344, as amended.

DEED OF SALE OVER A PORTION OF A PARCEL OF LAND
KNOW ALL MEN BY THESE PRESENTS:

This DEED OF SALE, made and executed this _________ day of ___________________________ at
__________________________________, by NIEVES R. GUEVARRA and PURITA R. GUEVARRA, both single,
of legal age, Filipino citizen and presently residing at Brgy. San Bartolome, City of Sto. Tomas,
Batangas, hereinafter referred to as the VENDORS, for and in favor of FRANZ DAVE AZUCENA,
single, of legal age, Filipino citizen, and a resident of Brgy. 5, Tanauan City, Batangas, hereinafter
called the VENDEE;

WITNESSETH:

That the VENDORS are the true and registered owner of a portion of parcel of land situated
at Brgy. San Bartolome, City of Sto. Tomas, Batangas which is more particularly described as
follows, to wit:

ORIGINAL CERTIFICATE OF TITLE NO. O-242

“A parcel of land (Lot 2, plan Psu-195102, L.R. Case No. N-1474; L.R.C. Record
No. N-37109), situated in the Barrio of San Bartolome, Municipality of Sto. Tomas,
Province of Batangas. Bounded on the NE., from point 1 to 5, by property of the

That FOR AND IN CONSIDERATION of the sum of PESOS: ONE MILLION PESOS
(Php 1,000,000.00), Philippine Currency, in hand paid by the VENDEE unto the VENDORS who
are the lawful and absolute owners of the aforesaid parcel of land with no improvements found
thereon, having executed the Deed of , the latter hereby by these present SELL, TRANSFER AND
CONVEY unto the VENDEE, his heirs, assigns and successors-in-interest, a PORTION of the land
above-described consisting an area NINE HUNDRED THIRTY THREE (933) SQUARE METERS
more or less.

That the other remaining portions shall remain with the declared owner hereof;

That the VENDORS hereby warrant unto the VENDEE full title and ownership over a
portion of the land above-described, free from all liens and encumbrances whatsoever;

That the said property does not fall under the provisions of R.A. 6657 or the
Comprehensive Agrarian Reform Law and that the vendors have notified the owners of the
adjoining lots in compliance with the provisions of Art. 1621 to 1622 of the Revised Civil Code of
the Philippines.
