BY THE MARRIAGE LAWS (AMENDMENT) ACT, 1976
FOR DISSOLUTION OF MARRIAGE BY A DECREE OF
DIVORCE BY MUTUAL CONSENT.

MOST RESPECTFULLY SHOWETH:


1. That the petitioner no. 1 namely Amul Kanodia S/o Mr.

Ashok Kumar Kanodia R/o H No.-3/35, DDA Flats,


Vikaspuri, New Delhi. The copy of the Aadhar card of the
Petitioner no 1 is annexed here Annexure A.
2. That the petitioner no. 2 namely Ruby W/o Sh. Amul

Kanodia, D/o Sh. Nem Singh R/o H No.-7/B Begum Pur,


Rohini, New Delhi. The Copy of the Aadhar Card is
Annexed here as Annexure B.
3. That the marriage between the parties to this petition was

solemnized as per the Hindu Rites and Ceremonies in the


presence of the respective families That both the parties were
Engaged to each other on 08/01/2023 at begum pur, Rohini
after that on 23.02.2023 at Royal Pepper, Peeragarhi, New
Delhi, The said Marriage was duly consummated, After the

solemnization of the marriage, both the parties lived together


as husband and wife at House No. 3/35, DDA Flats
Vikaspuri, New Delhi. The said marriage was duly
consummated; however, no issue was born out of the said
wedlock. The Photographs of the Marriage are annexed
herewith as Annexures C (respectively).
4. That the status, age and place of residence of the parties to

the petition before the marriage and at the time of filing the
present petition were / are as under:

5. That thereafter due to the temperamental differences in their

nature and beliefs, making it unable for them to adjust with


each other in the matrimonial house parted their ways and
started living separately from each other from 13.03.2023 and
since then there is no cohabitation between the parties. All the
efforts of reconciliations by the parents, relatives and common
friends of both the parties failed and parties have thus decided
to dissolve their marriage in an amicable and peaceful manner
as there is no probability and possibility of the parties living
together as husband and wife.

6. That now the parties to the petition had through the MOU dated

09.03.2024 executed between them had agreed to settle all


their dispute out of court as per the terms and conditions
agreed and mentioned in the MOU. The copy of the MOU
dated 09/03/2024 is annexed herewith as Annexure G.
7. That both the parties have settled all their disputes and

differences and had agreed to proceed for taking divorce by


mutual consent on the following terms and conditions: -
a. It has been agreed between both the parties that the parties
will file for divorce by mutual consent on the terms and
conditions as mutually agreed upon as per this MOU.
b. The First Party has agreed to pay to Second Party a total
sum of Rs. 13,00,000/- (Thirteen Lakhs Only) through
Bank Demand Draft or through RTGS to the Second Party

as permanent alimony and for her past, present and future


maintenance in two equal instalments of 6,50,000/- (Six
Lakhs Fifty Thousand) each, first instalment will be paid at
the time of recording of statements of the parties in First
Motion Petition and Second instalment will be paid at the
time of recording of statements of the parties in Second
Motion Petition before the Concerned Court.
c. The Second Party has further agreed to return to First Party
the Gold Jewellery i.e. One Gold Mangal Sutra at the time
of recording of statement in First Motion Petition.
d. The First Party has agreed to return the Gold Jewellery i.e.
One Gold Chain, One pair of gold Ear rings, One Gold
Ring to the Second Party at the time of recording of
statement in First Motion Petition.
e. It has been agreed by both the parties that they will
withdraw all their respective complaints/ cases from every
Court of Law/ Forum, filed by them against each other if
any within 15 days of the recording of statements in First
Motion Petition before the concerned court.
8. That it has been agreed between the parties that the second

party/wife has settled all her past; present and future


maintenance including permanent alimony with the first
party/husband and has agreed not to claim anything from the
first party/husband after getting decree of divorce.

9. That both the parties have agreed that they shall not file any civil

suit/criminal case, claim or any petition etc, in any Court of


Law against each other or against their respective parents and
parental family members after getting the decree of divorce

and shall withdraw the same if already pending before any


court of law or any other forum.

10. That both the parties further agreed that they shall not claim any

right in each other’s properties and shall not interfere in each


other’s life and are free to take their own decisions and to
settle in their lives as per their will and choice.

11. That both the Parties are bound to comply with the terms and

conditions of the Memorandum of Understanding dated


09/03/2024.

12. That the consent of the parties has not been obtained by any

force, coercion, undue pressure or fraud and the parties have


given their consent for this MOU out of their own free will in
an out of the court settlement.

13. That there is no collusion between the petitioners in filing and

institution of the present petition.

14. That there is no legal ground as to why the relief to the

petitioners should not be granted, as prayed for.

15. That there has not been any unnecessary or improper delay in the

instituting the present petition.

16. That Petitioner No. 1 is presently residing at House No.-3/35,

DDA Flats, Vikaspuri, New Delhi. which falls under the


territorial jurisdiction of this Hon’ble Court, therefore, this

Hon’ble Court has the territorial jurisdiction to try and


entertain this petition.

PRAYER
In view of the facts and circumstances and submissions made
above, it is respectfully prayed that this Hon'ble Court may
kindly be pleased to:
(i). Dissolve the marriage between the petitioners by a decree
of divorce by mutual consent under the provisions of
Section 13 (B) (1) of the Hindu Marriage Act, as amended
upto date, in the interest of justice.
(ii). Any other or such further order(s) as this Hon’ble Court
may deem fit and proper, may also be passed.

1. That the Deponent is the Petitioner No.1 (Husband) in the
accompanying petition and as such is well conversant with
the facts and circumstances of the present case and as such
is fully competent to make and swear this affidavit.
2. That the petition under section 13-B (1) of the Hindu
Marriage Act, 1955 has been drafted under the instructions
of the Deponent. The contents of the said petition are not
reproduced herein for the sake of brevity and same may
kindly be read as part and parcel of this affidavit. The facts
stated therein are true and correct which I have read and
understood in vernacular.
3. That the marriage of the deponent was solemnized with
petitioner No. 2 at Royal Pepper, Peeragarhi New Delhi on
23/02/2023 which was duly consummated according to
Hindu rights, customs and ceremonies and no issue was
born out of the said Wedlock.

4. That the Deponent is living separately from Petitioner No.


2 since 13.03.2023 and since then they are not able to live
together. The deponent has not cohabitated with petitioner
No. 2 since the date of living separately.
5. That the Deponent has resolved all her issues in relation to
the marriage with Petitioner No. 2 according to the
Memorandum of Understanding dated 09.03.2024, which
is annexed here with.
6. That the mutual consent for divorce has not been obtained
by force, fraud or undue influence by the either party.
7. That the joint petition has not been presented in collusion
with the Petitioner No. 2.
8. That there has not been any unnecessary or improper delay
in instituting the present petition.
9. That there is no other legal impediment in granting the
relief of divorce as sought by Deponent and Petitioner No.

3. That the marriage between the Deponent and petitioner


No.2 was solemnized at Royal Pepper, Peeragarhi New

According to Hindu Rites and customs, but due to
temperamental differences and different views both the
parties are residing separately since 13.03.2023 and they
have not cohabitated together since their separation.
4. That in the present circumstances, there is no possibility of
reunion and reconciliation between the Deponent and
petitioner No.2 for living together. The marriage between
the Deponent and petitioner No.2 broken down
irretrievably.
5. That both parties of this petition have decided to obtain
divorce by way of mutual consent and have agreed to file a
petition for grant of decree of divorce by mutual consent
under Section 13 (B) (1) and 13 (B) (2) of Hindu Marriage
Act, 1955 before the competent court of law.
6. That parties of this petition have settled all their disputes
as per the Memorandum of Understanding dated
09.03.2024 As per the terms mentioned in the MOU, the
Petitioner No. 1 i.e., Husband, The First Party has agreed
