APPLICATION FOR REFUND OF COURT FEES

1) The Applicant submits that the Applicant has filed the above mentioned
Securitization Application No. 127 of 2024 against the defendant for seeking
interim stay against the mortgaged property having its address at - Flat No. 504,
Bldng No. D 1, (5), 5th Floor, Evershine Woods Bldng, in the Society known
as Evershine Woods Maple, situated at Mira Road (East), Thane - 401 107.

2) The Applicant submits the Applications lodged the Securitization Application

through offline filling mode and the same was numbered as S.A. No. 127 of
2024.

3) The Applicant further submits that the Applicant has paid Rs. 14,505/- (Rupees
Fourteen Thousand Five Hundred and Five Only) on 03/02/2024 as the
requisite court fee vide DRT Receipt Transaction Ref No. 0302240024635 for
filing the Securitization Application through the account of Applicant’s
Advocate’s Bank. Statement of Account along with DRT Receipt Annexure
“A” annexed herewith.

4) The Applicant further submits that the Applicants lodged the Securitization
Application through the official website of DRT on 03/02/2024 and since the
case is disposed off uncontested, the Applicant is left with option to apply for
refund of Court Fees, it is informed by the department that the entire court fee
 will be refunded, and the Departmental Authorities further asked Applicant’s
Advocate to file an Application for refund of Court Fees.

5) The Applicant further submits that the Applicant has paid the court fees and the
same shall be refunded back to Applicant’s Advocate’s Bank Account as the
advocate of the Applicant has acted upon the instructions given by the
Department and the same shall be taken into consideration and entire court fees
shall be refunded to the Applicant’s Advocate’s Bank Account.

6) Affidavit in support, Mandate Form and Application Fees DRT Receipt filed
herewith.

7) In the above circumstance, the Applicant humbly prays as follows:

(a) Refund of the entire court fees paid by the Application Bank.
(b) Any other relief deems fit.

COURT FEES

Mr. Mohd Raees, Age:- 40 Years, Occu:- Service in Mira Road, Tal. & Dist. Thane, do
hereby state on solemn affirmation as under:-

1. I say that I have filed the above mentioned Securitization Application No. 127
of 2024 against the defendant for seeking interim stay against the mortgaged
property having its address at - Flat No. 504, Bldng No. D 1, (5), 5th Floor,
Evershine Woods Bldng, in the Society known as Evershine Woods Maple,
situated at Mira Road (East), Thane - 401 107., for refund of entire court fees
paid though the Applicant’s Advocate.

2. I say that the Applicant has paid the court fees and the same shall be refunded
back to Applicant’s Advocate’s Bank Account as the Applicant has acted upon
the instructions given by the Department and the same shall be taken into
consideration and entire court fees shall be refunded to the Applicant’s
Advocate’s Bank Account.

3. I repeat, reiterate and adopt the contents of the Application and what is stated
therein as part and parcel of this Application in support thereof.
 In the above circumstances, I am filing an affidavit for the same. I say that
whatever stated herein above is true and correct to the best of my knowledge.
