It is to submit that, the Tahsildar, Nellore Urban, SPSR Nellore District

has submitted a report vide reference cited stating that the land in
Sy.No.536 to extent of Ac.1.21 Cents & Sy.No.537 to an extent of
Acres.5.70 cents, Situated at Nellore Bit-II Village, SPSR Nellore District is

The Sy.No.537/1,2,3 measuring an extent of Ac.5.70 Cents of Bit-

II, T.D. No.87 Nellore is not attached property of any Waqf institution. As
per RSR, the Sy.No.537 of Bit-II, Nellore is sub-divided as (3) sub-divisions.
 Sy.No.537/1 an extent of Ac.5.14 Cents.
 Sy.No.537/2 an extent of Ac.0.38 Cents and
 Sy.No.537/3 an extent of Ac.0.18 Cents.
As per RSR (CAS) No.537 to an extent of Acres.5.61 cents is Mulla
Mohammed Khasim Saheb and Five (5) others. Certified copies of RSR, CAS
& FMB in Sy.No.537 , T.D. No 1497 of Bit-I of Nellore Rural are given by the
Revenue authorities are here with enclosed for your kind perusal.
He also stated that, said land was incorporated in 22-A prohibition list
as Waqf and requested to delete the said Sy.No.537 to an extent of
Acres.5.70 cents, T.D.No.87 situated at Nellore Bit-II Village, SPSR Nellore
District.
As per RSR (CAS) No.536 to an extent of Acres.0.88 cents is
Mulla Mohammed Khasim Saheb and Five (5) others. Certified copies of RSR,
CAS & FMB in Sy.No.536 , T.D. No 1497 of Bit-I of Nellore Rural are given by
the Revenue authorities are here with enclosed for your kind perusal.
He also stated that, said land was incorporated in 22-A prohibition list
as Waqf and requested to delete the said Sy.No.536 to an extent of
Acres.1.21 cents, T.D.No.87 situated at Nellore Urban, Bit-II ,SPSR Nellore
District.
In this context, it is submitted that land in Sy.No 536 to an extent of
Ac.0.88 cents & Sy.No.537 to an extent of Acres.5.61 cents T.D. No.1497
situated at Nellore Town, SPSR Nellore District is a notified Waqf published in
A.P. Gazette No.18- A, Supplement to Part-II, dated; 02-05-1963 at Serial
No.196 under TD.No.1497, Survey Commissioner Report Serial No. 39 of
Nellore and the same was also incorporated in the list of U/Sec.22-A (1) (C)
of Registration Act, 1908 of SPSR Nellore District.
In view of the above, if agreed, the same may be communicated to the
Chief Executive Officer, A.P. State Waqf Board, Vijayawada with all the
above facts with a request to take further necessary action in the above
matter.

Kind attention is invited to the reference cited.

In reference 1st citied Prohibited Properties list related to Waqf Board

was submitted pertaining to the Nellore Revenue Village of Nellore Mandal
U/s 22A(1)(C) .

Among the above certain Survey Numbers pertaining to Waqf

properties located in Nellore Corporation area are overlapping with the
Survey Numbers of original RSR of the village located in the limits of same in
Nellore Municipal Corporation, which are not actually prohibited.

In reference 2nd citied it has been reported that the land in Sy.No.537
to an extent of Acres.5.70 cents Classified as Patta Wet is different from
Waqf Land in Sy.No.537 with an extent of Acres.5.61 cents and both are
located in different locations i.e, Balajinagar of Nellore Bit-II and Magunta
Layout of Nellore Bit-I respectively.

The Sy.No.537/1,2,3 measuring an extent of Ac.5.70 Cents of Bit-

II, T.D. No.87 Nellore is not attached property of any Waqf institution. As
per RSR, the Sy.No.537 of Bit-II, Nellore is sub-divided into (3) sub-divisions
as noted below.
 Sy.No.537/1 an extent of Ac.5.14 Cents.
 Sy.No.537/2 an extent of Ac.0.38 Cents
 Sy.No.537/3 an extent of Ac.0.18 Cents
Total an extent of Ac.5.70 Cents

Besides the new Sy.No.537 to an extent of Acres.5.61cents is derived

from the resurvey of the land comprised in original Sy. No.1576 and its sub
divisions form 1 to 1072 (1576/1 to 1072) within an extent of Ac.2669.64 of
original RSR of Nellore Revenue Village. But after the resurvey of the above
said land new survey numbers are assigned starting with Sy.No 1,2, etc.,
only which lead to the duplication of survey numbers in the same village.

In this regard it’s further submitted that the new survey numbers
(resurvey numbers of the land covered by 1576/1 to 1072) are commonly
being called as CAS No. for easy differentiation . Whereas the prohibited
properties relating to waqf board are furnished with just survey numbers
only, hence all the survey numbers relating to waqf properties located in
resurvey area may be suffixed with CAS within the bracket for example
Sy.No.537 (CAS) Ac.5.61 cents.

During the discussion held with District Registrar, Department of

Stamps Registration Nellore, Tahsildars Nellore Rural & Urban have also
recommended for the same to resolve this unique problem pertaining to
Nellore Village & Town pending before the District Administration.

Further submitted that the Revenue Village Nellore was divided in to

Nellore Bit-I & Bit-II for the administrative convenience since beginning and
all the village accounts are being maintained accordingly.

And in the year 2018 the Nellore Mandal is bifurcated into two (2)
Mandal as Nellore Urban & Rural, so also the Revenue Village Nellore (Bit-I &
Bit-II) is also split into further parts as follows.

thoroughly, a comparative statement of waqf properties of CAS numbers and
other land details of corresponding survey numbers as per original RSR are

The Subject land Ac.5.61 cents in Sy.No.537 was incorporated in

Prohibited list of Nellore Revenue Village U/s 22(A)(1)(C) as Waqf Land
without specifically mentioning Nellore Bit-I village and CAS suffix.
 The Gazette notification along with Survey Commissioners
report of Sy.No.537 of Nellore City.

Sy.No.537 is herewith enclosed for kind perusal.

 Whether the Survey Number 537 of Bit-I or Bit-II attached to

any Waqf institution as per record.

As per the record available in this office, the Sy.No.537 measuring

an extent of Ac.5.61 Cents ,T.D.No.1497 of Bit-I, Nellore attached to
Waqf institution namely Kalan Mosque situated at Fathekhanpeta area,
Nellore town.
The Sy.No.537 measuring an extent of Ac.5.70 Cents T.D.No.87 of
Bit-II, Nellore is not attached property of any Waqf institution.
As per RSR, the Sy.No.537 of Bit-II, Nellore is sub-divided as (3)
sub-divisions.
 Sy.No.537/1 an extent of Ac.5.14 Cents.

The land in Sy.No.537 with Sub-divisions 1,2,3 with an extent of
Ac.5.70 Cents T.D.No.87 of Bit-II Nellore is a Private Land as per the RSR.

I further submit that as per above record the A.P.State Waqf Board is
