AFFIDAVIT TO SHOW CAUSE WHY THE ORDER NISI MADE ON

THE 5TH FEBRUARY, 2024 WILL NOT BE MADE ABSOLUTE
AGAINST THE 16TH GARNISHEE BANK

I, Chiedozie Franklin Akwari, male, Christian, Nigerian citizen

of full age and capacity and of 3, Baltic Crescent, Off Danube
Crescent, Maitama, Abuja do hereby make oath and state as
follows:

1. That I am one of the counsel in the Law Firm of G.U.

Nwaneri and Associates of the aforesaid address engaged
by the 16th Garnishee Bank to defend this application on its
behalf by virtue of which I am conversant with the facts
deposed herein having obtained the prior consent and
authority of the managing director of the 16 th Garnishee
Bank and my employers to depose to this affidavit.

2. That in the course of a client/witness conference held with

the officers of the 16th Garnishee Bank in our office at the
aforesaid address on the 26th February, 2024 by 4.30 pm, I
was informed by Mr. Akachukwu Okechukwu and I verily
believed him as true the following:

(a) he is the acting company secretary of the 16 th

Garnishee Bank;
(b) the 16th Garnishee Bank was served with an order nisi
made on the 5th February, 2024 with respect to the
application attaching the judgment sum obtained by the
judgment creditor against the judgment debtors as may
be found deposited with the 16th Garnishee Bank;
(c) the 16th Garnishee Bank maintained a central customer
data and information storage and retrieval system;
(d) immediately the aforesaid order nisi made by this court
was served on the 16th Garnishee Bank, he conducted a
search on the 16th Garnishee Bank customer
information system and found that the judgment
 debtors do not maintain an account with the 16 th
Garnishee Bank.

3. That I depose to this Affidavit solemnly, sincerely believing

same to be true and correct under the Oaths Act, 2004
LFN.
