APPLICATION U/S 151 CPC SEEKING WITHDRAWAL

OF THE PRESENT PETITION ON BEHALF OF THE
PETITIONER.

MOST RESPECTFULLY SHOWETH:

1. The Petitioner has filed the present Petition U/s 13 of

H.M.A 1955 and the abovementioned matter is pending
before this Hon’ble Court and is fixed for 03.08.2024.
2. That the Petitioner and Respondent seeing larger interest
and for avoiding legal battle have settled the matter
amicably vide counselling settlement dated 08.04.2024
executed in front of family members of the Petitioner and
friends of the Respondent.
3. That in view of the settlement between the parties, the
petitioner wants to withdraw the captioned petition with
the liberty to approach this Hon'ble Court again in case
the terms of the settlement dated 08.04.2024 has been
violated by the Respondent in future.
4. That now the matter has been settled between both the
parties amicably and thus this withdrawal application has
been filed before this Hon’ble Court.

PRAYER
It is therefore most respectfully prayed:
a) To allow the present application for withdrawal with
the liberty to file an application for the restoration of
the same at same stage in future, if the settlement
failed and terms of the settlement dated 08.04.2024
violated by the Respondent husband.
b) Pass any other further order/direction as may be
deemed fit and proper, in the circumstances of the
present case and in the interest of justice.
