MEMORANDUM-OF-AGREEMENT-LEGIT TUNAYYYY
-and-
WITNESSETH:
WHEREAS, bona fide students of the FIRST PARTY who are currently enrolled
in Practicum/On the Job Training (OJT)/Internship are required, under their curriculum,
to undergo practicum training;
WHEREAS, the SECOND PARTY has agreed to accept the students of the
FIRST PARTY trainees, and be accredited as a training center for students under the
FIRST PARTY’S PRACTICUM or OJT program.
NOW, THEREFORE, for and in consideration of the foregoing premises and
stipulations herein set forth, parties hereby agree as follows:
Section 1. OBLIGATIONS OF THE FIRST PARTY:
1. Upon signing of this Agreement, the FIRST PARTY shall determine the qualified
students who will undergo the practicum training at the SECOND PARTY’s
premises, as provided in the list. A copy of said list of students is hereto attached
as Annex “A”;
2. Conduct an orientation upon its students regarding the standard office decorum
and discipline, and other rules and regulations in compliance to the Commission
on Higher Education’s (CHED) existing memorandum necessary for the proper
administration of the practicum program;
4. Undertake such other measures to ensure faithful compliance with this Agreement.
Section 2. RIGHT AND OBLIGATIONS OF THE SECOND PARTY:
1. Provide the necessary practical training to the students of the FIRST PARTY in
accordance to the course requirements;

2. Provide the students of FIRST PARTY, a defined program of activities and/or
assignments with the necessary facilities based on its regular office workload with
written notice to the FIRST PARTY and as agreed upon by both PARTIES;
3. Shall not under obligation to remunerate the students or afford them benefits
usually given to its regular employees other than those voluntarily given, as there
exists no employer-employee relationship between SECOND PARTY and students
of the FIRST PARTY;
4. Ensure that the students of the FIRST PARTY are amply protected from
harassment, exploitation, or any incident which shall put under peril their life,
health, and honor;
5. With prior notice, allow the authorized representative/s of the FIRST PARTY to
visit/monitor the students in the actual place of work during office hours;
6. Reserves full discretion to screen and evaluate the individual competence of the
student’s performance, attitude, or behavior;
7. Fill-out the necessary evaluation form/s from FIRST PARTY in relation to the
student’s performance both in practical and theoretical aspect of the training;
8. Provide humane condition of workplace and never assign the students in a work
which will endanger their health and safety;
9. Be liable for any loss, damage, or injury that the students may suffer during the
period of practicum unless caused by the intentional or negligent act on the part of
the latter; and
10.Shall not require the students to perform work during weekends and holidays as
well as overtime work unless appropriate compensation shall be given.
1. Students of the FIRST PARTY who shall successfully complete the practicum or
OJT program shall be entitled to a curricular credit of 2 units;
3. The PARTIES shall be under joint obligation to promote the welfare of the students
and assist in the formation of their intellectual, moral, and professional
competence;
4. The PARTIES shall be bound by the following system of grading the students:
(a) Grading period shall be based on the schedule provided by the FIRST
PARTY; and
(b) The SECOND PARTY, through its Coordinator/In-charge of the
practicum/OJT/internship shall provide Seventy Five percent (75%) of the
weighted average for the practicum period while the FIRST PARTY through its
assigned FACULTY/OJT Coordinator shall provide Twenty Five percent (25%)
of the weighted average for the same practicum period.
5. The PARTIES shall endeavor to base the grades or rating of the students on
the following:

a. Attendance/Punctuality;
b. Competence/Dependability;
c. Accuracy/Effectiveness;
d. Interest/Cooperation; and
e. Personality/Interpersonal Relations.
Section 4. EFFECTIVITY
The Agreement shall commence on FEBRUARY , 2024, TO APRIL , 2024 and
shall terminate upon completion of the number of hours required, unless otherwise
suspended, revoked, or extended by either party upon serving a seven-day prior written
notice.
IN WITNESS WHEREOF, the PARTIES have executed this MOMERANDUM of
AGREEMENT on FEBRUARY 5 , 2024 at LUCENA CITY.
