AND WHEREAS, the owner of Plot No.4 & 5 Mr. Sayyad Munniroddin
Banemiya prepared a building plan for construction over the said Plots & Nashik
Municipal Corporation Nashik sanctioned the same vide Letter No.
LND/BP/A4/208/3152/12 on 17/09/2012.
AND WHEREAS, As per the building plan developer has commenced and
completed the construction on the said property which is certified by Nashik
Municipal Corporation vide their full occupancy certificate Approval No: NMCB
/ FO / 2021/APL/00025 dated 5/10/2021 ,a building consisting of parking on
Ground floor plus Five upper floor standing thereon, hereinafter referred to as the
said building Known as AASHIYANA HEIGHTSAPARTMENT.
AND WHEREAS, after demise of Mr. Muniroddin Banemiya Sayyad all other
heirs released their rights in favour of Vendor.
AND WHEREAS, the said flat premises with all rights, title interest and
membership thereof of the said Apartment Association the Vendor is having clear,
valid, legal and marketable title to the said flat premises with discretionary power
thereof dispose off the said flat premises.
1. The vendor shall doth hereby sell, alienate, transfer, assign and convey his
all rights, title, interest and possession together with corresponding
ownership and membership in respect of the said flat premises, for a total
consideration of Rs. 12,00,000/- (In Words Rupees Twelve Lakh) which,
the purchaser has paid as per Schedule of payment. The vendor on execution
of this Deed of Apartment confirms handing over vacant and peaceful
possession of the said apartment to the purchaser by his Late Father Mr.
Muniroddin Banemiya Sayyad and the same is confirmed by this Deed of
Apartment. The purchaser have now become the exclusive owner of the said
flat by virtue of this Deed of Apartment along with right in common area
and facilities as defined in the Declaration of Apartment along with absolute
rights, authorities and power to deal with and dispose of the said flat
premises to any individual firms and institution of own choice.
2. On receipt of the full and final payment the said vendor hereby admits and
transfer by way of Final Conveyance or Deed Of Apartment into the said
purchaser forever all that the said flat premises along with 3.53% ownership
right of said flat premises situated in the said building known as
AASHIYANA HEIGHTSAPARTMENT, attached herewith having
description, in detail, as per Schedule-II.
3. As per the said Deed Of Declaration of AASHIYANA
HEIGHTSAPARTMENT Condominium the said flat holds and Ownership
percentage of voting in the said Apartment as undivided interest, right, title
over the assets of the said flat and common areas and facilities thereof
excluding all the reserved mentioned, in detail, as per the said Deed of
Declaration. submission of the said land property, under the provision of the
said Act and on execution of AASHIYANA HEIGHTSAPARTMENT
Condominium under the provisions of the said Act, the said vendor has
assigned and transferred all rights, title and interest over the said flat
premises in favour of the said purchaser, so as to use and possess the said
flat for the residential purpose and to hold it and to have it, as a perpetual
owner, along with all the benefits and rights available and granted for the
said flat is hereby finally conveyed in favour of the said purchaser within the
four corners of the Deed Of Declaration of AASHIYANA
HEIGHTSAPARTMENT.
4. Rights of Vendor /Grantor as On The said purchaser has hereby become the
absolute owner of the said flat premises as per the terms and conditions of
the Deed Of Declaration and all the bye-laws of the AASHIYANA
HEIGHTSAPARTMENT along with rules and regulations of the said Act
will be binding on the said purchaser.
5. The said purchaser will pay all the required rents, taxes, assessments,
transfer charges, expenditure or any other dues or amounts payable
Municipal Corporation or any Government Semi Government or to any
Body of the said Apartment. To the Government of Maharashtra, Nashik- 7.
6. It is hereby expressly agreed and confirmed by the said purchaser all the
terms & conditions of the agreement of sale and Deed of Declaration will be
binding on the purchaser and future members of the AASHIYANA
HEIGHTSAPARTMENT.
7. It is hereby expressly agreed and confirmed by the said purchaser all the
terms & conditions of the agreement of sale and Deed of Declaration will be
binding on the purchaser and future members of the AASHIYANA
HEIGHTSAPARTMENT.
8. AND WHEREAS the said vendor doth hereby for himself and for his legal
heirs, executors, administrators covenant with the purchaser that;-
a. The vendor now has in himself good right, full power and absolute authority
to grant Deed of Apartment/final conveyance to the said premises hereby
granted and sold and intended so to be unto and to the use of the purchasers in
the manner aforesaid.
b. The purchaser shall and may at all times hereafter and peaceably quietly
enter upon, hold, occupy, possess and the said enjoy exclusively premises
hereby granted or expressed so to be with the said appurtenances and receive
rents, issues, income and of profits thereof every part thereof for their own use
and benefit without Suit, lawful any eviction, from or interruption and claim
and demand whatsoever by the vendor or any person or claim person lawfully
claiming or to by from under or in trust for the vendor and all persons having or
the lawfully claiming any estate, right or interest whatsoever at law in said
premises hereby granted, sold, expressed so to be under or in trust for by, from,
the vendor.
9. AND WHEREAS, the said purchaser is in possession of the said flat as the
owner of the said flat and has inspected the construction of the said flat in all
respects, which, is to the satisfaction of purchaser and on such the said
satisfaction, the possession has been obtained and retained by the said
purchaser from the said vendor. The said purchaser does not have any
complaint, claim against Mr. Muniroddin Banemiya Sayyad Late father of
the said vendor, on any ground of completion of construction of the said flat
or monetary transaction, purchaser agreed between Mr. Muniroddin
Banemiya Sayyad Late father of the said vendor and the said purchaser.
10.AND WHEREAS the said vendor has received all the amounts of
consideration as agreed between Mr. Muniroddin Banemiya Sayyad Late
father of the vendor and no claim of the said against the said purchaser on
account of consideration or any amount of any other expenditure of the said
transaction.
11.The required expenses for stamp, registration miscellaneous expenses fees,
required for obtaining final conveyance of the said flat premises on
execution of the said Deed of Apartment has been borned by the purchaser.
12.The information of any further transfer of the said flat along with
appropriate copies of agreement or deeds will be recorded at the office of the
said AASHIYANA HEIGHTSAPARTMENT by the said purchaser.

All that piece and parcel of non-agriculture property bearing Plot No.4 area
adm.610.51 Sq. Mtrs out of S. No. 7/9, situated at Village Wadala, Taluka and
District Nashik within, the limits of Nashik Municipal Corporation, Nashik
bounded as follows:
West : 18 Meter DP Rd
The said property together with all easements, access and other rights appurtenant
thereto and together with parking on ground floor plus Five Storied building
standing thereon.
SCHEDULE –II
(OF THE SAID FLAT PREMISES HEREINABOVE REFERRED TO)
On the aforesaid property a building named as "AASHIYANA
HEIGHTSAPARTMENT", from and out of the said building, the premises
of residential Flat bearing No.04 (Four) on Second Floor as shown on the
building plan having area of 53.71 Sq. Mtrs. built up .The said premise is
bounded as shown below.
EAST: Apartment Unit No.03
WEST: Apartment Unit No.03
NORTH: Passage
SOUTH: Marginal Space
Together with the Common right to easement of common passage, staircase,
Parking, Toilet units, boring water in absence of Municipal Water, etc. and
open space to enter into the said flat.
