Reference: Memorandum from TDL, dated October 5, 2023, with the same subject as above. 2. This pertains to the memorandum from TDL directing C, RLRDDs and C, REUs to issue directives within respective Area of Responsibilty (AOR) on the restriction from construction of permanent structure(s) and perimeter fences within all PNP acquired lots through Usufruct Agreement, MOA, MOU andlor lease. 3. Relative thereto, based on the provisions of property law outlined inthe Civil Code of the Philippines, when a lots acquired by the PNP through Usufruc, the PNP has the right to use and enjoy the property while the ownership remains with the legal ‘owner (the grantor ofthe usufruct). Ths is similar to MOA, MOU andlor Lease where the property owner retains ownership ofthe property. The PNP's rights are limited to the terms and conditions specified in the agreement. In all these cases, the lt cannot be referred to as PNP property in the sense of full ownership. 4. In this regard, be informed that the construction of permanent structures Within lots aquired through the above-mentioned acquisition are, as of now, prohibited except for the construction of bulding/structures solely funded by the LGU. This isto give way on the prioritization of the construction of buildings and structures on properties already owned by the PNP (ie. Donated lots, land under Presidential Proclamation, and/or land designated by Execute Order). 5.
