2. Consistent with the policy platform of the CPNP to bring police services
closer to the general public by ensuring seamless, streamlined, efficient and effective
coordination and synergy among various PNP units and offices, this Center has
crafted a proposed memorandum circular on the above subject.

3. Among the salient features of the proposed memorandum circular are as


follows:

a. Provision of specific guidelines that define the operational and


administrative requirements and tasks of units involved in VAWC
and TIP operations; and

b. Establishment of the WCPC as the custodian of all data pertaining


to women and children cases as well as all data on Human
Trafficking cases.

4. It is imperative therefore that we should seek the realization of the


directive of the National Police Commission as it aims to optimize the gains of social
legislation as enshrined under Republic Act Nos. 9208 and 9262 through the
Philippine National Police, which in turn, will be the vanguard of women and children
protection in the country. Moreover, apart from removing the unintended confusion
among PNP units in addressing TIP and VAW cases, the proposed memorandum
circular will harmonize the functions, roles and contributions of all PNP units in TIP
and VAWC operations. Hence, it is recommended that the proposed memorandum
circular be approved.

5. The proposed Memorandum Circular was pilot tested to the PROs for two
months to gain consultation and obtain meaningful contributions and comments from
other units. As a result, several provisions in the MC were reconsidered to give way
to the inputs of other units.

6. In view of the above, the undersigned recommends approval of para 4


above and signature on the attached memorandum circular.

DELINEATION OF FUNCTIONS OF WCPC, PROs, and OTHER NOSUs ON


MATTERS PERTAINING TO WOMEN AND CHILDREN PROTECTION AND THE
CAMPAIGN AGAINST TRAFFICKING IN PERSONS

2. RATIONALE:

Aware of the present operational set-up in the campaign against


Trafficking in Persons (TIP), NAPOLCOM Resolution 2014-441 provides that other
units involved in Anti-Trafficking in Persons (ATIP) operations, including the CIDG,
shall be relieved of its functions in conducting operations and investigation of TIP
cases. PNP NHQ GO Number DPL-15-02, on the other hand, mandated the DIDM
to issue appropriate directives for a clearer delineation of functions of Women and
Children Protection Center (WCPC) vis-à-vis PNP National Support Units (NSUs),
and PROs on matters pertaining to women and children protection and ATIP
campaigns.

3. SITUATION:

a. The Women and Children Protection Desks

Title VII of RA No. 8551, the "PNP Reform and Reorganization Act of
1998" mandated the creation of women's desks in all police stations throughout the
country to administer and attend to cases involving crimes against chastity, sexual
harassment, abuses committed against women and children, and other similar
offenses. Pursuant thereto, a section specifically mandated to cater to crimes against
women and children, which later on evolved as the WCPD, also known as "Desk,"
was created in all police stations across the country.

The Desks, which are in charge of investigating Violence Against


Women and Children (VAWC), Gender-Based Violence (GBV) and other similar
offenses, are under the supervision and control of police stations in particular, and
the Police Regional Offices (PROs) in general, that exercise jurisdiction over them.

b. The Women and Children Protection Center

In 2001, the Women's Crisis and Child Protection Center (WCCPC),


known also as the "Center," based at the NHQ under the guidance and supervision
of the OCPNP through the DPCR was activated pursuant to NHQ PNP Circular
Number 2001-002. The Center later evolved as the Women and Children
Concerns Division (WCCD) under the DIDM and subsequently became the
Women and Children Protection Center (WCPC) in 2012, pursuant to
NAPOLCOM Resolution No. 2012-059 and PNP NHQ GO Number DPL-13-15. It
serves as a "one-stop shop" for the investigation and treatment of victims of VAWC
and other forms of GBV, through a multi-disciplinary approach.

Under NAPOLCOM Resolution No. 2012-059, the WCPC is mandated


to oversee, direct, and supervise the operations of the WCPDs at all levels of the
organization for the conduct of investigations, and other legal processes of
addressing VAWC and the filing of cases in court.

The WCPC serves as the policy-making unit and the repository of all
reports and statistics pertaining to crimes against women and children recorded in
the PNP. Likewise, it serves as a link to different agencies and Non-Government
Organizations (NGOs) for the advancement of its programs and the enhancement of
personnel manning the WCPDs and the Center.

The year 2014 saw the strengthening and restructuring of the WCPC
pursuant to NAPOLCOM Resolution No. 2014-441 and PNP NHQ GO Number
DPL-15-02, which added to the mandate of the WCPC all operations, investigation,
counterintelligence, surveillance and monitoring of suspected traffickers and TIP
activities, and the execution of necessary proactive campaigns to deter the
commission of such crimes.

c. Relationship Between the WCPC and the PROs vis-a-vis the


WCPD

The relationship between the WCPC and the PROs over the WCPDs
are defined by the manner of supervision and control they exercise. On one hand,
the WCPC devises the manner of investigation, crafts reporting mechanisms, and
prescribes the training to be undertaken by WCPD investigators. To a certain
degree, the WCPC exacts compliance from the WCPDs by submitting
recommendations to the concerned PRO in case of irregularity or neglect of duty on
the part of WCPD personnel.

On the other hand, the PROs direct, superintend, and oversee the day-
to-day functions of police investigations being conducted by the WCPDs. The PROs
likewise assign or reassign personnel of the WCPDs, and serves as the disciplinary
authority of erring personnel.

4. PURPOSE:

This Memorandum Circular (MC) is issued for the purpose of complying


with the directives provided for by NAPOLCOM Resolution No. 2014-441 and PNP
NHQ GO Number DPL-15-02. Specifically, the Circular seeks to attain the following
objectives:

a. To delineate the functions of the WCPC vis-à-vis the Police Regional


Offices and PNP National Support Units on matters pertaining to
women and children protection and trafficking in persons;

b. To provide guidelines during the transition period on the specific tasks


to be performed by the PROs through their Regional Anti-Trafficking
Task Group (RATTG) on matters pertaining to the conduct of
operations and investigation of TIP;

c. To provide rules on the conduct of investigation and referral


mechanism on TIP by the WCPDs of the PROs and Women and
Children Protection Sections (WCPSs) of the NOSUs; and

d. To provide rules on the conduct of operation and investigation of cases


of abuse against women and children by the WCPDs of the PROs and
WCPSs of NOSUs.

5. DEFINITION OF TERMS:

For purposes of uniformity, the following terms shall be operationally


defined and used:
a. Anti-Trafficking In Persons (ATIP) Operations — shall be deemed to
cover all aspects of anti-trafficking operations including but not limited
to actual operations, investigation, and compliance to administrative
requirements such as deployment of personnel, logistics, and other
resources.

b. Coordination — refers to the required act of coordination to be made


by the RATTG and other police units to the WCPC prior to the conduct
of ATIP operations.

c. Delineation — refers to the clarification of the respective jurisdictions


and definition of tasks, responsibility, and accountability of the WCPC,
PROs and other NOSUs with regard to investigation and operations
against VAWC and TIP nationwide.

d. Field Units — the three WCPC units created under NAPOLCOM


Resolution No. 2014-441 in Luzon, Visayas, and Mindanao to conduct
investigation, operations, intelligence gathering, and rescue operations
for VAWC and TIP cases.

e. Gender-Based Violence (GBV) — violence that is directed against a


person on the basis of his or her gender or sex, including acts that
inflict physical, mental or sexual harm or suffering, threats of such acts,
coercion, and other deprivations of liberty.

f. Pre-Operational Coordination — the coordination made by an


operating unit to the WCPC before it conducts an ATIP operation. It
consists of information furnished to the WCPC of the typie of ATIP
operation, team composition, and location of the operation. As a
general rule, it must be in writing and submitted to the WCPC before
the ATIP operation. In exigent cases, the coordination may be made
through available modes of communication, in which case the written
coordination should be made immediately after the operation. (See
Annex "A" — Pre-Operation Coordination)

g. Regional Anti-Trafficking Task Group (RATTG) — the Group created


pursuant to PNP LOI 01-2011 tasked to conduct operation and
investigation on cases pertaining to TIP at the regional level.

h. Trafficking in Persons (TIP) — refers to acts of Trafficking in Persons


defined and penalized by RA No. 9208, as amended by RA No. 10364.

Transition Period — the period by which the strengthened WCPC shall


have been capacitated to fully organize its three field units in Luzon,
Visayas and Mindanao. For this purpose, the transition period shall
end when the DIDM certifies through a Memorandum that the WCPC
has been fully organized and operationalized.
j. Violence against Women and Children (VAWC) — refers to any act of
abuse or violence committed against a woman or a child on account of
their vulnerability.

k. Women and Children Protection Center (WCPC) — the strengthened


and restructured Center mandated by NAPOLCOM Resolution No.
2014-441 to handle investigation and enforcement of laws against
trafficking in persons and violence against women and children.

I. Women and Children Protection Desk (WCPD) — Desk created in


every municipal, city, province and regional police office/station
pursuant to Section 57 of RA No. 8551, manned by at least one female
police investigator trained to handle matters pertaining to the protection
of women and children and TIP investigations.

m. Women and Children Protection Section (WCPS) — Desks/sections


created in every NASOs/NOSUs for the same purpose as of the
WCPD.

6. GUIDELINES:

a. General Guidelines:

1) The NOSUs and the PROs shall continue to maintain


WCPD/WCPS desks;

2) The three WCPC Field Units based in Luzon, Visayas, and


Mindanao shall be responsible for the effective implementation of
the WCPC functions in their respective jurisdictions; and

3) The RIDMD (R7) through the Regional WCPDs shall submit


periodic reports on monthly basis or as required by the WCPC on
VAWC and other cases of GBV handled. The PROs and the ACG
shall likewise periodically submit similar report on TIP cases to the
WCPC.

b. Guidelines on VAWC:

1) The WCPC and WCPDs shall retain their mandate on VAWC and
other forms of GBV, and shall continue to undertake operations on
cases involving women and children;

2) All VAWC and other forms of GBV cases in NOSUs shall be


handled by the WCPS. For this purpose, NOSUs that do not have
WCPS in their units shall establish their respective WCPS; and

3) The PROs and NOSUs shall make available their WCPDANCPS


personnel for training and capacity building on handling cases
involving women and children.
c. Guidelines on TIP:

1) Specific Guidelines for WCPC on TIP:

a) Initiate investigation and intelligence gathering upon receipt of


statements or affidavits from victims of trafficking, migrant
workers or their families who have knowledge or information on
TIP cases;

b) Assist the local police units in TIP-related investigations and/or


task force operations;

c) Undertake surveillance and monitoring of suspected traffickers,


TIP activities and their modus operandi, and execute necessary
proactive campaigns to deter the commission of such Crimes;

d) Prepare and update the watchlist of the most wanted traffickers


and maintain a system to receive complaints and calls to assist
the victims and their families;

e) Maintain and update the database on TIP cases in compliance


with Sec. 16, of RA No. 10364;

f) Develop and evaluate the implementation of best practices


strategies in order to promptly respond to specific issues that
may arise when dealing with victims of TIP and when
apprehending traffickers; and

g) Maintain linkages for exchange of information with competent


local and international agencies, NGOs and private institutions
for effective ATIP measures, prevention, victim protection and
assistance.

2) Specific Guidelines for PRO on RATTG:

a) Create and constitute the RATTG in their jurisdiction, if none has


been constituted, pursuant to L01-01-2011. It shall be headed
by the DRDO with members composed of the RIDMD, RID,
RPCRD, and WCPD, and other units which the Chairman
deems necessary in the conduct of ATIP Operations which may
include RACO, RHPU, RIU, RCIDU, RMU, and AVSEGROUP;

b) Cause the investigation of TIP cases that fall within their


jurisdiction in coordination with the WCPC; and

c) Submit pre-operation coordination and post-operation reports


following the prescribed forms attached to this Memorandum
Circular.
3) Specific Guidelines for NOSUs on TIP:

a) Turn-over TIP cases received to the WCPC. When TIP is


committed by, through and with the use of Information and
Communications Technology (ICT), the case may also be
referred to the ACG;

b) Coordinate with the WCPC prior to or during the conduct of


operation, where a TIP case is known to be present or when it is
incidental to the conduct of operation pertaining to their main
functions; and

c) TIP cases currently under investigation by the CIDG shall be


turned over to the WCPC, or, in the absence of a WCPC Field
Unit in the AOR, the WCPD of the Province or Region which has
jurisdiction over the case. Personnel who are witnesses in court
to pending TIP cases shall continue to participate in the
proceedings until the termination of the case.

4) Specific Guidelines for WCPDs of PROs in TIP:

a) Report on periodic basis or as required, to the WCPC all TIP


cases handled for investigation. Proactive investigation shall be
coordinated with the WCPC by submitting pre-operational
coordination prior to the operation, and the spot report, progress
reports and final report after the operation. In addition, a copy of
the entire case folder shall be submitted to the WCPC; and

b) Immediately seek guidance from WCPC in sensational cases,


on the possible courses of action to be undertaken.

7. RESPONSIBILITIES:

a. WCPC

1) Design a reporting mechanism for the periodic reporting of WCPDs


on TIP, VAWC, and other GBV cases handled;

2) Monitor the status of cases handled by all offices/units investigating


TIP, VAWC, and other GBV;

3) Conduct computer-based investigations, in coordination with the


PNP ACG and other law enforcement agencies, to identify and
apprehend suspects who utilize the internet to entice and/or coerce
young people into prostitution;

4) Coordinate with the School for Investigation and Detective


Development (SIDD), Training Service (TS) and Directorate for
Human Resource Doctrine and Development (DHRDD) on training
matters pertaining to competency courses on TIP and WCPD
Specialized Course;
5) Coordinate with the DPCR on advocacy and public awareness on
TIP, VAWC, and other GBV;

6) Coordinate with government prosecutors and other law


enforcement agencies in the successful investigation and
prosecution of TIP, VAWC, and other GBV cases;

7) Execute necessary proactive campaigns to deter the commission of


TIP, VAWC, and other forms of GBV; and

8) Perform other tasks as directed.

b. PRO, NOSU and RATTG on TIP

Pending the issuance of a manual for operation and investigation of


TIP cases, the following guidelines shall be observed:

1) Flowchart on TIP cases (see Annex "A-1"); and


2) Forms and standard report format (see Annex "A-2")

c. PRO and NOSU on VAWC and other GBV


The following guidelines shall be observed:

1) Flowchart on VAWC cases (see Annex "B"); and


2) Standard report formats (see Annex "B-1" and "B-2")

8. PENALTY CLAUSE:
Violations of any of the provisions of this MC will be considered as neglect
of duty as defined and penalized by NAPOLCOM Resolution No. 2007-001.

9. REPEALING CLAUSE:
All memoranda, circulars, or rules inconsistent with this MC are hereby
repealed or modified accordingly.

10. SEPARABILITY CLAUSE:


If, for any reason, any part or provision of this MC is declared invalid or
unconstitutional, any part or provision not affected thereby, shall remain in full force
and effect.

11. EFFECTIVITY CLAUSE:

This MC shall take effect 15 days upon filing of a copy hereof at the
University of the Philippines Law Center in consonance with Sections 3 and 4 of
Chapter 2, Book VII of Executive Order Nr 292, otherwise known as "The Revised
Administrative Code of 1987," as amended.
