CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT OF LEASE is made and executed at the City of Manila this day of _______________
by and between:

RENEE HOSANA DALIT, of legal age, married, Filipino, and with residence and postal address at
Block 2 Lot 2 Venezia Subdivision Pulang Lupa Uno Naga Road Las Piňas City Metro Manila, of
legal age, Filipino hereinafter referred to as the LESSOR.

-AND-

____________________________ of legal age, Filipino, with postal address at


______________________________ hereinafter referred to as the LESSEE.

WITNESSETH; That

WHEREAS, The LESSOR is the owner of 1803, a condominium unit situated at R SQUARE
RESIDENCES, TAFT AVE COR P. OCAMPO, MANILA.

WHEREAS, the LESSOR agrees to lease-out the property to the LESSEE and the LESSEE is willing to
lease the same;

NOW THEREFORE, for and in consideration of the foregoing premises, the LESSOR leases unto the
LESSEE and the LESSEE hereby accepts from the LESSOR the LEASED premises, subject to the
following:

TERMS AND CONDITIONS

1. PURPOSES: That premises hereby leased shall be used exclusively by the LESSEE for residential
purposes only and shall not be diverted to other uses. It is hereby expressly agreed that if at any time the
premises are used for other purposes, the LESSOR shall have the right to rescind this contract without
prejudice to its other rights under the law.

2. TERM: This term of lease is for one-year (1) year from April 20 2024 to April 19 2025
inclusive. Upon its expiration, this lease may be renewed under such terms and conditions as my be
mutually agreed upon by both parties, written notice of intention to renew the lease shall be served to the
LESSOR not later than thirty (30) days prior to the expiry date of the period herein agreed upon.

3. RENTAL RATE: The monthly rental rate for the leased premises shall be in the amount of
TWENTY FIVE THOUSAND PESOS ONLY (P 25,000.00), Philippine Currency. All rental payments
shall be payable to the LESSOR on or before the Twentieth (20th) day of each calendar month.

4. SECURITY DEPOSIT: That the LESSEE shall DEPOSIT to the LESSOR upon signing of this
contract and prior to move-in a security deposit in an amount equivalent to the rent for ONE (1) MONTH
or the sum of in TWENTY FIVE THOUSAND PESOS ONLY (P 25,000.00), Philippine Currency),
Philippine Currency. Wherein the one (1) month deposit was paid last ________which will be the
Retention Payment to answer partially for damages and any other obligations, for resulting from
violation(s) of any of the provision of this contract otherwise it will be refundable not later than one (1)
month after the termination of the contract or expiration of the contract or after the LESSEE has moved-
out of and vacated the residential house, whichever is later.

This Security Deposit shall be held without interest by the LESSOR as security in order to
guarantee the LESSEE’s faithful observance of this Contract; to answer for the return in good
order and condition of the LEASED PREMISES and its contents; to cover the cost of any damage
beyond normal and reasonable wear and tear that the LEASED PREMISES and its contents may
suffer through the LESSEE’s fault or negligence; and to settle the LESSEE’s unpaid accounts for
telephone, electricity, water and other such charges. It is further understood that the Security
Deposit shall in no case be applied as rental. This Security Deposit or the balance thereof, if
used, shall be refunded no later than thirty (30) days from termination of the Lease or return of
the Leased Premises and settlements of accounts as noted herein, whichever comes first. An
Acknowledgment Receipt duly signed by the LESSOR shall be given to the LESSEE for the
payment of the Security Deposit. Likewise, premature and or pre-termination of this contract
and commitment of violations against the property will result to forfeiture of deposit.
Moreso, the rental payment should still be paid for the month consumed aside from the
forfeiture of deposit.

5. ADVANCE RENTAL PAYMENT: Advance rental payment which was received and paid last
________in the amount of twenty five thousand pesos (Php 25,000.00) shall be applied as an advance
one month rental payment for the period of APRIL 20 TO MAY 19 2024. Succeeding payment
following the same period shall be paid through PDC following the schedule dates mentioned above.

6. MODE OF PAYMENT. All rentals for the remaining eleven months shall be paid in PDC (post
deposit check) under the name of the Lessor. Security Deposit and Advance one month rent shall be paid
in cash.

7. DEFAULT PAYMENT: In case of default by the LESSEE in the payment of the rent, such as when
the checks are dishonoured (if applicable), the LESSOR at its option may terminate this contract and eject
the LESSEE. The LESSOR has the right to padlock the premises when the LESSEE is in default of
payment for One (1) month and may forfeit whatever rental deposit or advances have been given by the
LESSEE.

8. SUB-LEASE: The LESSEE shall not directly or indirectly sublet, allow or permit the leased premises
to be occupied in whole or in part by any person, form or corporation, neither shall the LESSEE assign its
rights hereunder to any other person or entity and no right of interest thereto or therein shall be conferred
on or vested in anyone by the LESSEE without the LESSOR'S written approval.
9. OCCUPANTS: Maximum occupancy for the residential house shall be ____________only. The
residential house will only be occupied by the LESSEE and its immediate family exclusive (maximum of
two persons including the lessee) for residential purposes only. STRICTLY NO KIDS, PETS AND
VISITORS ALLOWED.

10. PUBLIC UTILITIES: The LESSEE shall pay for its electricity and water bill during the duration of
the lease.

11. FORCE MAJEURE: If whole or any part of the leased premises shall be destroyed or damaged by
fire, flood, lightning, typhoon, earthquake, storm, riot or any other unforeseen disabling cause of acts of
God, as to render the leased premises during the term substantially unfit for use and occupation of the
LESSEE, then this lease contract may be terminated without compensation by the LESSOR or by the
LESSEE by notice in writing to the other.

12. LESSOR'S RIGHT OF ENTRY: The LESSOR or its authorized agent shall after giving due notice
to the LESSEE shall have the right to enter the premises in the presence of the LESSEE or its
representative at any reasonable hour to examine the same or make repairs therein or for the operation and
maintenance of the building or to exhibit the leased premises to prospective LESSEE, or for any other
lawful purposes which it may deem necessary.

13. ALTERATIONS: The LESSEE agrees not to introduce any improvements or make any alterations in
or to the residential house. The LESSEE agrees not to alter damage, or remove LESSOR's property,
including but not limited to furniture, fixtures, utility and cable TV wiring, windows, locks, keys and
security devices. No holes are allowed, inside or outside the residential house. Only items using non-
permanent or removable adhesive strips or tapes may be placed on the walls, floors, or ceiling of the
residential house. Any improvements to the residential house (with or without LESSOR's consent) shall
become property of the LESSOR unless agreed otherwise in writing.

14. MAINTENANCE, REPAIR AND REPLACEMENT: LESSEE shall well and sufficiently preserve,
repair and maintain in good, clean tenantable condition, at his/her own cost, the interiors of the residential
house, including the flooring, interior walls or other finishes, doors, windows, cables, conduits, wirings,
sockets, electrical installations, and plumbing fixtures found in or about the residential house. The
LESSEE shall, at his/her own expense, replace the light bulbs in the residential house with the same type
and wattage as well as repair or replace parts in the toilet tank with the same type and quality as that
installed by the LESSOR. The residential house and all additions and installations supplied by LESSOR
shall be kept in a good, clean, working condition. LESSEE shall keep drains, pipes, sanitary or plumbing
apparatus in the residential house in good, clean and tenable condition. LESSEE shall pay LESSOR the
costs in cleaning, repairing or replacing any of the same when found to be blocked or stopped. LESSEE
shall take all such steps and precautions at his/her own cost to prevent the Leased Premises from
becoming infested with termites, rats, mice, cockroaches or other pests or vermin. Should LESSEE fail to
maintain the Leased Premises properly such that the same is infested with pests, LESSOR may employ
pest control services on the Leased Premises and charge the cost thereof to LESSEE. All minor repairs in
the residential house will be at the LESSEE’s sole expense. Major repairs not caused by or attributable to
LESSOR’s fault or negligence shall be for the LESSEE’s sole account.

15. EXPIRATION OF LEASE: At the expiration of the term of this lease or cancellation thereof, as
herein provided, the LESSEE will promptly deliver to the LESSOR the leased premises with all
corresponding keys and in as good and tenable condition as the same is now, ordinary wear and tear
expected devoid of all occupants, movable furniture, articles and effects of any kind added by the lessee.

16. JUDICIAL RELIEF: Should any one of the parties herein be compelled to seek judicial relief
against the other, the losing party shall pay an amount of One Hundred (100) % of the amount claimed in
the complaint as attorney's fees which shall in no case be less than P50,000.00 pesos in addition to other
cost and damages which the said party may be entitled to under the law.
17. This CONTRACT OF LEASE shall be valid and binding between the parties, their successors-in-
interest and assigns.
