 TERMS AND CONDITIONS
PAYMENT
A non-refundable retainer of Php 10, 000.00 is due at the signing of this Agreement. Upon receipt of the retainer, Motion Diaries will reserve your date
and be available to you on that date. The retainer is applied toward your total investment agreement. We will not reserve your wedding date until
after receipt of the retainer. You may not transfer the retainer to another party, bridal couple or anyone else without our prior written consent. Fifty
Percent (50%) of the total package less the retainer fee will be given on the day of the Pre- nuptial shoot. In cases that no pre-nuptial shoot was availed
in the package, payment of the Fifty Percent (50%) will be settled one month prior to the event. If the Fifty Percent (50%) is not paid during the day of
the pre-nuptial shoot (or six months prior to the scheduled date of the event), we reserve the right not to provide service on the event. The second
installment of Fifty Percent (50%) will be settled on the event day.

PRE-NUP SHOOTS
Pre-nuptial shoots done within Manila are considered free of travel expenses. If the Pre-nuptial shoot will be done outside Metro Manila, travel
expenses such as parking, toll fees, fuel costs, lodging, plane tickets, destination fees or any other expenses that will be incurred must be shouldered
and arranged by the client for Motion Diaries. Payment for the expenses incurred must be paid on the day of the shoot or it can be added to the
balance due after the event

OUT OF TOWN WEDDINGS

Travel expenses such as parking, toll fees, fuel costs, lodging, plane tickets, destination fees or any other expenses that wi ll be incurred must be
shouldered and arranged by the client for Motion Diaries. Payment for the expenses incurred can be paid on or before the day of the shoot.
In cases where the client will be needing the assistance from Motion Diaries, the assistance will only be limited to helping the client find the suppliers,
venues and other items needed to accomplish the shoot. Payment for the venues and/or supplier will be between the client and the supplier that was
referred.

CREATIVE FREEDOM
Collaboration of ideas are normally allowed; however, the client hereby allows Motion Diaries full creative freedom, during the prenuptial shoot and
during the wedding day. Motion Diaries’ shooting style is based on the editing style of the company. Therefore, clients should give Motion Diaries full
creative control on the editing of the Save the date/Mini Movie, Same Day Edit Video, and Wedding Film Highlights.

EVENT FOOD SERVICE

A light meal is required for events up to 6 hours for the whole team of Motion Diaries. For events up to and past 8 hours a full course meal is required.
If no meal is provided, it is understood that Motion Diaries will leave the event to purchase a meal and you will be charged Php250.00 per person per
meal. Expenses for the meal will be reimbursed by the client.

CHANGE OF DATE OR VENUE

Motion Diaries must be notified immediately of any changes in schedule or location 90 days prior to the scheduled date of event. Notification of a ny
changes can be made by phone along with written notice sent via email for documentation. If the event is changed within 90 da ys of the initial date,
the client shall pay the balance of the contract due to the high probability that Motion Diaries will not be able to further book that date for other
events. If an email is sent, a confirmation of receipt must be in writing. It is the client’s responsibility to confirm all arrangements at least 90 days prior
to the event. In the event of change of address or contact information (time, etc.) as listed, you must notify Motion Diaries.

CANCELLATION
There shall be NO REFUND of retainer after the signing of agreement due to the reservation of the date. If the event is cancelled within
90 days of the event date, the client shall pay the full remainder of the balance of the contract due to the high probability that Motion Diaries will not
be able to further book that date. Once a balance is paid, it is NON- REFUNDABLE. Any other arrangements shall be discussed between the client and
Motion Diaries and shall be put in writing. Cancellation must be in writing even if a phone call was made to inform Motion Diaries of the cancellation. If
prenuptial shoot has been done and you decide to terminate the contract after, the down payment and the first 50% will not be refunded.

FORCE MAJEURE
If Motion Diaries cannot perform this agreement due to a fire, casualty, strike or other civil disturbances, Acts of God, including but not limit ed to, road
closures, severe traffic, fire, terrorism or other causes beyond the control of the parties, or due to the videographers illness, then Motion Diaries shall
return any moneys paid by the client, less expenses, but shall have no further liability with respect to the agreement. This limitation of liability shall
also apply in the event that video materials are damaged in processing, lost through camera malfunction, compact flash card malfunction, lost in the
mail, stolen gear or otherwise lost or damaged without fault on the part of Motion Diaries.

COPYRIGHT
Except as noted below, all Videos created by Motion Diaries are copyright protected. It is a violation of Republic Act No. 8293, which enshrines the
copyright law of the Philippines, to copy, scan, or allow videos of Motion Diaries to be reprinted, duplicated, digitally reproduced, copied, scanned, or
altered (digitally or otherwise), without Motion Diaries’ express written permission.

PANDEMIC
Should clinical tests be required prior to the event for safety precautions, all clinical, laboratory and medical certificati on costs shall be shouldered by
the client. The studio also has the right to apply the regular rates if the client’s guests exceed the agreed number of guest s during the event (30 pax).
For safety, all team members of Motion Diaries will ensure and declare that there is no exposure or symptoms 14 days prior to the event date. We will
also ensure that safety precaution, such as, wearing masks and/or other protective gears and practicing social distancing.

ARCHIVAL
Motion Diaries has 2 backups for each client and a copy of the raw files are given to the client as a 3 rd backup. It is the clients’ responsibility to provide
a hard drive within 3 working days after the event day. If the client failed to do so and the raw files were corrupted, damaged, and lost, Motion Diaries
holds no responsibility whatsoever. Motion Diaries will archive the raw files for another month after the delivery of the final output.

EXCLUSIVITY
In order for the Client to receive the best service and most compelling videos possible, Motion Diaries must be the exclusive professional videographers
for the event. Additional professional videographers may be employed only with prior written permission from Motion
Diaries.

EXPENSES
Travel expenses such as parking, shipping, or destination fees must be reimbursed to Moti on Diaries and will be added to the balance due
after the event.

LIMITS OF LIABILITY
While every reasonable effort will be made to produce and deliver outstanding videography of the event, the entire liability of Motion Diaries to the
Client for any claim or loss arising from our performance is limited to a refund to the Client of the amount paid for services. Some factors may be
uncontrollable during the event, therefore, Motion Diaries cannot guarantee delivery of any specifically requested image(s) especially with the
restrictions of the venue and the likes. In the unlikely event of personal illness or other circumstances beyond the control of Motion Diaries, a substitute
videographer acceptable to you may be sent to fulfill the obligations of Motion Diaries. In such case that the Client declines the substitute videographer,
the Client may terminate this agreement and receive a full refund of all moneys paid. Motion Diaries will not be held liable for the finished product or
incomplete coverage in the event of tardiness or time restrictions placed on Motion Diaries by Client or any outs ide vendors, including clergy or church
restrictions and/or policies on the day of the event.

PERMISSIONS
It is the clients’ responsibility to schedule and secure permits to use various locations for videography, including the pre-nuptial, wedding, and
reception locations and any other locations to be used for the wedding.

PRODUCT DELIVERY & PRICE LOCK

Final Output including the cinematic highlights (if availed), DVDs, thumb and hard drives shall be delivered within 6-8 months after the event date. The
client shall be notified should the materials be ready for shipping or pickup. Upon notification, the clients must arrange for pickup and delivery of DVDs
and other products within a reasonable time period, not to exceed 30 days after notification. Motion Diaries is not responsible for any damage that
may be incurred while the proofs and/or other final products are in storage after said 30 days. The terms of this agreement are valid for 6 months after
the date of the event. If no correspondence has been received by that date, this agreement will be considered completed in ful l. Motion Diaries cannot
be held liable in the event that video materials are damaged in the processing, lost/damaged in the mail, or otherwise lost or damaged without fault
on the part of the videographer. No money will be reimbursed. All prices are locked in for 6 months. After 6 months prices ar e subject to change. In
the event Motion Diaries decides to increase the rates, the price in this contract shall not be affected and shall stay as it is. Unless, the client availed
the lowest package and decided to have additional services at the time of the increase in rates. Only the additional services shall be affected and not
the basic package availed.

RETURNED CHECKS
Returned checks are subject to a Php2,500 returned check fee. Client assumes responsibility for any and all collection costs and legal fees incurred by
Motion Diaries in the event of enforcement of this contract becomes necessary. All legal action shall take place in the Metro Manila, Philippines.
UPGRADE
Clients who booked the lowest package may avail or upgrade of any additional services with additional charges applying. Motio n Diaries should be
notified at least a month before the scheduled event in writing.
I hereby state that I approve of and agree to abide by the videographers’ creative decisions in the video taking and editing process. I have also read
the terms and conditions listed on the second page.
