APPLICATION FOR PROBATION

COMES NOW, Accused RODEL CASTILLANO y DE LEON,
assisted by the undersigned counsel from the Public Attorney's Office, to
this Honorable Court, most respectfully applies for Probation under P.D.
No. 968, as amended and avers that:

1. During the Promulgation of Judgment on 27 May 2021, Accused

was sentenced the penalty of:
1.1 imprisonment of one (1) year and to pay a fine of ten thou-
sand pesos (Php10,000.00), subject to subsidiary impris-
onment in Criminal Case No. 2020-569; and

1.2 imprisonment of one (1) year and to pay a fine of ten thou-
sand pesos (Php10,000.00), subject to subsidiary impris-
onment in Criminal Case No. 2020-570

 after accused availed of Plea Bargaining under A.M. No. 18-03-16-
SC (Adoption of the Plea Bargaining Framework in Drugs Cases);

2. The offenses for which accused was convicted are not crimes
against the Security of the State and Public Order;

3. Accused, being person deprived of liberty (PDL) has no

capacity to pay the imposed fine, thus praying that it be served
through subsidiary imprisonment, which accused intends to
include to this Application;

4. Accused does not suffer from any of the disqualifications of the

Probation Law and he would like to avail the benefits and
privileges accorded by law to first time offenders;

5. Accused has not been previously placed on probation under

the provisions of P.D. No. 968, as amended; and

6. Accused is sincerely remorseful of having committed the

offenses and if granted probation, he is willing to undergo
supervision under such terms and conditions that may be
imposed by the Honorable Court.

PRAYER

WHEREFORE, foregoing premises considered, it is most

respectfully prayed of this Honorable Court to give due course to this
Application for Probation and place herein accused-applicant on
probation in accordance with law.

Other reliefs, just and equitable under the premises, are also
prayed for.
