INTERNAL RULES AND PROCEDURES

The creation of this Internal Rules of Procedures is very useful to the Sangguniang
Barangay of Rivera for the purpose of ensuring orderly sessions and enhancing quality
legislation.

RESOLUTION TO ADOPT THE INTERNAL RULES OF PROCEDURES IN THE


SANGGUNIANG BARANGAY OF RIVERA, SAN JUAN CITY

WHEREAS, under Batas Pambansa Blg. 7160, otherwise known as the 1991 Local
Government Code, particularly under Sention 50 thereof, respectfully states that: “ xxx On
the first regular session following the election of the members and within ninety (90) days
thereof, the Sangguniang Barangay shall adopt or update its existing Internal Rules of
Procedure.”

WHEREAS, after emphasizing the necessity of having an Internal Rules of


Procedures, the body agreed for the adoption of the same;

NOW. THEREFORE, on motion of Kagawad John Roy SL. Saragoza, seconded by all
Sangguniang Barangay Rivera Members present, RESOLVES, as this body hereby
RESOLVED to adopt the Internal Rules of Procedures of the Sangguniang Barangay of
Rivera to wit :
RULE I – COMPOSITION
SECTION 1. As provided for under R.A. 7160 otherwise known as the “1991 Local
Government Code” the Sangguniang Barangay is composed of:
1. The Punong Barangay
2. The seven (7) Sangguniang Barangay Members elected
3. The Sangguniang Kabataan Chairperson as Ex-Officio Member

RULE II – POWERS, DUTIES AND FUNCTIONS OF THE SANGGUNIANG


BARANGAY
The Sanguniang Barangay shall:
SECTION 1. Enact ordinances as may be necessary to discharge the responsibilities
conferred upon it by law or ordinance and to promote the general welfare of the
inhabitants therein.

SECTION 2. Enact Tax and revenue ordinances, subject to the limitations imposed by the
Local Government Code.
SECTION 3. Enact annual and supplemental budgets in accordance with the provision of
the Local Government Code.

SECTION 4. Provide for the construction and maintenance of barangay facilities and other
public works projects chargeable to the general fund of the barangay or such other funds
actually available for the purpose.

SECTION 5. Submit to the sangguniang barangay such suggestions or recommendations


as it may see fit for the improvement of the barangay or the welfare for the inhabitants
thereof.

SECTION 6. Assist in the establishment, organization and promotion of cooperative


Enterprises that will improve the economic condition and well being of the residents.

SECTION 7. Regulate the use of multi-purpose halls, or other similar facilities constructed
with government funds within the jurisdiction of the barangay and charge reasonable fees
for the use thereof.

SECTION 8. Seek and accept the cooperation of national, provincial, city of municipal
Agencies in implementing public works and cooperative enterprises.

SECTION 9. Provide compensation, reasonable allowances or per diems for sangguniang


Barangay members and other barangay officials and personnel, subject to the budgetary
limitations prescribed under the Local Government Code.

SECTION 10. Hold fund-raising activities for barangay projects without the need of securing
permits from any national or local office or agency. The proceeds from such activities shall
be tax exempt and shall accrue to the general fund of the barangay; Provided, that in the
appropriation thereof the specific purpose for which such fund-raising activity shall comply
with national policy standards and regulations on morals, health and safety of the persons
participating therein. The Sangguniang Barangay, through the Punong Barangay, shall
render a public accounting of the funds raised at the completion of the project for which the
fund-raising activity was undertaken.

SECTION 11. Authorize the punong barangay to enter into contracts in behalf of the
barangay, subject to the provisions of the local government code.

SECTION 12. Authorize the barangay treasurer to make direct purchase in an amount not
Exceeding Two Thousand pesos (₱2,000.00) at any one time for the ordinary and essential
administrative needs of the barangay; to keep custody of barangay funds and properties; to
collect and issue official receipts for taxes, fees, contributions, monies, materials, and all
other resources accruing to the barangay treasury and deposit the same in the account of
the barangay; to disburse funds in accordance with the financial procedures provided under
the local government code; to maintain petty cash fund not to exceed the amount of Ten
Thousand Pesos (₱10,000.00); to render an accounting report of all barangay funds and
Property at the end of each calendar year; to certify as to the availability of funds whenever
Necessary; and to exercise such other powers and perform such other duties and functions
as may be prescribed by law and ordinance.

SECTION 13. Prescribed fines in amounts not exceeding One thousand pesos (₱1,000.00)
for violation of barangay ordinances.

SECTION 14. Provide for the administrative needs of the lupong tagamayapa and the
Pangkat ng tagapagsundo.

SECTION 15. Provide for the organization of different committees, barangay tanod or
Community service units as may be necessary.

SECTION 16. Organize regular lectures, programs, of fora on community problems such as
Sanitation, nutrition, literacy and drug abuse, and convence assemblies to encourage citizen
Participation in government.

SECTION 17. Adopt measures to prevent and control the proliferation of squatters and
Mendicants in the barangay.

SECTION 18. Provide for the proper development and welfare of children in the barangay
by promoting and supporting activities for the protection and total development of children,
particularly those below seventeen (17) years of age.

SECTION 19. Adopt measures towards the prevention and eradication of drug abuse, child
abuse, and juvenile delinquency.

SECTION 20. Provide for the establishment of a non-formal education center in the
Barangay whenever feasible in coordination with the Department of Education, Culture and
Sports

SECTION 21. Provide for the delivery of basic services.

SECTION 22. Exercise such other powers and perform such other duties and functions as
May be prescribed by law or ordinance.

RULE III – DUTIES AND REPONSIBILITIES OF INDIVIDUAL MEMBERS


SECTION 1. Every member of the Sangguniang Barangay shall make a full disclosure of his
financial and business interests as required in him under the Local Government Code.

SECTION 2. Every member shall attend all the regular sessions and special sessions of
the Sangguniang Barangay unless he is prevented from doing so by reason of sickness or
other unavoidable circumstances. Provided however that, should there be official business
of any member for which reason he/she connot attend a session, he/she shall not be
considered absent for that day.

SECTION 3. Every member shall perform their duties and responsibilities being an
“Officer of the day” and shall wear the Barangay Uniform thereof;

SECTION 4. As a general rule, every member is required to vote on every question or


Proposed measure being voted upon by the Sangguniang Barangay. Abstentions may be
Allowed if it can be shown that the member concerned has conflict of interest, either directly
Or indirectly on the matter being acted upon.

SECTION 5. Every member of the Sangguniang Barangay shall observe proper


Department and decorum during sessions. The proper attire during the regular
sessions and special sessions shall be the Barangay Uniform, pants and shoes for men
and step-in for women.

SECTION 6. Members of the Sangguniang Barangay may be disciplined for disorderly


behavior, insubordination, and absences without justifiable cause for four (4) consecutive
regular sessions for which they may be censured, reprimanded or excluded from the
session, suspended for not more than sixty (60) with deduction from his/her leave credits.

SECTION 7. The penalty of suspension or expulsion shall require the concurrence of at least
two-thirds (2/30) vote of all Sangguniang Barangay Member.

SECTION 8. Any member who shall be convicted by final judgement of a crime involving
moral turpitude expelled from the Sangguniang Barangay.

SECTION 1. SUBMISSION OF COMMITTEE REPORT. Every committee to which the
Presiding Officer refers a particular measure shall submit its report in writing to the
Sangguniang Barangay, thru the Secretary, after finishing its task.

SECTION 1. Any part of this “Internal Rules of Procedure”, except those prescribed by
existing laws, may be suspended at any particular session by general consent of all its
members or upon the initiative of the Presiding Officer.

RULE XVIII – AMENDMENTS


SECTION 1. This “Internal Rules of procedure” may be amended at any regular session by a
Two-thirds (2/3) vote of all the members of the Sangguniang Barangay, provided that prior
Notice of such proposed amendment is given to all members and provided further that no
Provision herein which is based on, or prescribed by, existing laws shall be amended:

RULE XX – EFFECTIVITY
SECTION 1. This “Internal Rules of Procedure” shall take effect upon its approval.

Approved and Adopted this 3rd day of February. 6, 2024 here at Barangay Rivera Hall,
San Juan City.
