EXTENSION

FOR CONTRACT OF SERVICES


KNOW ALL MEN BY THESE PRESENTS:

This Contract of Services is entered into by and between the SOUTHERN PHILIPPINES
AGRI-BUSINESS AND MARINE AND AQUATIC SCHOOL OF TECHNOLOGY
(SPAMAST), Malita, Davao Occidental herein represented by LYNETTE A. BONTIA, Ph.D.,
in her capacity as the President herein referred to as FIRST PARTY.

-AND-

JERRIC PAUL U. MIGUEL, of legal age, married, Filipino and a resident of Poblacion,
Malita, Davao Occidental herein referred to as SECOND PARTY.

WITNESSETH;

WHEREAS, the SECOND PARTY is under a Contract of Service notarized by ATTY.


OPHELIA C. DELUTE under Doc No.46, Page No. 11 of Book 1 series of 2003, with the
FIRST PARTY, dated September 10, 2023 and will end on October 2023;

WHEREAS, the FIRST PARTY is in need of the services rendered by the FIRST PARTY in
order prevent delay and undermine the day to day services of SPAMAST;

WHEREAS, it is in the best interest of both parties that the services of the SECOND PARTY be
extended until the December 29, 2023;

WHEREAS, the SECOND PARTY agrees to the extension for the duration of the Contract of
Service.

NOW THEREFORE, for and in consideration of the monthly rate of ELEVEN THOUSAND
SIXTY-EIGHT PESOS ONLY (P11, 068.00) to be paid twice a month for the actual work
services rendered (after submission of the approved DTR) and a premium of up to 20% of the
salary/wage which will be paid in lump sum or in tranches, the parties have agreed as follows:

1. That this contract does not create an employer-employee relationship between the FIRST
PARTY and the SECOND PARTY and shall remain in force from November 6, 2023 –
December 31, 2020 only;

2. That the Second Party shall perform the same functions that are stated in their original
Contract of Service.

3. That the SECOND PARTY shall perform work at a time and schedule to be agreed upon
by both parties;

4. That the SECOND PARTY shall perform work which are not performed by the regular
employee and shall not be entitled to benefits enjoyed by the latter;

5. That the FIRST PARTY warrants the following pursuant to CSC Resolution 02-0790
2017, policies and guidelines of the school, CSC-COA and DBM Joint Circular No. 1, s.
2018:
a. The person hired has not been dismissed from the service due to
commission on an administrative offense;
b. The person hired is not covered under the rules of nepotism;
c. The person hired is not to perform functions pertaining to a vacant
regular plantilla position in the agency/local government unit; and
d. That the funding allocation of the above compensation shall be
chargeable against MOOE;
e. That the Second Party shall secure and accomplish clearance from
financial, property and work responsibilities/accountabilities before
leaving the College and claim his/her last pay for the semester.
f. Qualified COS and JO workers shall be considered for appointment to the vacant
positions of the Institution subject to existing Civil Service laws, rules, and
regulations and CSC- approved Merit Selection Plans.

6. In case the SECOND PARTY wishes to leave SPAMAST before contract completion,
he/she should submit a letter of resignation, one (1) month prior notice of his/her
resignation, subject to the Management’s right to waive this requirement in writing;

7. Regardless of the reason for separation from service, SECOND PARTY must
do the following before his/her departure from SPAMAST:
a. Return or transfer any and all SPAMAST property with proper
turnover documents;
b. Settle all outstanding obligations;
c. Undergo an exit interview with the immediate supervisor, the
Human Resource Management Officer and the President;
d. Complete the standard clearance procedure by obtaining
clearance from all designated clearing officers.

8. That the SECOND PARTY is bound to follow the rules and regulations of SPAMAST
and any infraction or violation of this contract can, in certain circumstances, result in
legal action taken by the FIRST PARTY against the SECOND PARTY.
