CONTRACT OF SERVICE

KNOW ALL MEN BY THESE PRESENTS:

This contract is entered by and between:

The Department of Education - ******** Elementary School, with official address at Brgy. Danlugan,
Dumingag, Zamboanga del Sur, represented herein by _____________________________Head Teacher II/School
Head, herein after referred to as the “FIRST PARTY.”

And-

_________________------ of legal age, Filipino and with residence at Barangay Danlugan, Dumingag,
Zamboanga del Sur, herein after referred to as “SECOND PARTY.”

WITNESSETH:

1. That the First Party is in need of the services of the Second Party who shall perform work not performed by
the regular personnel of the First Party;

2. That the Second Party has signified his intention, to which the First Party has accepted, to provide the
service needed by the latter;

3. That the Second Party possesses the skills required to perform the job as described herein;

4. That in view hereof, the Second Party is hereby contracted as a Utility Worker from July 01, 2024 to
December 31, 2024, in consideration of the monthly wage of Three Thousand Pesos only (Php. 3,000.00);

5. That as a Utility Worker, the Second Party is expected to perform the following functions, to wit;

a. To render Labor/Utility Works eight (8) hours a day from Monday to Friday within the contract
period.

b. Adhere to the contract standards set by the First Party and

c. Submit to the school administration needed reports which include but not limited to work
accomplishments, Daily Time Record (DTR) and others.

6. That this contract does not create an employer-employee relationship between the parties;

7. That the services under this Contract of Service are not covered by Civil Service law and rules, hence, not
creditable as government service.

8. The Second Party will not enjoy the benefits enjoyed by government employees, such as leave, PERA,
RATA, and 13th month pay.

9. Notwithstanding the fixed duration of this contract, the services of the Second Party may be terminated
earlier than the expiration date due to unsatisfactory service, unavailability of funds, or other reasonable
causes.

10. The role of the Utility Worker is vital to the effective functioning of the school for the following reasons:

a. Ensuring that school buildings and facilities are well-maintained, clean, and safe is crucial for creating
a conducive learning environment for students.

b. Utility Workers help manage school resources efficiently, ensuring that furniture, equipment,
and supplies are in good condition and readily available.

c. By assisting with logistical tasks and minor repairs, Utility Workers allow teachers and administrative
staff to focus more on their primary responsibilities, enhancing overall productivity and effectiveness.
