CRL.A. 182/2021
1. The appellant has preferred the present appeal under Section 374
Cr.P.C. against the judgment dated 01.04.2021 and order on sentence dated
05.04.2021 passed by Additional Sessions Judge, vide which appellant has
been convicted under Section 120-B IPC and sentenced to undergo rigorous
imprisonment for a period of one year with fine of Rs.1,00,000/-.
2. It is submitted by learned senior counsel for the appellant that fine has
already been paid.

4. List this appeal in due course in the category of ‘Regulars’ as per the
year of its seniority.
5. Issue notice. Notice of admission of the appeal is accepted on behalf
of learned counsel appearing for CBI.
CRL.M.A. 7317/2021 (for suspension of sentence and grant of stay)
6. By way of the present application, appellant seeks stay of judgment
dated 01.04.2021 and suspension of sentence of the appellant awarded by
the order dated 05.04.2021 till the disposal of the appeal.
7. Learned senior counsel for the appellant has submitted that sentence
of the co-accused Bipin Shah has already been suspended vide order dated
04.05.2021. It is further submitted that appellant was admitted to bail and
sentence of the appellant was suspended for 60 days by the learned Trial
Court. He also submitted that fine has already been deposited by the
appellant. It is further submitted by learned senior counsel for the petitioner
that the appeal is not likely to be heard in the near future.
8. Keeping in view the facts and circumstances of the case, since the
appeal is not likely to be heard in the near future, the sentence of the
appellant awarded by the order dated 05.04.2021 is suspended till the
disposal of the appeal and appellant is admitted to bail on the same terms
and conditions as imposed by the learned Trial Court.
9. The appellant shall not indulge in any illegal activities and he should
not leave India without prior permission of the court below.
10 The appellant shall remain present in Court at the time of hearing of
the appeal.
11. The application is disposed of accordingly.
