 People are active politically. They take part in elections.

Dawid Bunikowski

They are interested in the development of their local communities. They are active, they
are aware of the rights and duties as citizens. This is civil society. They discuss, they want
to participate in, in, in power and they want to also have a look at what public authorities
do. They want to check public authorities and so on. There are people who are interested
in the common good. Yeah. You know, in Aristotelian sense, Aristotle said like this, there
is there is no, there is no state.

Dawid Bunikowski

That is happy if some group social group in this state is not happy. Yeah, so we have to
take into consideration different groups, different social groups in in, in a given society, if
we skip needs or interests of a given group, like a sexual minority like indigenous people
like, we mean like, you know, poor men and so on. If we skip the interests of these
people, it's not a happy society. Why? Aristotle says that.

Dawid Bunikowski

There is no happy state, happy society if we skip interest of of some groups. Yeah.
Because you know a part of our state is not happy. Yeah. Live in bad conditions, for
example. So. So this not about happy society in happy society we have to take into
consideration interests of different groups as we said for example in this self introduction
section while speaking with Emmanuel the farmers in Europe are protesting why why are
they protesting yeah because they are facing.

Dawid Bunikowski

Huge challenges concerning.

Dawid Bunikowski
They drops and yeah, because they see that they are not able to survive in the market. So
we have to take into consideration different voices. Also the voice of various minorities
and you will see in this course how important it is to take into consideration also the
voice of minorities. Yeah. So the rule of law, that's it very in a very simple way you have
to.

Dawid Bunikowski

Video as an officer.

Dawid Bunikowski

But includes human rights, and we have to have a civil society. People call active, ordinary
people who are interested about common good and in in the common good. Also here
there is there is just the definition of the rule of law taken from the United Nations
Secretary and just in the end of this meeting I will side this the rule of law requires as well
measures to ensure adherence to the principles of supremacy of law.

Dawid Bunikowski

Equality before the law. I can't. The ability to deal fairness in the application of the law,
separation of powers, participation in decision making, legal certainty, avoidance of
arbitrariness and procedural and legal transparency, and we will continue these
considerations during our next meeting. This is the rule of law in the definition of the
United Nations. Have a look, separation of powers. Maybe those people from Europe, of
course, like Finland, they are aware what was going on in Poland. That is a NATO country.

Dawid Bunikowski

European Union country, but what was going on here in the last eight years during the
ruling, the regime of the nationalist conservative law and Justice Party and the Party of
Yorosov Kachinsky, they were destroying the independence of the judiciary. They're
violating the rule of law in this sense because there was no separation of powers because
the executive power wanted to have too much influence on the judiciary. There is no the
rule of law. If judges are not independent and that was going on in Poland that, you
know.

Dawid Bunikowski

Judges were fighting for their independence. There was a huge strong resistance and
judges were very brave and and and the society did win it in the last elections last
October. You know, the the voters in Poland said goodbye to the populist, nationalist,
conservative law and Justice Party also because of this destruction that the tribe, the
atom to to destroy the judiciary system. Yeah. So the people said no, we don't like you.
We don't want you anymore. Yeah, because you are not a responsible political party
because you do not.

Dawid Bunikowski

Separation of powers seriously and separation of powers is extremely important and in

separation of powers we have also independent judges. Yeah. And and this important
part of the rule of law concept of of the concept of the rule of law. And we'll go back to
this of course definition during the next time. So far what we have done is that OK, we
defined good governance and we also started to define the rule of law. But I think it is
important to focus on these elements.

Dawid Bunikowski

Just to have this idea, you know what the rule of law is? You are asking the street by
someone what was the rule of law. I have imagination and you some element of this
definition of this concept here. I can speak about.

Dawid Bunikowski

OK.

Dawid Bunikowski

About obeying officials, but also that law includes human rights and that we have civil
society, but also you can go to those details like supremacy of law, equality before the
law, accountability to the law of fairness in the application, the application of the law, that
we are fair.

Dawid Bunikowski

do not treat someone better and someone someone else in a worse way like men in a
better way women in a worse way or vice versa yeah we are fair in in dialogue application
yeah
