Terms of Use of PhonePe Rent Payment

These Terms of Use regulate the use of Rent Payment service enabled by PhonePe
Private Limited, a company incorporated under the Companies Act, 1956 with its
registered office at Unit No.001, Ground Floor, Boston House, Suren Road, Off.
Andheri-Kurla Road, Andheri (East) Mumbai – 400 093, Maharashtra, India
(hereinafter referred to as “PhonePe”/ “We”/ “Us”/ “Our”). PhonePe has been
authorized in this regard by the Reserve Bank of India (“RBI”) to issue semi closed
PPI in accordance with the provisions of the Payment and Settlements Act, 2007 and
the regulations and directions issued by RBI from time to time.

“Rent Payment” is a service provided by PhonePe through the PhonePe Platform

which enables You to pay the rent of a leased premises to the lessor/landlord of the
said premises using PhonePe Platform.

By proceeding to use PhonePe’s Rent Payment service, You agree to be bound by

these Terms of Use in addition to agreeing to PhonePe Terms and
Conditions (“PhonePe T&Cs”) available at https://www.phonepe.com/terms-
conditions/, the Privacy Policy available at https://www.phonepe.com/privacy-
policy/ and all other applicable terms, policies and guidelines issued by PhonePe
from time to time. Whenever the context requires “Customer”/ “User”/ “You”/
“Your”/ “Yourself” shall refer to you the customer who fulfils the eligibility criteria
specified in PhonePe T&Cs and is a registered user of the PhonePe Platform. By
proceeding to use this Rent Payment service of PhonePe, You shall be contracting
with PhonePe. If You do not agree with any of these terms and conditions, then You
should not use the Rent Payment service of PhonePe.

For the purpose of these Terms of Use, “Beneficiary” shall mean the entity/person
who is the landlord of the premises for which You are paying rent using the Rent
Payment feature available in PhonePe Platform.

We reserve the right, at Our sole discretion, to change, modify, add or remove
portions of these Terms of Use, at any time without any prior written notice to You. It
is Your responsibility to review these Terms of Use periodically for updates /
changes. Your continued use of PhonePe App following the posting of changes will
mean and signify that You accept and agree to the revised Terms of Use. As long as
You comply with these Terms of Use, We grant You a limited privilege to utilize the
PhonePe App for availing Our Rent Payment services.

You shall be responsible for the documents/information and declarations provided

to PhonePe about Yourself, Your residency and tax status, and other material
information including but not limited to Your KYC documents. PhonePe shall not be
liable for incorrect documents/information and declarations and retains the right to
refuse activation and right to decline Rent Payment services to You and report such
incident to law enforcement agencies and the regulator(s).

You agree and understand that We may review the data/information provided by You
and undertake appropriate due diligence, including risk management. We may also
fetch data from other sources available in public or through Our business partners or
service providers which may pertain to You as part of due diligence and risk
management.

The features and any limits are subject to PhonePe’s internal risk assessment and
We may change/modify such limits, apply cooling period and restrict beneficiary
addition and limit the rent payment. You understand that We may or may not
communicate the above action to You.

We may monitor Your transaction(s) for probable high-risk/fraud transactions.

PhonePe, in its sole discretion and more particularly in cases where financial or
security risk is suspected or the transaction appears to be fraudulent, unlawful,
unauthorised or in violation of applicable laws, reserves the absolute right to reject
such transaction, disable, block, suspend or permanently disallow this facility to You
and may also report the incident findings/information to appropriate authorities.

You agree and understand that PhonePe, based on its internal policies, regulatory
and statutory guidelines may report transactions to appropriate authorities in case
such transaction is classified as suspicious or fraudulent and We shall not be made
liable for any loss caused to You for such obligatory reporting by Us, even if any such
transaction is found to be regular and lawful at a later stage.

USING THE PHONEPE RENT PAYMENT FEATURE IN THE PHONEPE APP INDICATES YOUR
AGREEMENT TO ALL THE TERMS AND CONDITIONS. HENCE, PLEASE READ THESE TERMS
CAREFULLY BEFORE PROCEEDING.

1. General Terms for Rent Payment

a. You agree and understand that PhonePe is neither Your agent nor an
agent of the Beneficiary. PhonePe is only a facilitator of payments
made by You to a Beneficiary.
b. You agree and confirm that You are availing the Rent Payment facility
solely for the purpose of paying rent to the Beneficiary as per the
terms of a valid agreement entered between You and the Beneficiary.
c. You agree and confirm that You are residing in or using the premises
for which You are paying rent to the Beneficiary using PhonePe’s
Rent Payment facility.
d. Your use of the Rent Payment service means and signifies that You
have authorized PhonePe to hold, receive and disburse funds in
accordance with its applicable terms and policies.
2. Setting up Rent Payment:
a. You agree and understand that Your payment shall be processed as
per the details submitted by You. For the purpose of availing the
Rent Payment facility in the PhonePe Platform, You may be required
to provide the following information about the Beneficiary:
 - Name of the Beneficiary;
- Account details of the Beneficiary (Bank Account details or UPI
Address);
- Amount of rent to be paid by You to the Beneficiary;
- Address of the premises for which You are paying the rent; and
- PAN card details (if required) of the Beneficiary.

b. For the purpose of transaction processing, You hereby authorize

PhonePe to access, fetch, share, use, store the information provided
by You for Rent Payment services on an ongoing basis.
c. You understand that correctness of information is of utmost
importance and You accordingly confirm to ensure and be
responsible for the correctness of the information provided by You to
PhonePe.
d. You understand that the amount to be paid by You to the Beneficiary
is specified in a valid agreement entered between You and the
Beneficiary and PhonePe has no obligation to verify the correctness
of the same.
e. You agree to keep Your account information up to date and comply
with these Terms of Use at all times otherwise PhonePe shall have
the right to suspend Your account or deny any of its services at its
sole discretion.
f. You agree that for providing the Rent Payment services to You,
PhonePe may share with the Beneficiary or with any other party, the
User identifier data, location/state and/or Your KYC information / any
other personal information.
g. You agree and authorize PhonePe to communicate with the
Beneficiary on Your behalf for processing the transaction.
h. You agree and understand that PhonePe may set up a rent payment
reminder facility.
i. You agree and understand that payment once made to the
Beneficiary is non-refundable.
3. Charges

a. You agree and accept that PhonePe may levy a convenience fee or
any other charges for providing the Rent Payment services to You.
4. Your Responsibilities: In connection with Your use of PhonePe’s Rent Payment services, You shall
be solely responsible for the following:

a. Verifying the success or failure of the transaction from the

transaction history and/or the notifications.
 b. Keeping a track of Your rent payment due dates. PhonePe shall not
be responsible for the same.
c. Scheduling Your bill payment well within the rent payment due date.
You understand that the payment realization time may vary
depending upon the mode of payment opted by You. We shall not be
responsible for the delays/ reversals or failure of transaction.
d. Providing accurate information for each payment instruction. You
agree and understand that We cannot reverse a payment once the
same is initiated as per Your instructions. We shall not be liable for
any loss incurred by You as a result of a transaction processed by Us
in accordance with Your payment instructions.
e. You shall indemnify PhonePe and/or the Bank/Card issuing company
from all claims, demands, actions, suits, losses, costs, charges,
expenses, damages, liabilities and expenses (including legal
expenses), arising directly or indirectly, which PhonePe and/or the
Bank/Card issuing company may pay, sustain, suffer or incur due to
or as a result of any false or incorrect information submitted by You.
f. deduction of applicable taxes as per the provisions of Income Tax
Act, 1961.
5. User Errors:

a. If You erroneously send a payment to the wrong party or double pay

or send a payment for the wrong amount (for instance a
typographical error at Your end) Your only recourse will be to contact
the said party to whom You have sent the payment and ask them to
refund the amount. PhonePe will not reimburse You or reverse a
payment that You have erroneously made.
6. Disclaimers:

a. You agree that all risks arising from online transactions shall be
solely borne by You.
b. Except as expressly provided in these Terms of Use, PhonePe
disclaims on its behalf and on behalf of its third-party partners, any
and all representations and warranties, either express or implied,
statutory or otherwise, with respect to the Rent Payment services
including without limitation warranties of merchantability, title,
fitness for a particular purpose, non-infringement, uninterrupted,
timely or error-free operation.
c. You agree that the Bank/Card issuing company facilitating this
transaction and PhonePe may from time to time (i) seek additional
information from You, (ii) conduct various verifications to cross
check such information, and (iii) initiate legal action against You, in
 case they are of the view that You have submitted any untrue and/or
incorrect tenancy details.
d. Except as expressly provided herein and to the full extent permitted
by law, the Rent Payment services are provided "as is", "as available"
and "with all faults". All such warranties, representations, conditions,
undertakings and terms, whether express or implied, are hereby
excluded. It is Your responsibility to evaluate the accuracy,
completeness and usefulness of the Services and other information
provided by PhonePe or generally available. We do not authorize
anyone to make any warranty on Our behalf and You should not rely
on any such statement.
7. Other Terms:

a. All other terms including terms such as User Registration, Privacy,

User Responsibilities, Indemnification, Governing Law, Liability,
Intellectual Property, Confidentiality and General Provisions etc. are
deemed to be incorporated into these Terms of Use by reference to
the PhonePe T&Cs.
