The plaintiffs are present with their counsel Shri V.K. Kautkar
advocate. They have filed an application (Exh.60) to withdraw the suit
unconditionally contending that the matter has been amicably settled
between the parties outside the court. Defendant No.2 has given no
objection for withdrawal of the suit. Rest of the defendants failed to file
reply on present application.

2. The plaintiffs are admitting the contents of the application

(Exh.60) for withdrawal of suit. The said application has been made on
affidavit stating that the plaintiffs do not want to prosecute with the
matter owing to the settlement outside the court. The learned counsel for
plaintiff submitted that the matter may be disposed of being withdrawn by
the plaintiffs unconditionally. In view of above, I pass the following order.
i. The proceeding of the suit is hereby closed being withdrawn
by the plaintiffs unconditionally.
ii. The parties shall bear their own costs.
iii. The application Exh.60 stands disposed of accordingly.
iv. The court fees be refunded to the plaintiff as per rules on
making an application.
