NOTIFICATION

No.A. l2018/73/2009 - P&AR(GSW), the 28th October, 2009. In exercise of the powers conferred
by the proviso to article 309 of the Constitution of India, the Governor of Mizoram is pleased to make the
following Rules relating to recruitment to the post(s) of Additional Chief Engineer, Superintending Engineer,
Executive Engineer, Sub-Divisional Officer/Assistant Engineer under Minor Irrigation Department, Mizoram
namely :-

Short Title and 1. (1) These Rules may be called the Government of Mizoram Minor Irrigation
Commencement Department (Group ‘A’ posts) Recruitment Rules, 2009
(2) They shall come into force from the date of publication in the Official
Gazette.
Application 2. These rules shall apply to the posts specified in column 1 of the Annexure – I
hereto annexed.
Number of posts, 3. The number of the said posts, their classification and the scales of pay attached
Classification and thereto shall be as specified in column 2 to 4 of the Annexure – I
Scale of pay
Method of 4. The age limit, qualifications and other matters relating to the said posts shall be
Recruitment, age as specified in column 5 to 14 of the Annexure – I aforesaid;

Qualifications
Provided that the upper age limit prescribed for direct recruitment may be
relaxed in the case of candidates belonging to the Scheduled Castes/Scheduled
Tribes and other special categories of persons in accordance with the orders
issued by the Central Government or by the Government of Mizoram, as the case
may be, from time to time.

Disqualification 5. No person
a) who has entered into or contracted a marriage with a person having a
spouse living; or
b) who having a spouse living has entered into or contracted a marriage with
any person, shall be eligible for appointment to the said posts;
Provided that the Governor may, if satisfied that such marriage is permissible
under the personal law applicable to such person and to the other party to the

marriage and that there are other valid grounds for doing so, exempt any such
person from the operation of this rule.

Training and 6. Every Government servant recruited under these Rules shall undergo such training
Departmental or pass such Departmental Examinations as may be prescribed from time to
Examination time.

Powers to transfer 7. Notwithstanding anything contained in these Rules, the Governor of Mizoram, in
public interest, shall have the right and power to transfer any officer so recruited
under these rules to any other post or position which is equivalent in rank or
grade.

Power to relax 8. Where the Governor is of the opinion that it is necessary or expedient so to do, he
may, by order and for reasons to be recorded in writing and in prior consultation
with the Mizoram Public Service Commission through the Department of Personnel
& Administrative Reforms, relax any of the provisions of these Rules with respect
to any class or category of persons, except the educational and technical
qualifications.

Reservation and 9. Nothing in these rules shall affect any reservation and other concessions required
other concessions to be provided for the Scheduled Castes/Scheduled Tribes and other categories
of persons in accordance with the orders issued by the Central Government or
Government of Mizoram from time to time in this regard.

Repeal and Savings 10. All Rules pertaining to the posts of Joint Director (Agricultural Engineering) now
re-designated as Superintending Engineer (P&D), Executive Engineer under
Agriculture Department, Assistant Engineer(Agril. Engineering)/Sub-Divisional
Agriculture Engineer/Sub-Divisional Agriculture Engineer (Mechanic)/Soil
Conversation Engineer framed by the Government of Mizoram under Gazette
Notifications

1) No.A.12018/73/80-APT(B) dt.17.8.1987,
2) No.A.12018/73/80-APT(B) dt.3.4.1990
as amended by the Notification
No.A.12018/73/80-APT(B)/Vol-I dt. 21.1.2002 and
3) No.A.12018/73/80-APT(B)/VOL-dt.29.6.1998
in respect of the present posts in the Minor Irrigation Department stand hereby
repealed;

Provided that any order made or anything done or any action taken under
the rules so repealed, or under any general order ancillary thereto, shall be deemed
to have been made, done or taken under the corresponding provisions of these
Rules.
