APPLICATION ON BEHALF OF THE DEFENDANT IS AS

FOLLOWS:

1. The Defendant is appearing in the present matter today before the

Hon’ble Court. That the Defendant has received the said summons
on 2nd Feb 2024 to Appear in the said matter on 8 th February
2024.

2. That the Defendant appeared in the present matter on 2 nd April

2024 through its Advocate and also mentioned orally before this
Hon’ble court to direct the counsel of the Plaintiff to provide the
Defendant with the copies of Exh.1 i.e., Suit and Exh. 3 i.e. List of
Documents along with documents filed.

3. That the Defendant hasn’t received any documents regarding the

said matter till date ant that the service of summons is improper
without the service of Exh. 1 and Exh. 3 of the captioned matter.
Hence under the said circumstances the Defendant is unable to file
its reply/Written statement in the Present matter.

4. Thus, considering the above-mentioned reason it is necessary that

the matter may be adjourned and directions be given to the
Plaintiff to Provide with the copies of the said matter to the
Defendant, and time may be given to this Defendant to file the
Reply dealing with the case made by the Plaintiff in the interest of
justice.

It is therefore most respectfully prayed that;

a. The Application may kindly be allowed, and matter may kindly
be adjourned and time may kindly be granted to the Defendant
to file its Reply dealing with the documents produced by the
Plaintiff.
 b. Directions may kindly be given to the Plaintiff to Provide with
the copies of the said matter to the Defendant.

c. Any other order in the interest of justice may kindly be passed.
