In turn, the said Sri.Muniyappa, sold and re- conveyed land bearing Sy.no.11/3, measuring 2 acres 03 guntas situated at Samethanahalli Village, Anugondanahalli Hobli, Hoskote Taluk unto Sri.Sonnappa by virtue of a Sale Deed dated 16.03.1955 registered as doc no.3095/1954-55. in Book-I, Volume-820, entered in Pages 172 to 173, at the office of Sub-Registrar, Hoskote. WHEREAS thereafter, Sri.Sonnappa together with his. son Sri.S.M.Munivenkatappa Urf Appanna for a valuable consideration, sold and conveyed land bearing Sy.no.11/3, measuring 1 acre 32 guntas situated at Samethanahalli Village, Anugondanahalli Hobli, Hosakote Taluk (ie. the Schedule Property) in favour of Sri.R.Raghava Reddy & Sri.R.Dasharath (Vendor herein) under a Sale Deed dated 29.09.1983 registered on 08.11.1983 as doc n0.1831/1983-84, in Book-I, Volume-1672, entered in pages 32 to 34, at the office of Sub-Registrar, Hoskote. The sale transaction wast acted upon by transfer of mutation register bearing MR no.2/1985-86 by the office of RR. Shirasthedar, Hosakote Taluk. WHEREAS the said Sri.R. Raghava Reddy (co-owner) released his right, title and interest over the Schedule Property along with another property in favour of his brother Sri,R.Dasharath (Vendor herein), through a Release Deed dated 12.02.2004 and registered as doc n0.3974/2003-04, in Book-l, stored in C.D. The Vendor hereby assures the Purchaser that the Schedule Property is the self acquired property of the Vendor, he having acquired the same out of his self earned funds, without any aid or assistance from his family members. 3. The Vendor further assures the Purchaser that he has not done or suffered any act, deed or thing whereby the Schedule Property or any part/s thereof, hereby conveyed is or may be subject to any claims, clogs, demands, charges, pending litigations, attachments, encumbrances and maintenance charges of whatever kind or nature, whereby the Vendor may be prevented from conveying the same, absolutely to the Purchaser herein, according to the true meaning and correct intent of this deed. 4. The Vendor covenants and assures the Purchaser, that he will indemnify and save harmless the Purchaser, against all losses, expenses or damages, incurred or sustained on account of any encumbrances, attachments, claims, charges, clogs, hindrances, lispendens, etc., of whatever nature in or upon the Schedule Property or any portion/s thereof or on account of any defect in ttle, latent, patent or otherwise. 5. The Vendor covenants and assures the Purchaser, that he and all persons claiming through/under him shall henceforth and from time to time at the request and cost of the Purchaser do execute or cause to be done or executed all such acts, deeds and things and all other assurances as may be reasonably required for further and more perfectly assuring the title to the Schedule Property hereby conveyed and every part thereof and have this day handed over physical vacant possession of the Schedule Property, according to the true meaning and intent of this deed. Over and above the foregoing covenants and assurances, the Vendor specifically covenants and assures the Purchaser as follows; a) That the Schedule Property is free from all kinds of liens, mortgages, charges, disputes, attachment by the decree of any court or otherwise, court injunction, acquisition proceedings, Wil, Trust, Surety, Stay order, religious and family disputes of any kind whatsoever. b) That the Schedule Property is not a granted land to Schedule Caste and Schedule Tribes and there is no prohibition or bar. or impediment for sale of the Schedule Property to anyone else. ©) That he has ngt alienated the Schedule Property or encumbered it in any way to anybody and that he has not entered into any agreement/arrangement to sell the Schedule Property to any other person/s and that the rights of the Vendor in and upon the same, are very much in force and that there are no rights of any other person/s subsisting, in respect of the Schedule Property, except the rights of the Vendor herein, which are hereby being transferred under this deed of sale to the Purchaser herein. o pe.7 amie Hes Document Sheet BF |) cago ude tat Osos || Date of Exeation d) The Vendor further assures that there are_no easements, quas easements, restrictive covenants or other rights or servitudes running with the property. 2) That the Schedule Property is free from any demand of the Government departments of the nature of Income tax, Wealth ‘ax, Gift tax or any other tax which would affect his title to the Scheaule Property or any portion thereof. f) That the Vendor as on date, has a subsisting, good, clear ane marketable title and absolute right to the Schedule Property and fully empowered in law and in fact to deal the same g) That the Schedule Property does not form the subject matter of any court litigation or tand acquisition proceedings. h) That the Purchaser may enter upon and take physical possession of the Schedule Property and enjoy the same peacefully without any manner of let or hindrance or any daim/s being advanced thereto by the,Vendor or any person/s claiming through or under him or in trust for him. i) The Vendor fully indemnifies and shall keep indemnified the Purchaser from any loss incurred or sustained by the Purchaser through any fault of the Vendor for not disclosing any material fact/s pertaining to the Schedule Property. @razarale— % Verda, i aa! The Schedule Property has been described in the Schedule on the basis of available documents and any error or omission in the schedule part shall not invalidate this sale. 9. The Vendor has this day delivered all relevant original documents of title, pertaining to the Schedule Property to the Purchaser. 10. The Purchaser is also placed in actual vacant physical possession of the Schedule Property by the Vendor. 11.
