The Las Gaviotas HOA Rules

(These Rules are stated in the CCNRs or adopted by the Supervisory Committee
pursuant to the CCNRs. They are applicable to Homeowners, Visitors and Renters.)

1. Noise and Gatherings: Nuisance noise levels are prohibited at all times and in all
places. All noise must be minimal during a Quiet Period between 10pm and 8am.
During the Quiet Period persons may not gather in outdoor spaces, such as patios,
streets, walkways, malecon areas, pool area and entry area.
2. Home Occupancy: Renters and visitors without a Homeowner present are limited to
two persons per legal bedroom. No exceptions. Violators will be treated as trespassers
and the Municipal Police will be summoned.
3. Speed Limit: 8 miles per hour.
4. Vehicles & Parking: All vehicles must have a “Vehicle Permit” on windshield. Two
vehicles per home. Excess vehicles park outside complex. Motor homes, campers,
trailers and buses are not permitted at any time. Motor cycles may be used between
home and gate only. Vehicles impeding traffic will be towed.
5. Visual Nuisance: Do not hang laundry, wetsuits, clothes, bathing suits, towels and
similar items on railings and parapets. Umbrellas, flags, banners and similar items may
not block forward ocean views. Drones may not be flown over any homes or any
common area other than the ocean and beach areas.
6. Public Behavior: Disorderly conduct, public nudity, illegal drug use, bribery are
prohibited. Law enforcement will be called.
7. Misconduct: Physically threatening a person and similar hostile behavior is prohibited.
Law enforcement will be called.
8. Glass Containers: No glass containers and bottles are permitted in any area outside
of homes, including the malecon areas, paseos, pool area and roadways. Please use
plastic cups or aluminum cans.
9. Fireworks: No fireworks or exploding devices allowed at any time.
10. Animals: Renters and visitors cannot bring pets into the complex. The pet and its
owner will be evicted from the complex.
11. Fire Pits: To be attended at all times. No roof top fire pits allowed. Please be
considerate to residences downwind of a fire pit.
12. Pool and Spa: Use of the pool and spa is prohibited from Midnight until 8:00 a.m.
Wetsuits are prohibited in pool and spa. Diapered children are prohibited in pool.
Children under 13 years must have adult supervision in the pool and no children under
15 years are permitted in spa at any time. Other posted rules apply.
13. Beach: The beach is closed from Midnight until 6am. Fires are permitted in fire rings
only at all times.
14. Children’s Playground and Putting Green: Hours are from 9am to 6pm (except

during Daylight Savings Time the hours are extended to 7:30pm). Posted rules apply.
Children must be supervised by an adult.
15. Tennis Court: Hours are from 8am to 10pm. Tennis only. Tennis attire and tennis
footwear required. Posted rules apply.
16. Streets and Walkways: The use of skates, skateboards, rollerblades, bicycles and
golf carts is prohibited on the malecon areas and paseos. Please be considerate of
pedestrians on the streets.
17. Homeowner Areas. The library, computer room and gym may only be used by
homeowners. Minors must be accompanied by the homeowners.
18. Private Areas. Visitors and Renters are permitted on a homeowners property only
with the express invitation of the homeowner. Violators will be treated as trespassers.
19. Solicitors and Vendors: Without written approval from Administrator, solicitors and
vendors will be treated as trespassers.
20. Visitors: Only homeowners are permitted to have guests and visitors. Renters are
not permitted to have guests or visitors and their presence in the community will be
treated as a trespass.
21. Garbage: Homeowners must provide garbage receptacles sufficient for the number
of people who occupy or rent their homes. The receptacles must be in an enclosed area
or have lids to prevent access by rodents and sea gulls. Renters must be instructed to
put their garbage bags in these receptacles, not on the street in front of the house. On
garbage pickup day, Las Gaviotas will move the receptacles to the street.
22. Drones: Use of drones is permitted only over the ocean and is not permitted over or
close to houses. Drones used over the ocean must be launched from the beach. A
drone operated over or near a house will be treated as trespass.

Las Gaviotas HOA Rules and Fines
The Las Gaviotas Rules are a matter of common sense & safety and will be strictly
enforced at all times. A Violation of the Rules may result in a Fine assessed against the
homeowner. Repeated or serious violations may result in Mexican Law Enforcement
being summoned and eviction of the offender(s) may occur. The Administrator may
refuse entry to or evict renters or visitors on account of a violation of the Rules. Renters
whose presence in the community will be a violation of the occupancy rules will not be
granted entry to the community regardless of whether their name(s) appear on the entry
form.

Fines for Violation of Las Gaviotas Rules

Rule 7 Misconduct $300


Rules 1, 2, 6, 10, 18 and 20 Noise, $100 for first offense by any member of a
Occupancy, Behavior, Animals, Trespass renter group
and Guests $200 for each additional offense by any
member of the same rental group charged
in the first offense
Rule 9 Fireworks $200
All other Rules $100

Note to Homeowners:
Fines are meant to deter conduct that interferes with the quiet and peaceful enjoyment
by homeowners and renters of homes and common areas. A fine levied on account of
violations of the Rules by a renter is charged to the homeowner who has granted
access to the community to such renter. Renters do not directly pay the fines.
Homeowners who rent their homes are encouraged to take steps to stop violations of
the Rules before they occur. Good practices include interviewing renters by telephone
before they arrive, instructing your property manager if you have one to appear
personally at your house when renters arrive to inform them about the Rules and ask
that they respect the neighbors, and posting in your house a copy of the Rules and a
statement that they will be strictly enforced by the guards. Homeowners who rent should
also consider whether the amount of deposit they require is sufficient to discourage a
violation of the Rules by their renters. Anyone who sees or experiences a violation of
the Rules is encouraged to report the violation to the guards immediately. Based upon
their observations at the scene of a reported violation, the guards will determine
whether a violation has occurred.
