On 12/02/11, at approximately 0229 hours, I, Officer Maynard, was preparing to turn onto southbound Broadway from Arapahoe Ave. when I was flagged down by the driver of an Xcel Energy truck. The driver advised me that there was a male walking down the center of Broadway south of University Ave., and the male was "taunting" cars. I turned southbound onto Broadway, and was again flagged down by a cab driver who again advised me there was a male walking down the middle of Broadway.

I drove down Broadway and observed a male standing, facing south, on the dotted white lane marker in the center of the two northbound lanes of Broadway near a bus stop just north of the intersection of Broadway and 15th St. I activated my overhead lights, exited my vehicle, identified myself as a police officer and ordered the male (later identified as Noah Adam Miranda) to come toward me. Miranda began walking away from me down Broadway, so I told him to exit the roadway. Miranda ignored me and continued walking down Broadway. I approached Miranda from behind, grabbed his right arm with my hands and maneuvered him over toward the east curbline of Broadway and made him sit down. Miranda immediately began yelling at me. He asked me why I had put my hands on him, and I advised him he had not heeded my directions, so I had to physically remove him from the roadway. I immediately placed him in handcuffs from my safety until I could determine the nature of the situation (I advised him of this). He kept repeating, "what did you say, what did you say?" I redirected him by asking him what he was doing in the roadway. Miranda advised me that he was "conducting a study." I asked him what kind of study, and he advised he was trying to determine whether drivers had enough concern for his welfare and courtesy to avoid him in the roadway. I asked him under what authority he was conducting the study, and he stated, "what authority, what authority, my authority." I asked him if he had any desire to hurt himself or anyone else, and he stated, "no." Miranda had bloodshot and watery eyes, and I could smell the odor of an alcoholic beverage on his breath. I asked him how much alcohol he had consumed, and he stated, "Why? It's protocol to give me a blood test, isn't it, isn't it?" I advised him that he was pedestrian, and it was not out protocol and I was simply interested in how much alcohol he had consumed. Miranda advised me since approximately 2230 hours on 12/01/11, he had consumed one shot, two glasses of rum with coke and one pitcher of long island ice tea. Once other officers arrived, I placed Miranda in the rear seat of my patrol car. I advised him that I was placing him under arrest for obstructing the roadway. I then transported him to the Boulder County Jail. While enroute to the jail, Miranda was very verbally antagonistic. He began by asking me why I became a police officer. I was willing to engage him in a civil conversation, however, I had to call out that I was going to the jail. Miranda immediately began to rant about how I did not know why and I could not answer him. He then stated that I would not answer him because I was being recorded. I advised him that we were not being recorded, and he began to rant, yelling and screaming, for the rest of the trip to the jail about how I had authority and I could do what I wanted because we were "off the record," and how it was ridiculous that we had computers in our cars but no audio recording devices. He would ask me questions, and as I would attempt to respond, he would cut me off and go into another rant repeating the same statements over and over again. Once we were at the jail, he was immediately taken to discipline. Because of this, he was unable to sign his summons. This case is cleared with an adult arrest.
