Dear Sir,

My client M/s Piramal Revanta Ravik CHS Ltd., Mulund (W) Mumbai (hereinafter referred to as “my

client) has place before me, a legal notice dated 29.06.2024 sent by you on behalf of your client Mrs

Salma Begam Mohammed Rafique S (hereinafter referred to as “your client) having flat no.0303 in

the society and has instructed serve upon your client the following reply cum-legal -notice.

That my clients most respectfully submit as under: -

At the outset, it is pertinent to mention here that the content of the notice under reply if not

specifically admitted and which are contrary to the records, are deemed to be categorically and

vehemently denied.

1. At the very outset, the content of para 1 of your notice it is submitted that it is a matter of

fact.

2. At the outset for the content of the para 2 it is the matter of record.

3. Content of para 3 my client has denied that the violation of any statutory provision of the

Model Bye-Laws of Co-Operative housing society and arbitrary maintenance charges

levied for creation of fund and utilisation and investment. The said bill is issued as per

statutory provision of Model Bye-Laws of Co-Operative housing society.

With reference to the para no.4 and 5 my client submit that maintenance charges has

levied as per the Model Bye-Laws of Co Operative Housing Society under the provision of

Maharashtra Cooperative Society Act 1960.

4. We refer to para 6 (a) in your notice regarding charges for water will be charged on the

total inlets in the flat however there is nominal difference calculated as per inlets and the

actual charges, which is shown on equal basis in the maintenance bill , the actual water

charges as per inlets will be calculated as per the Model Bye-Laws of Co- Operative

Housing Society under the provision of Maharashtra Cooperative Society Act 1960, form

the month of May 2024 to September 2024 and difference will be adjusted in the

maintenance bill for the month of October 2024 that is after upcoming AGM, which has

been already discussed in the SGBM which was held on 19.05.2024 which meeting was

attended by your client.

5. We refer to para 6 (b) in your notice regarding electricity charges for common area it is

submitted that the electricity charges for common area will be divided equally amongst all

the members and it will be recovered from all the member equally as per hybrid method

as per the provision of Model Bye-Laws for Co -Operative Housing Society under the

provision of Maharashtra Cooperative Society Act 1960.

6. We refer to para 6 (c) in your notice regarding insurance and the maintenance charges of

the society it has been charged for society premisses will be divided equally amongst all

the members and it will be recovered from all the member equally as per the area of the
flat on actual basis by hybrid method as per the Model Bye-Laws of Co- Operative
Housing Society under the provision of Maharashtra Co-operative Society Act 1960 as per
the discussed in the Special General Meeting held on 19.05.2024.

7. We refer to para 6 (d) in your notice regarding repairs and Maintenance fund and Sinking

fund and educational and training fund has been charged as per the Model Bye-Laws of

the Co-Operative Housing Society. Which is already explain in the Special General Meeting

held on 19.05.2024. The said meeting was attended by your client.

8. Content of para 7 my client says and submit that no any illegal charges has been charged

to any member of the society. Every charge in the maintenance bill is as per the law and

as per the Bye-Laws of the Co-Operative Housing Society.

9. The Content to the para 8 and 9 my client says that my client has always co-operate to all

the members. Earlier your client has demanded for copy of Model Bye-law of the Society.

My client has handed over the original Model Bye-law of society to your client to take

print out for the same. Your client also demanded for copy of all common expense’s bills,

which was my clients has given for checking on 26.05.2024.

10. Under these circumstances, I am hereby call upon you to desist from sending any kind of

such notice to arise dispute and withdraw your legal notice as early as possible to avoid

any further legal complications.

11. A copy of this legal notice is retained in my office for further necessary action.
