Delay Condonation Application U/s 5 of Indian Limitation

Act 1963.

The above named applicants most respectfully state as

follows-

1] The applicants have filed an appeal along with this delay

condonation application against judgment & decree

passed in RCS No. lS0/l0l9 on 19/07/2023, delay has
been caused for filing the appeal thus, appellant prays for

condonation of delay.
2) The applicant no.i 1s handicapped old lady
even walk without the support of other persqq.,

applicant no.2 being the son of applicant no.1 Is only
bread earner who occasfonallY lives in Mumbil dCJlnt
labour work there, for his earnings.

3) Applicant no.3 is agriculturalist, due to illite~acy he has

no knowledge of legal concepts thus, he was unable to file
the appeal within the prescribed limitation.

4] Due to low rainfall last year, the agricultural product of

applicants was not sufficient which made their financial
condition weaker which resulted in delay for filing the said

appeal.

S] Applicant no.3 to 6 are married daughters living with

their in-laws, thus they also were unable to file the said
appeal within the limitation.

6] The subject matter of about the appeal relates to the
immovable property and if the technical delay will not be
condoned by Hon'ble Court, then it may cause Injustice to
the applicants which will lead to the suffering of

BJ If the said delay will not be condoned, the doors of

justice will be permanently closed for the applicants & they
will face permanent injustice.

i] Delay of 8 months & 7 days caused to file appeal may

kindly be condoned & order to be numbered & registered
the said appeal shall be passed.

ii] Applicant may be allowed to amend & alter this

application as & when necessary.

iii] Pass such other order(s) as this Hon'ble Court may

deem fit and proper in the circumstances of case in the
interest of justice.
