ORDINANCE NO. 01

AN ORDINANCE ESTABLISHING COMMUNITY GARDENS IN BARANGAY CENTRO


NORTHEAST, SOLANA, CAGAYAN AND PROVIDING FUNDS THERETO

WHEREAS, Section 15 of the 1987 Philippine Constitution declared “that the State shall protect and
promote the right to health of the people and instill health consciousness among them”;

WHEREAS, Section 17 of the Local Government Code of 1991 or Republic Act No. 7160 provides
that barangays shall exercise powers and discharge functions and responsibilities necessary
appropriate to efficient and effective provision of the basic services and facilities;

WHEREAS, Executive Order No. 138, series of 2021 provides that the delivery of basic services
and facilities shall be devolved from the national government to provinces, cities, municipalities and
barangays – that each local government unit shall be responsible for a minimum set of services and
facilities in accordance with established national policies, guidelines and standards;

WHEREAS, the government sectors must utilize its fiscal, monetary and regulatory policies to steer
the development path towards enabling Filipinos to attain AmBisyon Natin 2040, to include
agriculture sector as essential factor in generating employment and addressing the problem on hunger
and food insecurity;

WHEREAS, in support to the thrust of President Ferdinand R. Marcos, Jr. in addressing hunger, and
ensuring food security in the country, the barangay shall implement the Halina't MAgtanim ng Prutas
At Gulay (HAPAG) sa Barangay Project introduced by Department of the Interior and Local
Government (DILG);

Be it ordained by the Sangguniang Barangay Member in session assembled that;

ARTICLE I
GENERAL PROVISIONS

SECTION 1. TITLE – This ordinance shall be known and cited as “AN ORDINANCE
ESTABLISHING COMMUNITY GARDENS IN BARANGAY CENTRO NORTHEAST,
SOLANA, CAGAYAN AND PROVIDING FUNDS THERETO”.

SECTION 2. DECLARATION OF POLICY – It is the policy of the barangay to intensify and


foster sustainable agricultural initiatives through the establishment, setting-up and operations of
barangay community gardens and providing funds for its stability and continuity.

As essential partners of the national government in contributing to addressing hunger, and ensuring
food security in the country, Barangay Centro Northeast shall adopt measures and implement various
initiatives and strategies to diversify food source and ensure sustainable and resilient production and
food availability.

SECTION 3. DEFINITION OF TERMS – The terms or phrases used in this Ordinance shall mean
as follows:
1. Barangay Community Garden - The barangay community garden shall refer to a piece of
land or several patches of land operated and cultivated by the barangay for the purpose of
planting and growing vegetables and fruit-bearing trees.

2. Container Gardening - refers to a micro model farming where a family unit or household is
producing fruits and vegetables in special containers for personal consumption.

3. Vertical Gardening - refers to a special kind of urban gardening suitable for small spaces,
particularly for decorating the walls and roofs in in various styles. It is an alternative method
for gardening by expanding the scope of growing plants in a vertical space.

ARTICLE II
POLICY CONTENT AND GUIDELINES

SECTION 4. ESTABLISHMENT OF BARANGAY COMMUNITY GARDEN

1. The community garden shall cover at least two hundred (200) square meter of land area or its
equivalent in several parcels of land located at:

(Ownership: Indicated if the land is owned by the city/municipality/barangay or by
private individuals/institutions.)

The barangays are encouraged to coordinate and request from the city/municipal government
for any vacant property owned by the local government or with private individuals who own
a certain vacant lot that can be used to establish the barangay community garden.

2. The barangay shall grow the following at the designated community garden:

Vegetable Plants Herbal Plants Root Crops Others


Leafy vegetables oregano sweet potato
vegetables Aloe vera Cassava
legumes Lemon grass Onion
Fruit bearing plants garlic

Barangays with suitable spaces are encouraged to plant bamboos (kawayan).

3. Barangays that do not have vacant areas, shall implement alternative gardening such as
container gardening, vertical gardening, square foot gardening, hydroponics, aquaponics, and
aeroponics.

4. Residents of Barangay Centro Northeast are likewise encouraged to set up their backyard
garden such as family vegetable garden and/or plant fruit-bearing trees in available open
spaces.

SECTION 5. ROLES AND RESPONSIBILITIES OF THE BARANGAY – The barangay shall:

1. Ensure the organization, reorganization, and strengthening of the Barangay Nutrition


Committee;

2. Include in their respective Barangay Development Plans and Annual Investment Programs,
applicable nutritional programs , projects, and activities to ensure adequate funding for
nutritional impact;
3. Ensure the formulation, or if existing, revision/updating of the Barangay Nutrition Action
Plan, to include and support the establishment of and maintenance of community gardens,
both at the barangays and households;

4. Designate one (1) Sangguniang Barangay Member, preferably the one who handles the
environmental concerns, to lead and manage the establishment and maintenance of the
barangay community garden, through an Executive Order;

5. The Punong Barangay shall also designate personnel from among the barangay officials and
staff, including the Barangay Nutrition Scholar, who shall assist in the operations and
maintenance of the barangay community garden;

6. Identify the area/s where the barangay community garden shall be established;

7. Set-up a community garden in a vacant area, preferably owned by the barangay or local
government concerned;

8. Together with the designated Sangguniang Barangay Members, coordinate with the
Municipal Agriculture Office or its equivalent for any available agricultural, training,
seminars, and capacity-building services, as well as seeding materials and other agricultural
equipment and facilities, that would help them in the operations of their barangay community
garden;

9. Lead the promotion of barangay community gardening to their community, including its
importance and benefits as well as the products produced through the community garden;
10. Promote agribusiness, especially for high-value products in the area;

11. Keep a record of the overall operations of the community garden such as the types of
seedlings planted, number f seedlings per plant planted, and number of vegetables and fruits
harvested (e.g. per sack, per piece, per kilo, etc.), among others;

12. Ensure the adequate provision of agricultural services and facilities in the barangay pursuant
to Section 17 pf the Local Government Code of 1991;

13. Enact an ordinance regarding the setting-up and operations of barangay community gardens
and allocate funds to sustain its operations;

14. Establish a group of volunteers in the community to help in the establishment of and
maintenance of the barangay community garden as well as spread the information in setting-
up household vegetable gardening and/or planting fruit-bearing trees; and

15. Submit necessary reports to the DILG Municipal Local Government Operations Officer
(MLGOO) on their compliance with the establishment of the barangay community garden.

ARTICLE III
FINAL PROVISIONS

SECTION 6. ALLOCATION OF FUNDS – The barangay, through the local Sanggunian, shall
allocate funds to sustain the operations of the barangay community garden.

SECTION 7. RECOGNITION AND AWARDS – The DILG shall develop guidelines for the
recognition and awards to barangays with exemplary performance.

To further encourage and motivate the residents, the barangay shall likewise give
recognition/incentives to communities/households with best practices/innovations in producing fresh,
healthy and affordable fruits and vegetables from their backyards and spaces.

SECTION 8. MONITORING AND EVALUATION – The DILG, through its MLGOO, shall
monitor the compliance of the barangay to this policy.
SECTION 9. REPEALING CLAUSE – All ordinances, resolutions, circulars, memoranda, or rules
and regulations inconsistent with the provisions of this Ordinance are hereby repealed and modified
accordingly.

SECTION 10. SEPARABILITY CLAUSE – If for any reason, any portion or provision of this
Ordinance is declared unconstitutional or invalid, the other sections or provisions hereof which are
not affected thereby, shall continue to be in full force and effect.

SECTION 11. SUPPLEMENATRY CLAUSE – On matters not provided for in this Ordinance,
any existing applicable laws and their corresponding implementing rules, executive orders and
relevant issuance issued therefore shall apply in a supplementary manner.

SECTION 12. EFFECTIVITY CLAUSE – This Ordinance shall take effect upon its approval.
