2. At the very outset, learned counsel for the petitioner submits that
petitioner has thrown challenge to the order of dismissal. The petitioner was
dismissed from service on 02.07.2011 on the basis of conviction on
02.03.2010. It has further been argued that on 25.11.2022 the petitioner has
been acquitted in Criminal Revision No.755 of 2011 under Sections 379 and
323 of the Indian Penal Code.

Since nothing has been brought on record to show whether after


acquittal petitioner has represented before the respondent no.2 for
reconsideration of his case, suffice, it would be if the petitioner files a fresh
representation along with copy of the acquittal order passed by the Court. On
receipt of the representation, the respondent no.2 shall consider the case, in
view of the certified standing order as well as prevalent rules, regulations and
laws and thereafter pass a reasoned order within a period of eight weeks.

3. Needless to say, if the petitioner is found entitled for reinstatement


appropriate order to that effect be passed and communicated to the petitioner
within a further period of four weeks.

4. Accordingly, the instant writ petition stands disposed of.
