“AN ORDINANCE INSTITUTIONALIZING THE WASTE SEGREGATION AND


COLLECTION PROGRAM OF BARANGAY PALAO, SOLANA, CAGAYAN”

WHEREAS, Republic Act No. 9003 provides for an ecological solid waste management
program, creates the necessary institutional mechanism and incentives, declares certain acts
prohibited and provides penalties for violation;

WHEREAS, it is the responsibility of the barangay to be effective and efficiently


implemented the Solid Waste Management System;

WHEREAS, the unsystematic waste disposal by households and commercial/industry


establishments cause unsightly surroundings and spread of communicable disease;

WHEREAS, the practice of waste segregation to facilitate reuse and recycling does not
reduce the cost of collection and disposal of garbage but conserved the natural resources of
materials and avoid wasteful consumption of goods.
NOW, THEREFORE, BE IT ORDAINED, AS IT IS HEREBY ORDAINED by the
Sangguniang Barangay of Palao, in its regular session duly assembled that;

Section 1. Title. This Ordinance shall be known as an “AN ORDINANCE


INSTITUTIONALIZING THE WASTE SEGREGATION AND COLLECTION PROGRAM OF
BARANGAY PALAO, SOLANA, CAGAYAN”

Section 2. Coverage. This Ordinance shall apply to all residential houses and commercial
establishments.

Section 3. Legal Basis. This Ordinance is enacted to implement the provision of Republic
Act No. 9003 which mandates the proper segregation and collection of household wastes.

Section 4. Definition of Terms.

1. Residual Waste – refers to the household rubbish not able to be recycled, re-used or
composed.
2. Special Waste – waste that requires special handling – trained people and/or special
disposal methods. It can be potentially infectious medical waste, hazardous waste,
pollution control waste on industrial process waste.
3. Biodegradable Waste – includes any organic matter in waste which can be broken
down into carbon dioxide, water, methane or simple organic molecules by micro-
organisms and other living things using composting aerobic digestion, anaerobic
digestion, or similar process.
4. Recyclable Material – refers to any waste material retrieved from the waste stream
and free from contamination that can still be converted into suitable beneficial use or
for other purposes.

Section 5. Purpose. This Ordinance is enacted for the following purposes:

5.1 To guide, control and regulated for the generation of solid waste within the Barangay and
promote an orderly and sanitary system for the same;

5.2 To enhance the total environment of the locality through the necessary control and
mitigation of negative environmental impacts of solid waste;

5.3 To promote and protect the health, safety, peace and convenience of the general welfare
of the inhabitants

of the Barangay;

5.4 To minimized the generation of solid waste and maximized possible


resource/recovery/recycling and utilization by:

a. Maximizing the use of goods and consumption of foods;


b. Encouraging the salvaging of possible “recoverable” from solid waste for re-use
and/or recycling back to production process; and

c. Encouraging the recycling and resource recovery of waste in own backyards


through composting.

Section 6. Mandatory Segregation of Solid Wastes. The segregation of wastes shall


primarily be conducted at the source, to include household, institutional, industrial,
commercial and agricultural sources: provided that wastes shall be segregated into the
categories provided in Section 2 of this Article.

Section 7. Requirement for the Segregation and Storage of Solid Waste Pending
Collection. The following shall be the minimum standards and requirements for the
segregation and storage of solid waste pending collection.

1. Owners of residential houses/buildings and business/commercial establishments are


required to segregate their waste and install and label their trash receptacles in a
strategic place within their premises;
2. The Waste shall be segregated into Residual, Special Waste, Biodegradable and
Recyclable;
3. Waste shall be placed or thrown only to the appropriate trash receptacle.
4. The above-named persons are responsible in storing and disposing their waste
respectively in accordance with this ordinance.

Section 8. Collection. All purok must have a designated strategic collection/drop-off points
to facilitate the segregated solid waste materials of the barangay. Only segregated solid waste
materials must be collected by the daily duty per purok.

Section 9. Fines and Penalties.

First Offense – Three Hours (3) Community Service

Second Offense – Three Hundred Pesos (P300.00)

Third Offense – Five Hundred Pesos (P500.00)

Section 10. Separability Clause. If any provision of this Ordinance or the application of
such provision to any person or circumstances is declared unconstitutional, the remainder of
this Ordinances or the application of such provision to other persons or circumstances shall
not be affected by such declaration.

Section 11. Repealing Clause. All Ordinances, Resolutions, Circulars, Memoranda, or Rules
and Regulations inconsistent with the provisions of this Ordinance are hereby repealed and
modified accordingly.
Section 12. Effectivity Clause. This Ordinance shall take effect upon its approval, after its
posting in at least three (3) conspicuous places within the barangay.
