LETTER OF EMPLOYMENT
We are pleased to offer you the position of Kitchen Staff with JS RASA SDN. BHD. The
Asam Pedas Place.
1.0 APPOINMENT
2.0 COMPENSATION
2.1 You will be paid a basic salary of Ringgit Malaysia One Thousand and Six
Hundred only (RM1,600.00) per month and shall be paid before 7th of every
calendar month.
2.2 Any claims or allowance for the month shall be paid on the 15th of every calendar
month.
2.3 Official salary review will be on annual basis, during Company’s annual focal
review.
2.4 You are entitled to the following claims:
- Medical Claim of Ringgit Malaysia Three Hundred Sixty only (RM360.00)
per year;
- All claim must be supported by original receipts.
3.0 PROBATIONARY
3.1 You shall serve a probationary period of three (3) months from commencement date.
3.2 at the end of the probationary period, your immediate manager will conduct written
performance review to decide on your confirmation. The company reserves the right to
extend your probationary period at the maximum of not more than six (6) months.
3.3 The company may at any time during your probationary period or at the end of
probationary period provide you with a notice of CONFIRMATION of your employment with
the company.
4.1.2 Your annual leave is on earned basis. You are expected to submit your annual
leave application it is being approved. The application should be made at least 7
working days in advance, otherwise it will be captured as an emergency leave.
4.1.3 You may accumulate and carry forward not exceeding for (4) days of your
annual leave to be the following company financial year provided that such leave
days shall be taken and cleared within the following company financial year. All leave
days not taken by such time shall be forfeited.
4.1.4 You are allowed to en-cash unutilized earned leave in the case of resignation,
retirement, retrenchment and termination of service for whatever reason. The
calculation of earned leave will be up to the last day of your employment in the
company. However, this will not be applicable if there is a case of major misconduct.
4.2.2 You are also entitling to 60 days hospitalization leave, which include non-
hospitalization sick leave as per schedule above.
4.2.3 The granting of paid sick leave will require to be supported by medical
certificates issued from registered medical practitioner.
4.2.4 You are expected to inform your direct manager that you will be absent from
work first thing in the morning (latest) due to sick leave and you are expected to
submit your medical certificate immediately the next day returning from work to the
manager as acknowledgment before passing the copy to HR processing.
4.3 The company recognizes 11 days gazetted Public Holidays per year.
5.1.1 Except in the event of breach of terms of your appointment, example major
misconduct of wilful default on your part, in which case company has the right to
terminate your employment forthwith without notice.
6.0 DUTIES
6.1 As the Kitchen Staff, you shall be responsible to undertake and provide the
duties that commensurate with the designation herein or which shall include but not
limited to those as set by your direct manager (Addendum II)
7.1 The Company reserves the right to transfer you to any other Department, parent
company, fellow subsidiaries or associate companies or to assign or modify your job
responsibilities and duties as and when it deemed necessary. Prior notifications will
be given to you before performing such change.
8.2 Overtime
8.2.1 You shall be paid and overtime at the rate 1.5x of your current basic
salary Per Hour
10.0 OTHERS
10.1 The retirement age for male and female employees shall be at the age of sixty
(60) years old
10.2 You are required to comply with all expressed and implied company policies,
rules and regulations that may be issued or amended by the Company from time to time.
10.3 You are required at all times to act in the best interest of the company. Trade
secrets and confidential information shall under no circumstances be divulged to any
unauthorized person (s) or firm (s). For the avoidance of doubt, this requirement is an
addition to any non-disclosure or confidentially undertaking that you may separately give or
will give to the company or its parent company, fellow subsidiaries or associates companies.
10.5 You shall participate in any compulsory statutory contributions as required by
the laws of Malaysia, which will be deducted from your monthly salary.
10.6 The terms and conditions of this offer are severable and if any term or condition
is held to be invalid or unenforceable by any court of competent jurisdiction then such
invalidity or unenforceability shall not affect the remaining terms and conditions offer.
10.7 The terms and conditions as set out herein shall not be amended, modified,
varied or supplemented unless in writing signed by duly authorized representative (s) of the
company and yourself.
10.8 This letter shall be governed by and constructed in accordance with the laws of
Malaysia.
