2. GETCO has submitted as follows :-


(1) GoG has issued Government Resolution (GR) Dated 31.12.2021 in line with the guidelines
issued by GoI and keeping relevant provisions of Electricity Act, 2003 for paying
compensation to the land owners for laying transmission lines on their land. As per GR dated
31.12.2021, the methodology of compensation calculation against RoW was that, the latest
Jantri rates to e escalated @ 10% compounding every year of the year, accordingly latest
available Jantri rate for the year 2011 was working out to be 3.13 times the value as on 2023.
(2) GoG revised the Jantri rates w.e.f. 15.04.2023, which are effectively double of that for the year
2011. Accordingly, the compensation amount gets reduced to 64%, which will lead to unrest
among the land owners, as even the present rates of 3.13 times are not acceptable to the land
owners. This would lead to important transmission projects being held up and would
adversely impact the growth of transmission network in Gujarat.
3. The above matter was deliberated in 149th Board Meeting of GETCO on 02.03.2023 and vide Board
Resolution dated 02.03.2023, a committee of Directors of GETCO consisting of following members, has
been formed, to deliberate and prepare the proposal regarding the issue of RoW compensation vis-à-vis
land acquisition and all related matters to the Government including jantri rates and resultant project delay
cost involved;

1. Shri P. Swaroop, IAS, Secretary (Land Reforms) and Commissioner of Land Reforms.
2. Shri Ravi Shankar, IAS, Director (Admin.), GUVNL.
3. Shri Upendra Pande, Managing Director, GETCO.
4. Shri H.P. Kothari, Director (Tech.), GUVNL.
5. Shri H.P.Desai, Independent Director.

4. Further, GETCO has informed that a meeting was held on 04.05.2023 at O/o Secretary (Land
Reforms) and Commissioner of Land reforms, wherein alongwith committee members District Collectors
of Jamnagar, Surendranagar, Devbhumi Dwarka, Kutch, Banaskantha, Navsari, Valsad and Surat, with the
objective to send proposal on the issue of RoW compensation vis-à-vis land acquisition and all related
matters to the Government including Jantri rates and resultant project delay cost involved and also to

deliberate and prepare the proposal which can be moved directly on the file through Energy &
Petrochemicals Department, GoG.
During the meeting a presentation was given by GETCO covering various challenges being faced
during execution of transmission projects. Following issues were also briefed by MD, GETCO:-

a. Inadequate compensation agitates the land owners causing delay and sometimes even complete
stoppage of the work which leads to mounting of huge CWIP and further deprives the
transmission licensee of their legitimate return;
b. The projects, i.e., expansion of existing transmission infrastructure, which is intended for the end
users too are deprived of power supply;
c. Electricity supply, being one of the most important input for business/ growth will also be
hindered, leading to a dent in the overall economy and consequential adverse effects;
d. Also, the agitating land owners who are losing their precious land will also not be compensated
fairly, which will in-turn creates social problems as well.

5. After deliberation, following suggestions were received from the District Collectors as well as
committee members:-
(1) Difference in compensations paid by private agencies vs GETCO for similar work, leading to
grievances from land owners.
(2) Difference in compensation throughout the same region, i.e., within 2km range for the same
district, or in adjoining land owners (due to high variation in jantri rates) causing grievances
from land owners.
(3) Need to fix a time-line for the decided jantri rates so that the land owners can expect a revision
from Government after the stipulated time-period.
(4) Rates of compensation of specific horticultures, example, Mango, Chikoo, Coconut etc., need
to looked into separately, based on the specific sensitivity/ specialization of the respective
area.
(5) Need to decide a formula based on which the DM/ Prant etc., may be able to derive the fair
compensation cost of respective land under dispute. Same formula to be made applicable to
Private agencies as well, so that the disputes arising from difference in compensation, can be
reduced.
(6) Need to review the tower alignment to avoid agricultural lands as far as possible.
(7) Need for prior planning so that the same piece of land may not be in dispute due to ROW
dispute related to two different organizations.
6. After deliberation the matter and considering the suggestion received from committee member and
District Collectors, Committee Recommended as follows:-
The doubling of Jantri rate w.e.f. 15.04.23 is a temporary measure and the survey for
deriving Jantri rate in a scientific way has started by the Revenue department and the
exercise is expected to be completed in four to five months. It is therefore proposed to
continue the methodology of compensation calculation, as per Tharav 31/12/21, i.e., rates
of existing Jantri (2011) with compounding 10% per year, for the next 6 months or till the
finalization of new policy, whichever is earlier.

7. The relevant Committee Report submitted by GETCO is placed on Pg. /cs for kind perusal please.

8. By submitting above, GETCO has requested State Government to take up the matter suitably
for necessary approval for the same.
9. In view of above, as of now, it seems that the recommendation of the committee as per para-6
above are needs to be consider and accordingly necessary Resolution needs to be issued in this
regard. Draft resolution is submitted for approval please.
9. In view of above all, if approved, the proposal as narrated in para-9 above may submit the
papers to State Government through Revenue Department and Finance Department for further
consideration and approval please.

3. The department has submitted the recommandation of the committee for consideration and accordingly
Draft resolution is submitted by the department for approval.

4. As mentioned in note-1, GoG has issued Government Resolution (GR) Dated 31.12.2021 in line with the
guidelines issued by GoI and keeping relevant provisions of Electricity Act, 2003 for paying compensation to the
land owners for laying transmission lines on their land. As per GR dated 31.12.2021, the methodology of
compensation calculation against RoW was that, the latest Jantri rates to e escalated @ 10% compounding
every year of the year, accordingly latest available Jantri rate for the year 2011 was working out to be 3.13
times the value as on 2023.

5. GoG revised the Jantri rates w.e.f. 15.04.2023, which are effectively double of that for the year 2011.
Accordingly, the compensation amount gets reduced to 64%, which will lead to unrest among the land owners,
as even the present rates of 3.13 times are not acceptable to the land owners. This would lead to important
transmission projects being held up and would adversely impact the growth of transmission network in

2. The matter under consideration relates to amendment in the Guidelines issues by State
Government, vide GR dated 14.08.2017, 31.12.2021 and 25.08.2023, for payment of compensation
towards damages in Right of Way for transmission line.
3. In this regard, it may be mentioned a meeting under the Charimanship of Principal Secretary,
Energy & Petrochemicals Department, was held to deliberate the "Modalities of laying transmission
lines and address ROW issues." under the chairmanship of PS Energy & Petrochemical Department,
GoG at EPD Gandhinagar on 09.11.23, wherein the following officials participated :-

1. Secretary (Land Reforms), Revenue Deptt., GoG


2. Secretary to Govt. (Expenditure), Finance Department, GoG ----as a special invitee.
3. Managing Director, GUVNL – Through VC
4. Managing Director, GETCO.
5. Joint Director of Agriculture, Directorate of Agriculture, Gandhinagar.

4. During the meeting, deliberation held are narrated as follows:-


i. Commissioner Land reforms informed about severe Row issues being faced in different
districts of Gujarat, particularly in the districts of Surat, Navsari, Valsad, Kutch and
Morbi. Accordingly, special meetings were held with the District Collector of these
districts and their suggestions were sought. He further informed that MoP, Gol has
constituted a committee of Chairperson CEA, CMD POWERGRID and PS Energy

department Gujarat and PS Energy of some of the other important states. A meeting of
the committee was held on 22.08.23, copy of MoM is placed at Annexure-I. Subsequent
follow-up discussions were also held.

1. MD GETCO gave a brief presentation; copy enclosed as Annexure-II. The following


issues arising due to ROW were focused upon:

a. Inadequate compensation agitates the land owners causing delay and sometimes
even complete stoppage of the work/projects which leads to mounting of huge
CWIP and further deprives the transmission licensee of their legitimate return;
b. The projects, i.e., expansion of existing transmission infrastructure, which is
intended for the end users too are deprived of power supply; also in some cases,
the transmission network is intended for RE-integration (evacuation of renewable
power), which also remains unfulfilled due to ROW; (such as Green Energy
Corridor schemes)
c. Electricity supply, being one of the most important input for business/growth will
also be hindered, leading to a dent in the overall economy and consequential
adverse effects;
d. Also, the agitating land owners who are losing their precious land will also not be
compensated fairly, which in-turn will create social problems as well.

1. Existing practices of various states (like Andhra Pradesh, Kerala, Maharashtra, Goa,
Odissa, T.N., Meghalaya etc.) were also presented and deliberated.
2. Transmission network planning of GETCO by 2032 was shared with the committee
especially for South Gujarat and Saurashtra-Kutch region. It was informed that
about 13,000 ckm transmission network in South Gujarat region and about 25,000
ckm transmission network in Saurashtra-Kutch region has been planned by 2032
3. Further, it was highlighted how crucial it is to resolve the ROW/ Compensation
issues timely in order to achieve the set targets which will in turn fulfil both, RE-
Generation evacuation targets as well as DISCOM consumer targets.

1. MD, GUVNL suggested that payment of fair compensation to land owners is essential
for timely resolution of RoW issues enabling transmission licensees to complete and
capitalize their transmission projects timely.

1. Participatingmembers deliberated on various aspects including practices in place in


other smaller and bigger states. Suggestions given by POWERGRID were also
discussed. Guidelines of MoP, Gol dated 15.10.2015 and Tharav of GoG dated
31.12.2021 were deliberated in detail. Based on various inputs, PS EPD advised that
compensation to be given to the land owner for tower footing area and for the line
corridor should be fair and policy framed for compensation should address this issue.

1. As discussed above, not only present value of the land gets diminished substantially but
also future purpose and therefore future value of the land gets compromised and
diminished. It is, therefore, essential that the land owner needs to be compensated
adequately and fairly. Accordingly, double the rate of Online Jantri rate is considered
just for considering compensation.

5. In order to evolve suitable policy within Gujarat and providing input to the committee
constituted by MoP/Gol, following is proposed after detailed deliberation:

(iii) Also, for calculation of damages to fruit bearing trees, the GR vide no. LAQ- 22-
2018/1550/G Dtd. 12.01.21 (for tree prices) in conjunction with GR no. LAQ-
222018-1550-G Dtd. 13.07.23 (for derivation of tree valuation) are required to be
followed. (Enclosed as Annexure III).
(iv) Also, it is desirable to get consultation from local administration during
the finalization of the route alignment. Laying of lines can be
minimized in agricultural lands, if waste/ gauchar land is available
subject to technical suitability even by re-routing the line.
*Note: The ROW width (transmission line corridor) is as per the MOP guidelines for ROW
compensation dated 15.10.2015, enclosed at Annexure IV.

Further, It was informed that at present, the average compensation cost is about 5 to 6% of
transmission project cost and as per the proposed compensation rates, the same would be about
10 to 11% of the transmission project cost (cost of transmission line as well as substation
combined).

6. The Recorded Note of the Discussion and decision taken by the Committee is submitted for
kind perusal please.
7. The recommendation made by the Committee, as mentioned in Para-5 above, seems to be in
order and perhaps, may be approved by the Government. It may be mentioned that the Guidelines as
suggested above, would be from prospective effect and applicable to all ongoing transmission line
work with effect from the date of GR, to be issued in this regard. However, cases settled (where
compensation has been finalized) shall not be re-opened. Other terms and conditions of the
Government Resolution dated 14.08.2017 and 31.12.2021 will remained unchanged.

8. Further, GETCO was asked to submit the details regarding financial implication on account of
recommendation made by the Committee. In response to the same, GETCO has submitted the details
via e-mail dated 13.12.2023, which are briefly narrated as follows:-

1. The additional financial implication (only for compensation- Tower base Area + RoW Corridor)
has been worked out based on proposed guideline considering average jantri rate of Rs.300/- per
Sqmtr for 1 Route Kilometer (RKM) line for each 400 KV, 200 KV, 132 KV and 66 KV voltage
class for tower based area and RoW corridor:-

9. Furthermore, GETCO has clarified that on account of implementation of proposed guideline,


GETCO will have to pay higher compensation but it is reiterated that the implementation of
recommendation made by the Committee, would help in terms of following :-

i. Speedy clearance of Right of Way (RoW)


ii. Timely completion of project
iii. Cost saving with reference to the total project cost as well as saving of cost of
litigation.

10. In view of above all, If approved, the proposal as contained under para5 above, may be
submitted to State Government, for further consideration and approval please. On approval, this may
be conveyed to the Revenue Department, all the Collectorates, GUVNL and GETCO, for further
appropriate actions.

suggested above, would be from prospective effect and applicable to all ongoing transmission line
work with effect from the date of GR, to be issued in this regard. However, cases settled (where
compensation has been finalized) shall not be re-opened. Other terms and conditions of the
Government Resolution dated 14.08.2017 and 31.12.2021 will remained unchanged.

8. Further, GETCO was asked to submit the details regarding financial implication on account of
recommendation made by the Committee. In response to the same, GETCO has submitted the details

Sqmtr for 1 Route Kilometer (RKM) line for each 400 KV, 200 KV, 132 KV and 66 KV voltage

GETCO has further clarified that about Rs.893.08 crore increase in Annual CAPEX of
GETCO on account of revision in Compensation guideline which may result in increase of
transmission tariff by 0.85 paisa / unit .

9. Furthermore, GETCO has clarified that on account of implementation of proposed guideline,


GETCO will have to pay higher compensation but it is reiterated that the implementation of
recommendation made by the Committee, would help in terms of following :-

i. Speedy clearance of Right of Way (RoW)


ii. Timely completion of project.
iii. Cost saving with reference to the total project cost as well as saving of cost of
litigation.

10. In view of above all, If approved, the proposal as contained under para5 above, may be
submitted to State Government, for further consideration and approval please. On approval, this may

With the rapid developmental activities in State and at national level as well, demand in energy
sector is increasing day by day. And for this purpose, setting up of transmission infrastructure viz.
Transmission Lines of different voltage class, Sub-station etc. are necessary to cater increasing
power demand and to supply uninterrupted power. It is observed that while setting up these
infrastructure, severe ROW issues are faced by the developers and implementation of project is
delayed considerably.
In some cases, with other reasons, due to ROW issues in Projects of National importance and
State level projects like DFC, NHAI, NHRCL, GEC, KSY etc. are delayed by average two to six years
in its completion. This has caused not only project over run, but also cost over run. Therefore, to
resolve the ROW/Compensation issues timely in order to achieve the set targets, existing practices of
various states (like Andhra Pradesh, Kerala, Maharashtra, Goa, Odissa, T.N., Meghalaya etc.) were
also presented and deliberated in the aforesaid meeting.

Considering all these, it was also deliberated and discussed in the aforesaid meeting that
payment of fair compensation to land owners is essential for timely resolution of ROW issues enabling
developers to complete the projects timely so that project over run and cost over run can be
minimised. Moreover, it will also facilitate DISCOMs to supply quality power to end users.
Keeping in view facts narrated in above note, if agreed, we may request Govt. to consider and
approve the proposal as submitted above.

Above Note - 58 to Note - 79 may please be seen. The proposal of revision of the
compensation norms for ROW issues for Transimission Network is under consideration in this file. In
this regard, as per the discussion held in presense of MD-GETCO and an email dt.19/02/2024
received from GETCO may kindly be read.

It is pertinent to mention here that Electricity sector is fully interconnected and integrated though
Generation, Transmission and Distribution have been segregated as separate business entities.
Economics of one impacts other one also. Considering future power requirement, various
developments taking place in the sector, shifting of energy sources from fossil fuel to non-fossil RE
and accordingly need of development of transmission system, economics of overall power supply
suggests in-depth study.

The proposal is resubmitted with a request to consider the following points:-

(1) The planning of transmission systems has been strategically aligned with the locations of
Generation Sources, Capacities and Demand Centres. Now, the emphasis has shifted towards
tapping into the vast potential of Renewable Energy (RE). This shift necessitates the development of
transmission infrastructure that extends from renewable energy sources to demand areas. Although,

this may result in a lower utilization factor and potentially higher transmission costs, it is a strategic
move that facilitates greater integration of renewable energy and broadens access to sustainable
energy solutions. GETCO has designed strategic plans for the next 5 and 10 years, taking into
account generation locations, demand growth, and various important projects of GoG such as
Daytime power supply for agriculture, Tribal Area Sub Plan (TASP), Sagarkhedu Sarvangi Vikas Yojna
(SSVY).

(2) As projected by GETCO the transmission cost will rise from present notional level of 39 paisa
per unit to 50-52 paisa per unit after 5 years and expected to be in the range of 65-68 paisa per unit
after 10 years.

(3) To counterbalance the rise in transmission costs, promoting decentralized renewable energy
generation is crucial. Encouraging the installation of Solar Rooftops and Off-grid Solar Pumps in
Agriculture Sector may also reduce the need of transmission systems to some extent by enabling
energy consumption within the vicinity of same areas where it is generated. However, balanced
approach is needed while designing transmission system such that these pockets will remain
adequately connected to the main grid for getting cheaper and reliable power. This will not only help in
further reducing losses but will also attract consumers to get income by way of injecting surplus power
into the grid. This will further motivate these sets of consumers to use electricity in economic way by
adopting efficient use of electricity such as energy efficient Solar Pumps, Drip Irrigation System etc. to
optimize their income. On the other hand, DISCOMs will also get some cheaper power.

(4) As of now, Battery Storage System is not that much cost-efficient, which suggests its
implementation on a smaller scale. Similarly, Pump Storage is also constraint of being contingent on
specific locations, and co-optimization is expected to occur once the costs of storage systems
decrease.

(5) Keeping in view the overall rapid growth in all sector, need for quality power supply is also
necessary. And as narrated above, setting up Transmission Network is also required in pace with
Generation. Considering that developers are required to complete their projects in time bound
manner. With an aim to enable the developers to complete their projects timely so that project over
run and cost over run can be minimised and further to facilitate DISCOMs to supply quality power to
end users by resolving the ROW/Compensation issues timely in order to achieve the set targets is
necessary. For all these purpose, payment of fair compensation to farmers/land owners is
essential for timely resolution of ROW issues. Therefore, in view of facts narrated above, if
agreed, we may request Govt. to consider and approve the proposal as submitted above.

2. The matter relates to amendment in the Guidelines issues by State Government, vide GR
dated 14.08.2017, 31.12.2021, 25.08.2023 and 01.03.2024, for payment of compensation towards
damages in Right of Way for transmission line and considering the payment of fair compensation to
farmers/land owners is essential for timely resolution of RoW issues.

3. In view of above, PowerGrid Corporation of India Limited (PGCIL), vide their letter dated
12.03.2024 has raised the formal objection to a specific clause included in the Government
Resolution, dated 01.03.2024, summarized as under:

The amended GR, dated 01.03.2024, contains a specific clause as: "..........the local
administrative authority has to be consulted before finalizing the route of the transmission
line........."

The aforementioned subject clause directly contravenes several statutory provisions and settled
legal principles and also raises significant concerns regarding its legality and potential impact on
the successful & smooth completion of transmission line construction throughout the State of
Gujarat.

The subject clause for consulting the local administrative authority before the finalization of the
route of transmission line appears to be direct contradiction of statute and the settled legal
provisions recited by various High Courts and Apex Courts through their judgments. Inclusion of
such a clause in the subject Government Resolution, ipso facto contradicts those legal
provisions, and the Government is potentially putting the licensees who are engaged in
transmission line construction at risk.

The subject clause in the Government Resolution has the potential to deeply affect the
completion of various ongoing/future transmission line construction projects which are in pipeline
throughout the State of Gujarat under ambitious 30GW Khavda RE Zone project.

Majority of the transmission line projects are awarded under TBCB Regime and the positioning of
the proposed Sub-stations and the route alignment of its allied transmission lines would have
had finalized by the Bid Processing Co-coordinators and based on the above facts only the
competitive bidders/transmission licensees are able to succeed in the bidding process and
getting the awards of the projects for its timely implementation. In such circumstances,
reviewing/repositioning of the route alignment at any point thereafter leads to increase in cost
and huge delay in execution of the project.

Further, the finalization of the route alignment of the transmission line will be done by the
Transmission Licensees through experts after walk- over survey, detailed & check survey
considering all the technical, ecological and environmental factors/aspects and such finalization
of the route cannot be consulted/reviewed by any individual or administrative authority at any
stage. It is for the Transmission licensee to decide the appropriate land to locate the towers as
per the techno economic feasibility & technical requirement/parameters. A particular route of the
transmission line will be identified by the transmission licensee after due study and considering
all the relevant factors/aspects and it is not for any local administrative authority to be consulted
and to point out as to which land is to be utilized and as to which land should not be used. If such
consultations/objections are entertained, it would be detrimental to the highly technical
functioning of the transmission licensees whose statutory duty is to establish Inter-State
Transmission System running into hundreds of Kilometers. If people or any local administrative
authorities are permitted to decide the route alignment of the transmission line, the transmission
lines cannot be established according to the norms, standards and the required parameters. The
above settled provisions have been time and again reiterated by various judgments of High
Courts & Apex Court of the country.
4. It is pertinent to mention here that, as per the amendment in the Guidelines issues by State
Government, vide Government Resolution dated 01.03.2024, Specific subject clause (No.2) narrated
word to word as follows:

“લાઈનનાં માર્ગ (Route) નક્કી કરતા પહેલા સ્થાનિક વહીવટી સત્તામંડળો સાથે જરૂરી પરામર્શ કરવો અપેક્ષિત

As the intention for inclusion of the aforementioned clause, is to minimize the various RoW
issues arising during the laying of the transmission lines and by checking the availability of waste
land or gauchar land and with consultation with the local administrative authority, it aided the
selection of the best possible route for laying of the said transmission line, which may be least
prone to the emergence of severe RoW issues.

5. In view of above all, if approved, we may inform PowerGrid Corporation of India Limited
(PGCIL) regarding their formal objection in the Government Resolution, dated 01.03.2024, as per
Para-4 above, as justification regarding the said formal objection.

Although, papers are submitted for further consideration and orders please.
