WHEREAS, originally the total land belonged to and owned by SHRI


SHANKARRAO RAJARAM KADAM.
AND WHEREAS, as a result of the urban land ceiling act -1976, (hereinafter
referred to as ‘THE CEILING ACT’) which come in to force in the State of
Maharashtra on .the 17 Feb 1976. The original owner was not entitled to hold
any vacant land in excess of the ceiling limits except as otherwise provided in
the Ceiling Act.

AND WHEREAS, the origin owner having been shown to be the owner of the
said land in the Govt, and revenue records. The original owner submitted to the
Govt. Maharashtra (hereinafter referred to as the ‘The Government’) an
application u/s 20 of the ceiling Act for exempting the said land from the
provisions of the ceiling Act.

AND WHEREAS, a draft statement was filed by, Shri Shankarrao Rajaram
Kadam and 8 units were released, as ceiling free out of the total land
admeasuring 1H 49 Ars and 3840 sq. mtrs, of land was declared as surplus by
the Competent Authority, Pune Urban Agglomeration, Pune vide its order no.
ULC/WSHS/20/D-3/B-1084/93 dated 2-3-93, the said surplus land is being
separately developed as per the orders of the Competent Authority thereto.

AND WHEREAS, the said original owner, Shri Shankarrao Rajaram Kadam
expired .on 3.12.93.--Leaving behind his heirs viz. 1) Shri Vithal Shankarrao
Kadam 2) Shri Shivaji Shankarrao Kadam 3) Shri Madhavrao Shankarrao
Kadam 4) Shri Krishna Shankarrae Kadam 5) Shri Ashok Shankarrao Kadam 6)
Sbri Shashikant Shankarrao Kadam 7) Mrs. Suman Digambar Kaibhor & 8)
Mrs. Kamal Namdeorao Kalekar which names were entered and recorded on the
7/12 extract as per the mutation entry No.184.

AND WHEREAS, by release deeds dated 13.9.1994, executed by 1) Mrs.


Suman Dknunbarrao Kaibhor- and 2) Mrs. Kamal Namdeorao Kalekar
separately and both these registered with Sub-Registrar Haveli No.9 Pune, ; the
said releasers released: all their rights, title and interest in the said land ; in
favour of the remaining heirs and as such only the first six above named heirs
become entitled to the said property. The layout of the land was prepared and
submitted to the P.M.C. which was sanctioned by their order no.
DPO/-3443/II/488 dated; 3-8-94 wherein six equal area plots admeasuring
584.10 sq. mtrs. each were carved in the layout. The said equal area plots
admeasuring each 584.10 sq. mtrs. were shared amongst the six heirs and shares
entitled to it and by a deed of partition dated 24/09/1996 thereto amongst the six
heirs, being the six brothers, the said partition deedHvas registered with the sub-
registrar Haveli no.9, Pune at serial no. 8898/56 on 25/09/1996, the.; 1/6 share
of the present Owner being plot no. 1, admeasuring 534.10 sq. mtrs., came to be
partitioned by metes and bound and of sole and exclusive Joint Hindu Family
property of the Owners family which is more particularly described in the
Schedule ‘A’ hereinbelow written. The Owner is desirous of developing the said
property.
AND WHEREAS, the PROMOTER himself being the karta, of the Hindu
Undivided Family i.e. The owner decided to develop the said property and to
put up -building thereon at their own costs and expenses, which the owner has
agreed to do on certain terms and conditions mutually agreed upon by between
them.

AND WHEREAS, by agreement DT. 25/01/2001 executed between the owner


viz. Shri. Madhavrao Shankarrao Kadam (H.U.F) hereinafter referred to as
“THE O WNER.’ 'of the one. part and the Promoter of the other part, the said
joint owner appointed the Promoter to develop the piece or parcel of the lane!
which open land is lying and being at Katraj, being S.No 7/1, (New) (6/i old),
Plot no.!, this land admeasuring 584.10 Sq.mtrs. with Additional F.S.I. of
104.61';Scj:.mtrs. of the D.P. Road, or there about more particularly described
in the-schedule ‘A’ hereunder written (hereinafter referred to as the ‘Said
Land5) and further the owner having executed a Power of Attorney dated
25/01/2001 in favour of the Promoter, thereby empowering the promoter to
construct therein building/s and bungalow/s and cause development of the said
land in accordance with the terms and conditions contained therein;

The Pune municipal corporation sanctioned a building plan, vide letter no. 320
dated 13/04/1999; -and forther revised vide letter no. 1872 dated 02/02/2001.
SCHEDULE DESCRIPTION OF THE APARTMENT
The said apartment No. 07 is situated on Stilt First floor of the building . named
‘YASHRAJ’ APARTMENTS which building is situated on the Schedule ‘A’
Plot of land located in internal part of remaining area of Ratraj bearing S.No
7/1, Plot. No. 1, of Katraj, Pune. The apartment being . a residential family unit
consisting of total built up area 500.00 sq.ft. and / terracearraof;52.00 sq.ft.

ALL'EASEMENTARY RIGHTS THERETO ALONG WITH ' All that prices


and parcel of land and ground situated within the registration sub-dist. Taluka -
Haveli, Dist.- Pune and within the limits of Pune Municipal Corporation bearing
S.No. 7/1, (New) of village Katraj Pune totally admeasuring 1 H 49 Ars located
in internal part of remaining area of Katraj, of the land being 584.10 sq. mtrs.
and extra F.S.I of 104.61 Sq.mtrs. to be consumed on the said pl'ot.no. 1. And
